PBTITION FOR APPBAL
AND NOW, CQmes the petitioner., JOSEPH D. BEIGH, by and
through his attorneys, MANCKE, WAGNER, HERSHEY & TULLY, and files
the following Petition:
1. Your Petitioner, JOSEPH D. BEIGH, is an adult
indivdual currently residing at 3400 Foxfire Circle,
Mechanicsburg, Cumberland County, Pennsylvania.
2. The Respondent, The Department of Transporation,
has an address of Office of Chief counsel, Third Floor,
Riverfront Office Center, Harrisburg, Dauphin county,
Pennsylvania.
3. On or about November 26, 1997, the Petitioner
herein received notification of license suspension effective
December 31, 1997, as a result of an alleged violation of section
3362(a)(3) of the Motor Vehicle Code.
4. The imposition of the sanction of suspension is
improp~r, invalid and illegal for the following reasons:
A. The underlying violation of the Motor Vehiole Code
3362(a) (3) is currently on appeal in the Court of
Common Pleas of Cumberland County as evidenoed by
the Notioe of Appeal from Summary criminal
conviotion, a oopy of whioh is attached hereto.
B. The imposition of suspension is in violation of
law.
C. The imposition of suspension constitutes an abuse
of discretion.
D. The imposition of suspension is not based upon a
oonviction as the matter is presently on appeal.
5. The appeal of the Petitioner from the underlying
summary citation was a timely appeal, and the Department of
Transportation was so notified, nevertheless, the Department
oonducted a Departmental Hearing and imposed the aforementioned
suspension despite express notice that the matter was on appeal.
6. Petitioner believes and therefore avers that he has
a valid defense to the underlying motor vehicle citation, and
therefore requests the Cour.t to grant his appeal and in the
meantime, grant a supersedeas to the suspension.
