Smith and Wendy J, Smith, of Cumberland County, Pennsylvania is about to execute contemporaneously herewith, a contract, with Haubert Homes Ine" of 2151 Linglestown Road, Suite 200, Harrisburg, Pennsylvania for the erection of a two story, frame dwelling upon a lot of land situate on Lot Number 5, Signal Hill Drive, Mechanicsburg, Pennsylvania bounded and desqribed as follows, to wit: ALL THAT CERTAIN tract or parcel of land being situate in the Township of Hampden, County of Cumberland, and Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wi t : BEGINNING at a point on the eastern right-of-way of Signal Hill Drive, said point being the southwest corner of Lot No.6; thence along the southern line of Lot No.6, North 51 degrees 57 minutes 08 seconds East a distance of 277.98 feet to a point, said point being the southeast corner of Lot No.6; thence along a line South 49 degrees 07 minutes 03 seconds East a distance of 47.50 feet to a point; thence along Phase II South 27 degrees 18 minutes 26 seconds West a distance of 283,78 feet to a point at the northern right -of -way of Signal Hill Drive; thence along said right-of-way South 86 degrees 57 minutes 37 seconds West a distance of 70.39 feet to a point on the northern right-of-way of Signal Hill Drive; thence along a curve to the right having a radius of 10.00 feet and an arc length of 14,36 feet, said are being subtended by a chord of North 51 degrees 54 minutes 28 seconds west 13.16 feet to a point on the eastern right-of-way of Signal Hill Drive; thence along said right-of-way along a curve to the left having a radius of 250.00 feet and an arc length of 72.64 feet, said are being subtended by a chord of North 19 degrees 06 minutes 01 second West 72.39 feet to a point on the eastern right-of-way of Signal Hill Drive; thence along said right-of-way North 27 degrees 25 minutes 27 seconds West a distance of 44.09 feet to a point on the eastern right-of-way of Signal Hill Drive, the place of BEGINNING. CONTAINING 33,537.31 square feet of land. BEING Lot 5 on the plan of Signal Hill Residential Development, Final Subdivision Plan for Ph~se 1, prepared by Melham , " . Associates, PC and recorded in plan Book 69, Page 77. NOW, December 15, 1997, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with OWNER and the further consideration of One Dollar, to CONTRACTOR paid by OWNER it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
