TO THE HONORABLE JUDGES OF SAID COURT: petitioner, Ms. Shirley Barrick (hereinafter !Iother), on behalf of her minor children, Barbara Thompson and Douglas Francis Allen, through her attorney, the Family Law Clinic, hereby petitions this Honorable Court to enter a decree changing the names of her minor children from Barbara Thompson and Douglas Francis Allen to B~rbal'a Barrick and Michael Joseph Barrick. represents the following information: Mother NAME CHAHGI OF BARBARA THOMPSON 1. Barbara Thompson was born on April 12, 1981 in carlisle, Cumberland County, pennsylvania. A copy of her original birth certificate is attached as exhibit "A" and incorporated herein by reference. 2. Barbara Thompson 1i ves with Mother at 55 East Pomfret street, carlisle, PA 17013. 3. Barbara Thompson received the following social security number under the name Barbara Thompson: 161-62-7860. 4. Barbara uses the last name Barrick, although she is required to use her legal last name of Thompson for medic:al ~ insurance purposes and other official purposes requiring her to use her legal surname. 5. Mother seeks to chanqe Barbara Thompson's name to Barbara Barrick for the following reasons: a. At birth, Barbara was given the last name of Mother's then husband, Thomas Thompson. b. At the time cf ~arbara's birth, Mother was married to, but seeking a divorce from, Thomas Thompson. Mother's divorce decree from Thoma9 Thompson was granted on March 25, 1982. (See docket num~er 837-Civil 1981). c. Mother lived separate and apart from Thomas Thompson since 1979. Mother and Thomas Thompson had no contact since 1979 and lived in separate residences. Mother had rio sexual relations with Thomas Thompson after their separation in 1979, inCluding the nine months prior to Barbara's birth. d. Barbara Thompson has lived with Mother since birth. e. Thomas Thompson has had no contact with Barbara since her birth. f. Thomas Thompson has never acknowledged paternity of Barbara. g. Thomas Thompson has provided Barbara with no financial support. There have never been any child support actions against Thomas Thompson. h. Thomas Thompson currently resides at 3629 40th Street North, st. Petersburg, FL 33713. i. The only person Mother had sexual relations with nine months prior to Barbara Thompson's birth was I,eslie Davis. j. Barbara Thompson has had no contaQt w~th Leslie Davis since her birth. k. Leslie Davis roo ides at 474 South McArthur Way, Greenfield, OH 45123. l. There is currently a child support action against Leslie Davis in the Domestic Relations Section of Cumberland County, which was filed on May 21, 1997. See DR 26,438. m. Leslie Davis haD denied paternity in the above- mentioned child support action. n. It is in the best interests of Barbara Thompson to have her name changed to Barbara Darrick for the following reasons: 1) Barbara con>1iders nej.ther Thoman Thompson nor Leslie Davis to be her father. 2) Barbara's ties to her family would be strengthened if she would share the same last name as her mother and brother, Douglas. 3) Barbara desires to have her last name changed to Barrick and understands the consequences of that change. 6. Barbara Thompson has resided at the following addresses over the past five years: a. Safe Harbour, 102 West High Street, Carlisle, PA 17013 b. 562 North Bedford Street, CarliSle, PA 17013 c. 55 East Pomfret Street, Carlisle, PA 17013 7. There are no jUdgments, liens, or decrees of the like character against Barbara Thompson. (See attached Certificate of No JUdgment Liens). NAMR CHANOR or DOUGLAS fRANCIS ALLEN 8. Douglas Francis Allen was born on October 23, 1983 in Carlisle, Cumberland County, Pennsylvania. A copy of his original birth certificate is attached as Exhibit "B" and incorporated herein by reference. 9. Douglas Allen lives with Mother at 55 East Pomfret street, Carlisle, PA 17013. 10. Douglas Allen received the following social security number und~r the name Douglas Francis Allen: 167-64-7660. 11. Douglas uses the last name Barrick, although he is required to use his legal last name of Allen for medical insurance purposes and other official purposes requiring him to use his legal surname. 12. Mother seeks to have Douglas Francis Allen's name changed to Michael Joseph Barrick for the following reasons: a. Douglas' father is Charles Allen. At birth, Douglas was given the name Douglas Francis Allen. Douglas' name was cllosen from paternal family names. Douglas' first name is his father's middle name. Douglas' middle name is his paternal grandfather. b. Charles Allen resides at 1701 Ashland Road, Columbia, MO 65201. c. Pursuant to a Court Order Mother has full custody of Douglas. (Docketed as: Court of Common Pleas of York County, Shirley Thom~son v. Charles Allen, No. 92-SU-05243-03/custody). d. Charles Allen has been ordered to pay child support through a support action listed as state of Missouri, ex. reI. Shirley M. Thompson v. Charles D. Allen. (Court Ordar No. A09569). e. Charles Allen has lDade no attempts. to contaot Douglas since Mother obtained full custody of Douglas. f. It is in the best interests of Douglas Francis Allen to have his name changed to t1ichael Joseph Barrick for the following reasons: 1) Douglas' ties to his family would be strengthened if he would share the same last name as his mother and sister, Barbara. 2) Douglas strongly desires to change his first and middle name because of exper\~nces he had while living with his father in 1993. Those experiences include a number of activities engaged in by his father which he now negative~y associates with his name, including the use of illegal substances, alcohol, and theft. 3) Douglas has carefully chosen the name Michael Joseph Barrick. Michael is the name of a cousin to whom Douglas is close, Joseph comes from the Bible, and Barrick is his mother's surname. 4) Douglas dl!lsires to have his full name changed to Michael Joseph Barrick and understands the consequences of that action. 13. Mother served the petition for change of Name and Notice of Hearing on Thomas Thompson, and filed Proof of service on March 5, 1998. /:2QlIQJ.aS Francis Allen In her Petition, Mother alleged that Douglas's father is Charles D. Allen, Mother attempted to serve Charles 0, Allen with the Name Change petition and Notice of Hearing on January 7, 1998, by certified mail, That mail was returned to counsel on January 15, 1998, marked "MLNA" (moved left no forwarding address) . Mother subsequently learned of a new address for Charles D. Allen and on February 20, 1998, mailed a true copy of the petition for Name Change to him at P,O. Box 15272, Jefferson City, MO 65102, by certifi.ed mail, restricted delivery, return receipt requested, That mail was returned on March 16,1998, marked "addre s s unknown," Mother mailed a form to the above-mentioned post office requesting change of address or boxho1der information. If investigations fail to uncover an address for Charles Allen, Mother is prepared petition the court for a special order permitting service of the Petition by publication, ARGUMENT Mother should be permitted to proceed with the name chanGe petition for Barbara Thompson i.i notice is provided to her pusband at the time of conce~tion and birth of Barbara, As noted above, Mother alleged in her Pet i t ion that Lesl ie Davis is the natural father of Barbara Thompson, After filing the petition, this Court by Order dated December 12, 1997, excluded Les1 ie Davis as the biological father of Barbara Thompson, Although Mother was married to Thomas Thompson during the time of conception and birth of Barbara, Mother had separated from Thomas Thompson two years before the child was born and had commenced a divorce action against Thomas Thompson in 1981, Mother's divorce decree from Thomas Thompson was granted on March 25, 1982 (No, 81- 837), In addition, Mother alleged in her petition that she had no sexual relations with Thomas Thompson after their separation in 1979, including the nine months prior to Barbara's birth, Thomas Thompson has never supported Barbara, had contact with Barbara, or acknowledged paternity of Barbara. These facts strongly suggest that the presumption of paternity has been rebutted, Brinklev v, K.:i..ng, 701 A,2d 176 (1997), Because the presumption of paternity appears to have been rebutted and because Leslie Davis has been excluded as the natural father, the father of Barbara is presently unknown, Mother submits that she should be permitted to go forward with the name change petition on Barbara's behalf with service on Thomas Thompson even though Thomas Thompson is not the biological father of Barbara or the presumed father of the child. The Petition was sent certified, restricted, return receipt requested and was returned to the Family Law Clinic marked "MLNA" (moved left no forwarding address), b, On February 02, 1998, Petitioner's counsel contacted the Missouri Division of Motor Vehicles and was provided with the abov\: 1701 Ashland Road address for Charles D, Allen, c, On February 02, 1998, Petitioner's counsel contacted the Carlisle Domestic Relations Office and was n:ferred to the Missouri Division of Child Support Enforcement and the case of Shirley M, Thompson v, Charles D, Allen, Court Order No, A09569, Case No: XO. 32813041-A, d, On February 02, 1998, Petitioner's counsel contacted the Missouri Division of Child Support Enforcement and spoke with the Investigator who was assigned to the above- mentioned case number, The Investigator told Petitioner's counsel that Charles D, Allen's address was 170 I Ashland Road, as of March 03, 1997, e, On February 02, 1998, Petitioner's counsel conducted an Internet search of the Respondent's name "Charles D, Allen," The search produced two (2) "Charles Aliens" and provided accompanying phone numbers and addresses, Phone inquiries madc by Pctitioner's counsel revealed that neither of these individuals were the Respondent. f, On March 13, 1998, Petitioner's counsel mailed a Request for Boxho1der Information to Jefferson City, Missouri Post Office, That form was returned marked "no such address in Jefferson City, " g, On March 30, 1998, Petitioner's counsel faxed a Request for Boxholder Information to the Columbia, Missouri Post OITk~c, This inquiry revealed that Charles 0, Allen had moved and Icft no forwarding address, as of August 08, 1997, ..... 1."1 '" i f.
