5. At all relevant times herein, the Defendants, through
their agents, apparent agents, servants, members, and/or employees
provided care and rehabili tationto Arthur Kramer, (hereinafter Mr.
Kramer) .
6. At all relevant times herein, all registered nurses,
licensed practical nurses, nursing assistants, nurses aides,
respiratory therapists and ancillary care providers were agents,
apparent agents, servants, members, and/or employees of Defendants
and were acting within the scope of their employment.
7. At all relevant times herein, Defendants had the right
and duty to exercise, control, authority, and/or supervision over
these above listed agents, apparent agents, servants, members,
and/or employees who provided care and rehabilitation to
Mr. Kramer.
8. At all relevant times herein, Plaintiff reasonably relied
upon Defendants' expertise, competence, professionalism, and
training of its agents, apparent agents. servants. members, and/or
employees.
9. At all relevant times herein, Mr. Kramer was receiVing
rehabilitation for injuries sustained in an April, 1996 fall in
which he SUffered a broken neck, back, ribs, and a puncture of one
of his lungs.
10. Following the aforementioned fall, Mr. Kramer was taken
to the York 'I'rauma Center and then transferred to the Hershey
Medical Center where he underwent stabilization surgery.

11. Despite the stabilization surgery, Mr. Kramer remained
paralyzed from his nipples down and had very little movement of his
upper extremities.
12. Notwithstanding his conditions, Mr. Kramer remained
mentally alert, oriented times three and often even humorous with
staff members.
13. Additionally, after the stabi 1 ization surgery, Mr. Kramer
experienced respiratory problems which necessitated the performance
of a tracheostomy in order to better control his airway.
14. While at Hershey Medical Center, Mr. Kramer was required
to undergo frequent suctioning of his tracheostomy due to the
amount of his airway secretions.
15. On or about May 13, 1996, Mr. Kramer was transferred to
Defendant Heal thsouth for rehabil itation therapy and nursing care.
16. The Healthsouth nursing staff knew that Mr. Kramer had
paraplegia, weak upper extremities, shortness of breath, rhonchi in
his lungs, productive cough with thick sputum, swallowing problems,
and that he had a tracheostomy with tracheostomy tube placement and
thus its accompanying communication problems.
17. Due to Mr. Kramer I s paraplegia and ~Jeak upper
extremities, he was unable to suction his own trach and airway free
of secretions. He was completely dependent on the staff of
Healthsouth for this vital function.
18. The Heal thsouth staff knew that Mr. Kramer was completely
dependent upon them for auctioning his trach and for all vital

functions and had a duty to pr.ovide this care in a reasonable and
prudent manner.
19. Additionally, Mr. Kramer's only means of summoning
a~sistance from his room to the nurses down the hall was his call
bell system.
20. Thus, because of his tracheostomy tube and resulting
inability to yell for help, his only means of notifying the nursing
staff that he needed clearing of his airway or suctioning of his
respiratory secretions was his call bell system.
21. On May 13, 1996, Mr. Kramer was visited by his daughter,
Lisa Andrews. During her visit she noted that Mr. Kr.amer's call
bell was attached to a box positioned out of reach above
Mr. Kramer's head.
22. Mrs. Andrews notified his nurse that Mr. Kramer was
unable to reach the call bell. In fact. she specifically informed
the nurse that twice Mr. Kramer needed nursing assistance and had
attempted to reach the call bell but was only able to get within
two inches of it due to his weakened condition.
23. The Healthsouth staff had a duty to provide Mr. Kramer
with a reasonable means of calling for help.
24. Moreover. because of Mr. Kramer's tracheostomy tube and
breathing problems, ~lr. Kramer .,;as ordered treatment and care by
Healthsouth's respiratory therapists four (4) times a day. This
correlates to treatments every six hours. The Healthsouth staff
therefore had a duty to examine and suction Mr. Kramer's trach at
least every six hours.

25. In spite of this order, respiratory care was only
performed three (3) times that day (10:45 a.m., 3:15 p.m., and
7:50p.m.).
26. At approximately
6:00 a.m.,
on May
14,
1996,
approximately ten (10) hours after his last treatment by a
respiratory therapist, two (2) hours after the last registered
nurses note (which recorded "no suctioning required") and ten (10)
minutes after being turned by a nursing assistant, (who have no
training to suction a tracheostomy), Mr. Kramer was found in his
bed without respirations and a pulse.
27. Cardio-pulmonary resuscitation (CPR) was begun. A code
was called and Mr. Kramer's tracheostomy was suctioned four (4)
times for four (4) large amounts of thick yellow/brown secretions.
28. Plaintiff avers that due to the lack of respiratory and
nursing care, Mr. Kramer developed a thick mucus plug in his airway
which blocked his breathing, that Mr. Kramer was unable to reach
the call bell to summon for help and thus went into respiratory and
cardiac arrest.
29. Mr. Kramer's respirations began again and he was
transferred to Holy Spir i t Hospital, where he subsequently died
from complications of this incident on May 31, 1996, at the age of
sixty-two (62).

JO. Paragraphs one through twenty-nine (29) are incorporated
herein by reference as if set forth at length.
J1. At no time, while Mr. Kramer was admitted to Healthsouth,
did any Healthsouth nursing staff member do a full, "head-to-toe"
physioal assessment of Mr. Kramer.
32. .'urthermore, clt no time was Mr. Kramer's airway suctioned
by nurses at Hoalthsouth prior to his respiratory arrest, nor was
there oven Am record of a nurses evaluation of his breathing.
JJ. Defendants knew or should have. known that Mr. Kramer
required suctioning of his airway due to his respiratory condition.
34. Defendants knew or should have known that Mr. Kramer
required the assistance of Defendant's staff in the suctioning of
his airway and the maintenance of a patent airway.
J5. Despite this knowledge, Defendants, through their nurses
and nursing and ancillary staff failed to properly assess and care
for Mr. Kramer's compromised respiratory status.
J6. Additionally, despitp. this knowledge, Defendants did not
provide Mr. Kramer with an adequate means of notifying the
Hoalthsouth staff that he was experiencing airway difficulties.
J7. Defendants also knew or should have known that Mr. Kramer
had not been provided with an adequate means of communication (call
bell) to request assistance from the Healthsouth staff.
J8. Defendant Healthsouth is liable to Plaintiff for their
negligence and/or gross negligence in:
(a) placing Mr. Kramer in a non-monitored room out of
sight of the nurses station;

(b) not performing a head-to-toe assessment on Mr.
Kramer;
(c) not assessing Mr. Kramer's breathing, lung sounds,
and/or respiratory status prior to his r.espiratory arrest;
(d) failing to suction his airway and tracheostomy tube
at any time prior to his respiratory arrest;
(e) failing to assess, monitor, care for, and/or suction
Mr. Kramer's airway, especially in light of the fact that Mr.
Kramer had a passy Muir valve plug in his tracheostomy;
(f) failing to have in place a communication device
(call bell system) which Mr. Kramer could have activated with
a blow of his breath or a touch of his fingers;
(9) failing to place a communication device (call bell)
within Mr. Kramer's reach;
(h) failing to have registered nurses assess Mr.
Kramer's respiratory condition;
(i) allowing nursing assistants, who are not trained in
the suctioning of tracheostomies, turn Mr. Kramer every two to
three hours;
(j) failing to have sufficient numbers of adequately
trained staf f on the floor at the time of Mr. Kramer's
admission;
(k) failing to recognize the high level of care needed
by a patient such as Mr. Kramer who had a history of
paraplegia, weak upper extremities, shortness of breath.

(1) failing to provide Mr. Kramer with an adequate

arrest, even after being informed by Mr. Kramer's daughter
that the placement of his call bell was insufficient and
unsafe; and
(m) failing to properly assess Mr. Kramer for breCithing
difficulties, physical limitations, and for placing him in a
non-monitored room away from the nursing staff.
WHEREFORE, Plaintiff, Patsy E. Kramer, Individually and as
Executrix for the Estate of Arthur H. Kramer, Deceased, demands
judgment against Defendant, Heal thsouth corporation and Heal thsouth

40. Plaintiff, Patsy E. Kramer, brings this action on behalf
of the Estate of Arthur H. Kramer, under and by virtue of the Act
of 1976, July 9, P.L. 586, No. 142, 52, 42 Pa. C.S.A. 58302.
41. Defendants are jointly and severally liable to the Estate
of Arthur H. Kramer for damages as set forth herein.
42. Plaintiff, Patsy E. Kramer, as Executrix of the Estate of
Arthur H. Kramer, Deceased, and Patsy E. Kramer, individually,
claims for the damages suffered by the said Estate by reason of the
death of the decedent, for the pain and suffering the decedent
underwent prior to his death, the loss of earnings and earning
capacity for decedent's life expectancy, and for all other damages
sustained by the said Estate by reason of the death of decedent.
WHEREFORE, Plaintiff, Patsy E. Kramer, Individually and as
Executrix of the Estate of Arthur H. Kramer, Deceased, demands
judgment against Defendants, Healthsouth Corporation, Healthsouth

services at the facility located in Mechanicsburg, cumberland
County, Pennsylvania,
3. Admitted in part; denied in part, It is admitted that
Defendant, Healthsouth of Mechanicsburg, Inc, is registered with
the Pennsylvania Department of State Corporations Bureau and
maintains a registered fictitious name therewith of "Healthsouth
Rehabilitation of Mechanicsburg-Acute Rehab Hospital." It is
denied that Healthsouth Corporation maintains any such fictitious
name and/or is registered to do business under any such
fictitious name with the Department of State Corporation Bureau,
To the contrary, Healthsouth Rehabilitation Corporation had,
until January 18, 1995, registered a fictitious name of
"Healthsouth Rehabilitation of Mechanicsburg-Acute Rehab
Hospital;" however, from January 18, 1995 continuing to the
present, the former Healthsouth Rehabilitation Corporation is now
!<nown as Heal thsouth Corporation,

Defendant, Healthsouth of Mechanicsburg, Inc" provided care to
Arthur Kramer and did so through agents, servants and/or
employees, By way of further answer, and because there are no
allegations of which alleged agents, servants and/or employees
Defendant, Healthsouth of Mechanicsburg, Inc. is alleged to have
provided care and/or rehabilitation to Arthur K~amer, Healthsouth
of Mechanicsburg, Inc, lacks information sufficient to otherwise
form a belief as to the truth of these allegations and

accordingly the same are denied, Additionally, the allegations
of this paragraph constitute conclusions of law to which no
further responsive pleading is required and accordingly the same
are denied and proof thereof is demanded at trial, Insofar as
Defendant, Healthsouth Corporation is concerned, the allegation

the basis that it constitutes a conclusion of law to which no
further responsive pleading is required.

Defendant, Healthsouth of Mechanicsburg, Inc" provided care to
Arthur Kramer and did so through agents, servants and/or
employees. By way of further answer, and because there are no

Defendant, Healthsouth of Mechanicsburg, Inc. is alleged to have
provided care and/or rehabilitation to Arthur Kramer, Healthsouth
of Mechanicsburg, Inc, lacks information sufficient to otherwise

accordingly the same are denied. Additionally, the allegations
of this paragraph constitute conclusions of law to which no

which any physician or physicians provided professional services
to Plaintiff's Decedent,
53, Defendant, Healthsouth of Mechanicsburg, rnc" did not
render any medical and/or surgical or professional services to
plaintiff or Plaintiff's Decedent, Under the Pennsylvania
Medical Practice Act or 1985, 63 P,S, ~422,10 ill';. , sea" only an
individual person may be licensed as a medical doctor to practice
medicine and surgery, At no time hereto was Healthsouth of
Mechanicsburg, Inc, licensed as a medical doctor and Healthsouth
of Mechanicsburg, rnc, did not, in fact, have the right to
supervise, direct or control the manner in which any physician or
physicians provided professional services to Plaintiff's
Decedent.
54, All care and treatment rendered to Plaintiff's Decedent
by Healthsouth of Mechanicsburg, Inc, was appropriate, reasonabl.e
and within the applicable standards of care.
55. Defendants are entitled to contribution in accordance
with the Pennsylvania Comparative Negl.igence Act, 42 P,S. ~7102,
56. In the event that it is determined that Defendants were
negligent with regard to any of the allegations contained in and
with respect to Plaintiff's Complaint, said allegations being
spacirically denied, then such negligence was superseded by the
intervening negligence acts of other persons, parties and/or

organizations other than Answering Defendants and, over whom
Answering Defendants had neither control nor right of control
and/or responsibility and, therefore, Answering Defendants are
not liable in this action.

persons, partnerships, corporations or other legal entities
caused or contributed to the injuries or exacerbation of any pre-
existing condition of the Plaintiff's Decedent, then the conduct
of Answering Defendants was not the legal cause of any Buch

to constitute negligence were not substantial factors
contributing to the injuries and/or damages described by
Plaintiff in his Complaint,

same were caused in whole or in part by persons or entities over
whom Answering Defendant had no duty to supervise or control and

Plaintiffs, through their attorney, hereby propound the following
Interrogatories to defendants pursuant to Pennsylvania Rule of
Civil Procedure 4006 to be answered within thirty (30) days from
service thereof. These Interrogatories shall be deemed to be
continuing Interrogatories. If, between the time of your answer
to said Interrogatories and the time of the trial of this case
you, or anyone acting on your behalf, learns the identity and
whereabout.s of any other witnesses not identi.fied in your said
answers, or if you obtain or become aware of additional requested
1nformation not supplied in your answers, you shall promptly
furnish the same to plaintiffs' attorney by a supplemental
answer.
For the purposes of these Interrogatories, .:Y2..u or "your" refers
to the defendants and their files and all other persons, ~ent~
or representatives of the defendants and their files.' You
shall further include all persons on whose behal f defendants
prosecuted this action and all persons who will benefit or be
legally bound by the results of this action. Your answer to the
Interrogatories shall reflect and contain the knowledge of all of
the above persons.
References to plaintiff and/or defendant shall be interp~eted as
singular or plural, depending upon the particular circumstances
of each case.
The term "description" or "describe" as used herein shall mean
that the defendants shall set forth the name and address of the
author or originator, dates, title or subject matter, the present
custodians of the original and of any copieD and the last known
address of each custodian. "Document" shall mean any written,
printed, typed or other graphic matter of any kind, whether
handwritten, typed or printed, whether distributed or
undistributed. It shall include without limitation letters,
memoranda, articles, studies, notebooks, diaries and notes, as
well as all mechanical and electronic sound recordings or
transcripts thereof in the possession or control of the
defendants or known by them to exist. It shall also mean all
copies of documents by whatever means made.

AND NOW, comes the Plaintiff, Patsy E. Kramet", Individually
and as Executrix of the Estate of Arthur H. Kramer, by and through
her attorneys, Angino & Rovner, P.c., and hereby requests this
Honorable Court to Compel Defendants to supply full and complete
answers to Plaintiff's discovery, In support of her Motion,
Plaintiff avers as follows:
1. 'L'he instant medical malpractice action was commenced by
the filing of a Complaint on or about December 12, 1997.
2. On February 4, 1999, Plaintiffs fot"wat"ded to counsel for
Defendants, one Intert"ogatory seeking the identities of Defendants'
employees and other health care providers whose initials and/or
signatures appear in decedent's medical recot"ds ft"om their
facHi ty. Copies of this Interrogatory are attached hereto as
Exhibit A (red ink ad2ed to copy) ,
3. Because Defendants had provided no response to any of
these discovery requests, by lettet" dated May 5, 1999, Plaintiff
requested advisement as to when answers cou ld be expected. A copy
of that letter is attached het"eto as Exhibit B.
4. pennsylvanla Rule of civil Pt"ocedut"e 4006 provides that
the answering party shall set"ve a copy of theit" answet"s within 30
days after th~ set"vice of Intet"t"ogatot"ies.
5. To date, appl'oximately 1.1f! days have passed since
Oefendants t"eceived service of Plaintiff's discovet"y and Plaintiff
has yet to receive any answet"s to any of their requests,
6. All of the discov€Jt"y sought by Pl<lintiff tht"ough their
requests is relevant to the instant <lction, in conformance with
Pennsylvania Rules of civil Pt"ocedut"e 4001 and 400].

7. Our rules of civil Procedure provide for the liberal
granting of discovery.
8. Defendants have failed to comply with discovery as
required by the Pennsylvania Rules of civil Procedure 4006.
9. DefendantB have had more than ample time to respond to
Plaintiff's requests.
10. Plaintiff avers that answering all of her discovery
requests would not burden or oppress Defendants. certainly,
Defendants are in a better position to identify their employees and
the other health care providers who functioned in their facility
than would Plaintiff.
11. Pennsylvania Rule of civil Procedure 4019(a) (1) provides
that upon Motion of a party, the Court can make an appropriate
Order if a party fails to respond to discovery.
