agreed to pay plaintiff $25.00 per hour per man on the job plus the
cost of materials.
5. On or about July 25, 1997, at 7:30 a.m., Plaintiff drove
to "Home Depot" to purchase the required material to complete the
agreed upon work to Defendant's deck. At or about the same time,
Plaintiff's assistant gathered the necessary tools to complete work
on Defendant's deck. Upon picking up said materials, plaintiff
proceeded to Defendant's residence where he met his assistant and
commenced work upon Defendant's deck.
6. Plaintiff and his assistant performed the necessary
repairs and reconstruction of Defendant's deck. Said work was
completed at 11:45 a.m. on the morning of July 25, 1997.
7. Pursuant to the Agreement of the parties, Plaintiff
issued to Defendant a bill for services which was left at
Defendant's residence. Said bill was for four hours of labor
priced at $25.00 per hour per man plus Thirty Four Dollars and
25/100 ($34.25) for cost of materials.
8. The terms of the bill provided for the payment by
Defendant at the completion of the job and a 10% penalty for any
amount received after 30 days.
9. Defendant has failed to comply with the paym~nt terms of
the bi.ll in that, to date, Defendant has made only one payment to
Plaintiff. Said payment, which was made on August 25, 1997, was a
payment for the sum of One Hupdred Dollars and 00/100 ($100.00).
