LOCHMAN, JR. and LORETTA LOCHMAN, Defendants JURY TRIAL DEMANDED DEFENDANTS' ANSWER TO PLAINTIFFS' COMPLAINT WITH NEW MATTER AND NOW, corne the Defendants, William H. I,ochman, Jr. and Loretta Lochman by their attorneys, Snelbaker, Brenneman & Spare, P. C. and respond as follows to Plaintiffs' Complaint: 1. Admitted. 2. Admitted. 3. Admitted. 4. Admitted in part and denied in part. It is admitted that on or about December 15, 1996, the Plaintiffs gave possession of the pony to Defendant Loretta Lochman as "tempor~ry guardian" at no charge to be used as a hunter/jumper for her daughter as set fOl-th in the written agreement attached to LAW ''''PICKS SNIEI..BAKER. BAIENNItMMI 8t SF'ARI!: Plaintiffs' Complaint as Exhibit "An. It is denied that Defendant William H. Lochman, Jr. was a party to the written agreement attached to Plaintiffs' Complaint as Exhibit "A". It is denied that the written agreement attached to Plaintiffs' Complaint as Exhibit "A" provides that Defendant Loretta Lochmall had an option to purchase the pony for an unspecified sum. On the contrary, it is averred the writing speaks for itself and that Defendant Loretta Lachman had a right of first refusal as set forth in the written agreement attached to Plaintiffs' Complaint as Exhibit "A". By way of further answer, the written agreement attached to Plaintiffs' Complaint as Exhibit "A" is incorporated herein by reference. 5. Denied. It is denied that in May, 1997 the Plaintiffs agreed to sell and the Defendants agreed to buy the pony for $3,500, and paid $50 down. On the contrary, it is averred that Defendants never agreed to purchase the pony and never paid $50 as a down payment. 6. Admitted in part and denied in part. It is admitted that Defendant Loretta Lachman made payments to Plaintiffs of $50 in June, July and August and $200 in September, 1997. It is denied that said payments were "additional". By way of further answer, it is averred that Defendant Loretta Lochman sent Plaintiffs' the aforesaid payments for use of the pony. 7. Admitted in part and denied in part. It is admitted that on or about September 22, 1997 the pony died. It is denied L.AW <Jf'I'n.:L'1 that after the death of the pony Defendants refused to make any further payments.
