"I LEY KonON TU AKEND COKPLA [NT IN AJjNULnENT TO THE HONORABLE, THE JUDGES OF THE SAID COURTI Plaintiff, her attorney Joseph A. Kslasnik, Esquire, respectfully represents and moves this court as follows: 1, The Plaintiff is KABEL T. LOGO who currently resides at 1417 Beer Avenue, Hanover, Pennsylvania 17331. 2, The Defendant is SAnUEL R. WILEY who currently resides at 339 Lambeth Walk, York, Pennsylvania 17403. 3. A Complaint under Divorce Code was filed to the above term and number on D..c:ember 15, 19'37. 4. The Complaint, as filed, contalned only a counl for Annulment, and not divorce. 5. Pursuant to Pa. R.C,P. 1920.13, Plaintiff wishes to amend the Complaint to include a count for divorce under 23 Pa. C.S,A. ~3301{c). in that the marriage is irretrievably broken, which count could have been joined with the sction ln Annulment. COUNT 1 - IHHIiTIHt:YAllLY 1II!!!!<t:N 8. Paragraph 1 through 7 hereoi ure incorporated h~rein by relerence a~ though set 10rth in whole. 9. The marriage la irretrievably broken. WHEREFORE, Plaintiff requests requests the Honorable Court to enter a Decree ot Divorce on behal1 of the Plainlill and againat the Delendant, COUNT 11 - AIIIIULKENT 10. Paragrapha 1 through 9 are incorporated by reference as though set forth in whole. 11. The said marriage between Plainli!1 and Delendant was procured by the Defendant by fraud and aaid marriage has not been aubsequently confirmed by the acts of the Plalntitt, 12. Defendant's acts 01 fraud by which the marriage was procured involved his insiatence and representation lo the Plainti!! thal he had no other paramoure and/or aexual partnere at the time 01 the marriage. After the date of marriage the Delendant admitted to Plalnli!I, and/or Defendant independently discovered that Defendant had maintained a paramour and/or sexual partner before and contemporaneous with the date of the marriage. and that such relationship continues presently. 13. There has been no confirmation by cohabitalion or other acts by the Plaintiff after the removal ot the Impediment to the marriage.
