Dear Mr. Marritz, Ms. Ziegler and Mr. McConnell:
By order of Court of President Judge George E. Hoffer
dated September 16, 1998, the full-time Master has been
appointed in the above referenced divorce proceedings.
A divorce complaint was filed on October 18, 1997,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. The complaint also avers that the
parties separated August 9, 1997.
No economic claims have been raised in the complaint;
therefore, grounds for divorce appear to be the issue that we
need to resolve. I am writing to inquire of Mr. Mcconnell,
before SCheduling a hearing on the indignities grounds, as to
whether or not he would be willing to sign an affidavit of
consent so that the divorce can proceed to conclusion without
the necessity of having a hearing on fault grounds. If Mr.
McConnell does not agree to signing an affidavit of consent, I
request that he advise my office immediately of his refusal to
sign such an affidavit and we will immediately schedule a
hearing on the alternative grounds of indignities raised in the
complaint.
I ask that Mr. McConnell respond to my letter within the

next two (2) weeks so we know how we should proceed with this
case. If Mr. McConnell is willing to sign an affidavit of
oonsent, and he so advises, I will direct counsel for Linda
McConnell to provide Mr. McConnell with the appropriate
documents to conclude the divorce under the no-fault provisions
of the divorce code.

The plaintiff, Linda Kay Mcconnell, by her attorneys, the
Family Law Clinic, sets forth the fOllowing cause of action:
1. plaintiff is Linda Kay McConnell, who currently resides
at 214 South Enola Drive, Enola, Cumberland county, Pennsylvania.
2. Defendant is Jay Max McConnell, III, who resides at 405
Front street, West Fairview, Cumberland county, pennsylvania, and
is currently incarcerated at Cumberland County Prison, Unit E,
Cell 2, 1101 Claremont Road, Carlisle, Cumberl.and County,
Pennsylvania.
3. Plaintiff has been a bona fide resident of Cumberland
county and the Commonwealth for at least six months immediately
previous to the filing of this Complaint.
4. The plaintiff and defendant were married on April 1.3,
1996 at West Fairview, Cumberland County, Pennsylvania.
5. Plaintiff and defendant have lived separate and apart
since August 9, 1997.
6. There have been no prior actions of divorce or for
annulment between the parties.

1. I am the plaintiff in the above matter and because of my
financial condition am unable to pay the fees and costs of
prosecuting or defending the action or proceeding.
2. I am unable to obtain funds from anyone, including my
family and associates, to pay the costs of litigation.
3. I represent that the information below relating to my
ability to pay the fees and costs is true and correct.
(a) My name is Linda Kay McConnell. I reside at 214 South
Enola Drive, Enola, PA. My social security number is 183-50-9007.
(b) Employment: I am presently employed as a baker at weis
Market, 21st Street, Camp Hill, PA. I earn $1083 net wages per
month.
(c) Other income: I receive $650 child support per month.
I have no other sources of income.
(d) Total income: I have $1733 income per month.
(e) Property owned: I have a savings account with a $25
balance, and a checking account with a $10 balance. I have a 1994
Ford Escort which cost $15,000, and I still owe $10,900 in
payments.
(f) Debts and obligations: I have regular monthly expenses
of $1738, as follows: rent- $200jmonth, personal loan- $52jmonth,
car loan- $382/month, gas- $65/month, electric- $47/month, food-
$155/month, transportation expenses- $4 5/month, oar insurance-
$43/month,
trash/sewage-$30/month,
water-
$25/month, phone-
$40/month, clothes- $50/month, child care- $304/month, diapers-
$5/month, child's dance class $20/month, entertainment- $30/month,
medical expenses including:
counseling-$150/month, breathing
treatments- $30/month, doctor bills-$35/month, and medicine-
$30/month.
(g) I have 4 children who depend on me for support, Samantha
Lynn MCConnell, 23 months, Jessica Marie Pugh, 7 years, Justin
Pugh, 9 years, and Robert Pugh, Jr., 12 years.
4. I understand that I have a continuing obligation to
inform the court of improvement in my financial circumstances which
would permit me to pay the costs incurred herein.
5. I verify that the statements made in this affidavit are
true and correct. I understand that false statements herein are
made subject to the penalties Qf 18 Pa.c.S. 54904, relating to
unsworn falsification to authorities.
