In the meantime, to require anything more in Hempt's complaint would be unduly burdensome and would elevate the invoices li'llm their proper place as mere evidence. After reasonable investigation, Defondant Robert G. Larkin is without knowledgo or information sufficient to form a belief as to the truth of these averments as the specific materials and prices have not been identified in the Complaint. Defendant Nancy Y. Larkin cannot respond to this paragraph other than to reiterate her denial that she contracted with the Plaintiff in any capacity. 16. It is admitted that Defendant Robert G. Larkin has failed to make some required payments to the Plaintiff. Defandant Nancy Y. Larkin is not required to make any payments to the Plaintiff as she has not contracted to do so. 17. Defendant Robert G. Larkin acknowledges receiving some goods and materials for which he haa been unable to pay, but is unable to admit or deny the precise amount tor additional damages for the reasons stated elsawhere in this Answer. Defendant Nancy Y. Larkin denies indebtedness to the Plaintiff for any reason as she did not contract for or receive in any way any materials delivered by the Plaintiff. WHEREFORE, Defendant requests your Honorable Court to enter judgment in a just amount against Robert G. Larkin based upon the proof offered by the Plaintiff at the time of trial, and further requests that this matter be dismissed as to Nancy Y. Larkin. Plaintiff agreed to set up a credit account with Defendants provided that all invoices evidencing materials supplied to Defendants were paid within thirty (30) days of receipt. 6. Defendants agreed to pay Plaintiff for the materials provided to Defendants in accordance with its normal credit account, that being payment of tho outstanding invoices within thirty (30) days of receipt. Defendants also agreed to pay the sum of one and one-quarter (1 1/4%) percent interest per month for any outstanding invoices due over thirty days. COUNU 7. The averments of Paragraphs 1 through 6 are incorporated herein by reference as though more fully set forth herein. e. Plaintitf, at the insistence and request of the agents, servants, or employees of Defendants, acting within the scope of their employment, sold and delivered to Defendants certain goods and materials at the times, in the amounts, and for the prices set forth in Plaintiff's Accounts Receivable Detail Listing Report which is attached hereto and marked as Exhibit A. 9. Defendants accepted and received all material ordered from Plaintiff and referenced on Exhibit A. 2 10. Defendants have failed or refused to pay Plaintiff for the material received by Defendants and Identified by the Invoices which are identified on Exhibit A. 11. Defendants have breached the agreement with Plaintiff by their failure to pay for the materials received pursuant to the terms and conditions of the credit account. 12. Plaintiff has been damaged in the amount of $5,974.93 as a result of Defendants' failure to pay for all outstanding Invoices In accordance with the agreement between Plaintiff and Dafendants. 1 3. Plaintiff is entitled to receive interest at the rate of one and one-quarter 11 1/4%) percent per month for all invoices due over thirty days as a result of Defendants' failure to pay for the materials received in accordance with the credit account established with Plaintiff. WHEREFORE, Plaintiff demands judgment against Defendants in the amount of $5,974.93, plus interest at the rate of one and one-quarter percent per month for all outstanding invoices due over thirty days, until the time of judgment in this case, plus costs of suit.
