Diveglia, sq Attorney for Plaintiff 119 Locust St. Harrisburg, PA 17101 (717) 236-5985 " ~Plaintiff complains of increasing severity of pain arid tenderness within the left breast along with a palpable lum~ which has been present for at least a week.~ 11. Defendant Jordan did not contact the Plaintiff regarding the report of May 9, 1996 he received from Smith Radiology, Inc. 12. Plaintiff became increasingly concerned about the lump in her left breast and scheduled an appointment with Defendant on September 18, 1996, at which time Plaintiff again told Defendant Jordan about the lump in her. left breast. 13. During the breast examination by Defendant Jordan on September 18, 1996, Defendant Jordan palpated the lump in Plaintiff's left breast and told Plaintiff that the lump was just her ~normal lumpy breast" and told the Plaintiff to schedule a mammogram next year when it was about a year from the last mammcgram. 14, Despite the fact that Defendant Jordan knew that Plaintiff was at high risk for breast cancer; and that she had increasing severity of pain and tenderness within the left breast; that she had a palpable lump, and despite that fact that the mammogram and sonogram correlated the mass the Plaintiff described to Defendant Jordan, Defendant Jordan did not indicate any description of the findings of the lump in his September 18, 1996 office notes, and no plan of action was indicated in the office notes. 15. Despite the findings and correlations of the left breast lump and complaints, Defendant Jordan recommended only yearly mammograms as follow-up care 16. On April B, 1997, Plaintiff again underwent a mammogram and ultrasound at smith Radiology, Inc. 17. On April B, 1997, smith Radiology. Inc. sent to Defendant Jordan a report on the mammogram and ultrasound performed on Plaintiff on that same day. lB. By April lB, 1997, Plaintiff had not heard from Defendant Jordan concerning the results of the April B, 1997 diagnostic testing at Smith Radiology, Inc. so she called Defendant Jor.dan's Office at Evelyn G, Frederick Health center, Millersburg, and requested a copy of the report of Smith Radiology, Inc. 19. Plaintiff was informed by the employees of Evelyn G. Fr~derick Health Center, that Defendant Jordan was in Florida, Plaintiff learned of the findings of the mammogram report only after insisting upon having copies of the report faxed to her. 20. The mammogram films of Plaintiff's left breast indicated a large spiculated mass in the mid to outer portion of the left breast nearly 5 by 3 centimeters in diameter, which was not present in the March 31, 1994 mammogram, 21. After receiving a copy of the mammogram report, Plaintiff met with Henry K. Smith, D.O. to review the mammogram findings and to compare them with the findings of the 1996 which, Henry K, Smith, D. O. indicated were nearly identical to the findings of 1997. 22. Upon receiving the faKed copy of the April 8, 1997 report from Smith Radiology, Inc., plaintiff began a diligent search for a competent surgeon and was seen at the Slone-Kettering Institute/Memorial Hospital. Shortly thereafter., on April 28, 1997. 23. The surgical procedure of April 28, 1997" was a modified radical mastectomy that was performed after surgical biopsy revealed Plaintiff had incurred invasive lobular carcinoma. 24. The pathology studies of the tumor and lymph nodes of the Plaintiff revealed that the carcinoma had spread into the lymph nodes of the Plaintiff. 25. As a result of the spread of the carcinoma into the lymph nodes of the plaintiff, and as a result of the fact that there was additional.ly vascular invasion as well as perineurial invasion, Plaintiff underwent an intensive course of high dose chemotherapy, which in and of itself posed health risk tc the plaintiff. 26. As a result of the operative procedure and the chemotherapy, plaintiff has been disabled from her employment as a trial attorney and plaintiff has and will continue to incur an eKtended period of disability into the foreseeable future as a trial attorney. 27. The surgical procedure of modifiod radical mastectomy and the chemotherapy procedures that are required as a result of the spreading of the cancer was oaused by the failuro of Defendant Jordan to diagnose and/or order appropriate follow-up based upon the report of May 8, 1996, from smith Radiology, Inc., the physical findings upon examination on September 18, 1996, along with prior complaints and history of the Plaintiff. 28. As a result of the failure to diagnose, which will be more fully set forth hereafter, the Plaintiff has incurred an increased risk of harm and loss of chance of cure. 29. Plaintiff has suffered extreme mental distress, emotional turmoil, fright, and anxiety as a result of the diagnosis and prescribed treatment. 30. Plaintiff has suffered great pain as a result of surgical procedures which she otherwise would not have incurred had the Defendant made a proper diagnosis and follow-up. 31. Plaintiff has and may continue to incur severe adverse symptoms as a result of undergoing chemotherapy that include, among other things, loss of hair, depletion of red and white blood cells, increased risk of infection, weakness, fatigue, nausea, and generalized malaise. 32. As a result of the surgical procedure, and the removal of plaintiff's lymph nodes, Plaintiff has and will continue to incur increase risk of infection, the risk VERI FICA'l'ION I i II This Complaint is based upon information whlch has been gathered by my counsel in the preparation of the lawsuit.
