SHOLLENBERGER, and does respectfully represent the fOllowing: 1. The Plaintiff, K:MBERLEE RilllKLE, is an adult individual who currently resides at 47 South 35th Street, Camp Hill, Cumberland County, Pennsylvania 17011. 2. 'rhe Defendant, WANDA D. JOHNSON, is an adult individual whose last known address is 6695 Blue Ridge Avenue, Harrisburg, Dauphin County, Pennsylvania 17112. 3. The Defendant, NIKOLE D. BUCHANAN, is an adult individual whose last known address is 6695 Blue Ridge Avenue, HarriSburg, Dauphin County, Pennsylvania 17112. 4. The facts and circumstances hereinafter set forth took place on Trindle Road, Hampden TownShip, Cumberland County, Pennsylvania, at or about 9:53 p.m. on March 1, 1996 . 5. At the aforesaid tim~ and place, the Plaintiff, KIMBERLEE RUNKLE, was a passenger in a 1992 Ford Crown Victoria operated by Loralee Sue O'Brien, bearing registration plate DNW735. 6. At the aforesaid time and place, the Defendant, NIKOLE D. BUCHANAN, was the operator of a 1988 V.W.Fox owned by Defendant, WANDA D. JOHNSON, bearing registration plate BBH4394. At the aforesaid time and place, the 0' arien vehicle was westbound on 'l'rindle Road and was stopped with its turn signal on attempting to make a left turn on to Railroad Avenue, cumberland County, pennsyl v."inia. B. At the aforesaid time and place, Defendant, NIKOLB D. BUCHANAN, was travelling westbound directly behind the O'Brien vehicle when she failed to stop and collided with the rear of the O'Brien vehicle. 9. AS a result of the aforesaid collision, Plaintiff, KIMBERLEE RUNKLE, has suffered seriouS and permanent injuries, including but not limited to the following: (a) Post traumatic left shoulder girdle bursitis, (b) Tendinitis/bursitis with left. rotator cuff impingement, (c) Bilateral sacroiliac syndrome, (d) Muscle tension headaches; (e) Fibromyalgia, (f) post-traumatic Horner's syndrome with right upper lid ptosis and defects in her visual fields; (g) Chronic abdominal/pelvic pain aggravated by the motor vehicle collision, (h) Contusion and strain of the right elbow; (i) Right lumbar radiculopathYi (j) Severe strain and sprain of the muscles, tendon, ligaments and other soft tissues at or about the cervical spine, (k) Seve:-e strain and sprain of the muscles, tendon, ligaments and other soft tissues at or about th~ lumbar spine, (1) Severe strain and sprain of the muscles, tendon, ligaments and other soft tissues at or about the thoracic spine, (m) Multiple areas of significant muscle strain, lAW O~FICES Of 'f1MlYTHY II. Paragraphs 1 through 9 of plaintiff's complaint are incorporated herein by reference and made a part hereof as if set forth in full. 11. The aforesaid collision was a direct and proximate result of the n~gligence of Defendant, NIKOLE D. BUCHANAN, in operating her vehicle in a careless, reckless a~d negligent.manner as follows: (a) In operating her vehicle at an excessive rate of speed under the circumstances, (b) In failing to have her vehicle under proper and adequate control; (c) In failing to apply her brakes in time to avoid a collision, (d) In failing to observe the vehicle plaintiff was travelling in stopped on Trindle Road with its left turn signal 'on, (e) In permitting or C\llowing the vehicle to strike and collide with the reClX of the vehicle that plaintiff occupied as a passenger; (f) In failing to drive at a speed and in the manner that. would allow defendant to stop within the assured clear distance ahead, in violation of 75 Pa.C.S.A. ~3361, (g) In failing to keep a reasonable lookout for other vehicles lawfully on the road, (h) In operating her vehicle in a careless manner, in violation of 75 Pa.C.S.A. ~3714, and, (i) In otherwise operating said vehicle in a careless, reckless, and negligent manner and in a manner violating the Motor Vehicle Code of the Commonwealth of pennsylvania. As a direct and proximate result of the aforesaid inj uries, plaintiE f, l<IMBERLEE RUNI<I_E, has undergone and in the future will undergo great pain and suffering for which damages are claimed. 13. As a further result of the aforesaid injuries, Plaintiff, KIMBERLEE RUNKLE, has suffered and may continue to suffe. a loss of earnings for which damages are claimed. 14. As a further result of the aforesaid injuries, Plaintiff, KIMBERLEE RUNKLE, had and/or may in the future incur expenses for medical treatment and rehabilitation for which damages are claimed. 15. As a further result of the aforesaid injuries, Plaintiff, KIMBERLEE RUNKLE, has and/or may in the future incur a loss of earning capacity for which damages are claimed. 16. As a further result of the aforesaid injuries, Plaintiff, l<IMBERLEE RUNKLE, has sustained scarring and disfigurement for which damages are claimed. 17. As a further result of the aforesaid injuries, Plaintiff, KIMBERLEE RUNKLE, has sustained a permanent diminution in her ability to enjoy life and life's pleasures for which damages are claimed. 18. As a further result of the aforesaid injuries, Plaintiff, KIMBERLEE RUNKLE, has incurred or may hereinafter incur financial expenses and loss which exceed sums recoverable under the limitations and exclusions of the Pennsylvania Motor Vehicle Financial Responsibility Law for which damages are claimed. 19. As a further result of this collision, Plaintiff, KIMBERLEE RUNKLE, has and may in the future incur reasonable and necessary medical and rehabilitative costs and expenses in excess in the amounts paid or payable pursuant to Subchapter B of the Pennsylvania Motor Vehicle Financial Responsibility Law, Workers' compensation or any program, group contract, or other arrangement for payment of benefits as defined in 75 Pa.C.S.A. ~1719. PlaintHf is covered by the full tort option under her motor vehicle insurance policy with prudential Insurance Company. A copy of a letter dated February 10, 1995 wherein Plaintiff requested the full tort option is attached hereto as Exhibit "A." A copy of a letter from Prudential indicating that Plaintiff had been granted full tort status effective February 10, 1995 is attached hereto as Exhibit 118. It WHEREFORE, Plaintiff, KIMBERLEE RUNKLE, demands judgment against the Defendant, NIKOLE D. BUCHANAN, for compensatory damages in an amount in excess of the amount requiring compulsory arbitration. COUNT II KIMBERLEE RUNKLE v. WANDA D. JOHNSON 21. Paragraphs 1 through 20 of are incorporated herein by reference as if set forth in full. 22. At the aforesaid time and place, Defendant, NIKOLE D. BUCHANAN, was operating the 1988 V.W. Fox with the express and/or. implied permission of the Defendant, WANDA D. JOHNSON. 23. Plaintiff's Complaint and made a part hereof Defendant, WANDA D. JOHNSON, was negligent in that: a. She entrusted the use of the 1988 V.W. Fox to Defendant, NIKOLE D. BUCHANJ\N, who she knew, or should have known, had a reputation for reckless and/or negligent driving, and, b. She entrusted said vehicle to Defendant NIKOLE D. BUCHANAN, when it was likely that she would operate Defendant's vehicle in such a manner as to create an unreasonable risk of harm to others.
