5, Further, the Plaintifl's Amended Complaint, as received by the Defendants from the
Plaintifi: has no Exhibits whatsoever attaehed to it, although the Complaint all~ges an Exhibit
"A" as being attachcd; in addition, the Exhibit attached to the initial Complaint, allegedly copies
of the Plaintiffs labor and mutcrials reeords showing the dates and types of services allegcdly
pcrformed, fails to spccify the dates whcn and the U11111unts paid by the Defendants on these
alleged "invoices" regarding the serviccs rcndered thc Defendants by the Plaintill
6, Finally, Paragraph 7 allegcs that "Plaintiff provided the services required by
Defendants, as evidcnced by the attached work ordcrs, for a period of time up through June 26,
1997;" again, in this regard, there arc I1Q attachments whatsoever to the Amended Complaint and,

Defendants to prepare an Answt'r to the Amcnded Complaint as they cannot determine what
work they paid for. when they paid lor it, how work was billed or crcdit given thcm by the
Plaintiff, and, finally, what credits they are entitled to relative to the alleged invoices, none of
whieh are attached to eithcr the initial Complaint nor the Amended Complaint.

8. The services rcndered by Plaintifi' for Defendants wcre at all time proper, satisfactory
and consistent with and in performance of the agreement betwcen the parties.
9. Pursuant to the terms of the agreement entered into bctween Plaintiff a!1d Defendants,
Plaintiff forwarded monthly invoices to Defendants requesting payment for the serviccs rendcred,
copies of said invoices being attached hereto and incorporated herein by reference as Exhibit "A."
10. During the late summer and fall of 1996, Plaintiff provided services to Defendants
and, although payments were not always timely, Defendants compensated Plaintiff for all services
rendered in 1996.
II. Plaintiff began services for Defendants in 1997 on or about April 14, 1997.
12. Plaintiff rendered services for Defendants in April, May and June 1997, as evidenced
by the attached exhibits, for which Defendants have failed to make payment despite requested
demands.
13. Despite repeated demands by Plaintiff for payment, Defendants have failed and
requested to pay PlaintitTthe sum of TWO mOUSAND FOUR HUNDRf,"J) Jo:fGHIY-/\/G!/T and
88//00 ($2,488.88) DOUARS due for the services rendered by Plaintifi'to Defendants.
14. Defendants' failure to remit to Plaintifi' the amount owed is a material breach of the
agrcement between the PlaintitT and Defendants.
15. Defendants have been unjustly enriched due to Plaintifi' pl'Oviding services to
Dcfendants as requested by Defcndants, but for which Dcfendants failed to pay.
16, Defendants' breach and failure to pay Plaintiff for services rendered has caused

5. Plaintiff did in tact provide the agreed-upon landscaping services to Defendants
for a period of time up to and including June 26, 1997, Copies of the invoices evidencing
the services rendered are attached as Exhibit "B".
6, The services rendered by Plaintiff to Defendants were at all time proper,
satisfactory and consistent with and in performance of the agreement between the parties.
7. Pursuant to the terms of the agreement entered into between Plaintiff and
Defendants, Plaintiff forwarded monthly invoices to Defendants requesting paytllent for
the services rendered. Cople~ of the invoices are attached as Exhibit "B",
8. For a period of time, Defendants made periodic payments to Plaintiff of the
invoices but failed to pay each invoice in full as required by the agreement and has since
April I, 1997, stopped making any payments to the Plaintiff.
9. Presently, Defendants are TWO THOUSAND FOUR HUNDRED EIGHTY-
EIGHT and 88/100 ($2,488.88) DOLLARS in arrears on its payments to Plaintiff for the
services rendered by Plaintiff to Defendants. Despite repeated demands by Plaintill' for
payment, Defendants have failed and refused to pay this amount.
10. Defendants' failure to remit to Plaintiff the amount owed is a material breach
of the agreement between the Plaintiff and Defendant.
II. The Defendants' breach as aforesaid has caused Plaintiff injury in the amount
of TWO THOUSAND FIVE HUNDRED FIFTY-SEVEN and 38/100 ($2,557.38)
DOLLARS.
