pans, since he had no rea~on or duty tll retum liying pans or make restitution, since he did
not take the items and hud no responsiblity therefor.

17, Admitted Defendant was aware of the collection of flying pans; denied that he gave
penuission. Admitted that, assuming no responsibility, he acquiesced in the deposit of the
frying pans in the common area of the rooming house proper, to which all tenants had
access; of which Plaintiff had knowledge. Plaintiff was aware that there wus access to the
commonly used areas of the house by other tenants and by repair persons, including a
plumber.

19. Denied as set forth in Paragraph 7 above. On the contrary, Defendant made no
representation. Plaintiff assumed Ihe risk of potential theft by depositing the pans in the
common area of the rooming house and had no ba.sis for understanding or assuming that
Defendant would be responsible for the items. Other persons, roomers and other friell(ls of
roomers had access thereto, of which Plaintiff wa.s aware.
20. Denied that Defendant had any duty. With respect to value, Defendant is without
