4. On or about September 20, 1995, Defendants made, executed, and
delivered to Plaintiff a mortgage upon premises therein described, which Mortgage
contains a description of the premises subject to said Mortgage and was recorded on
September 26, 1995 In the Cumberland County, Pennsylvania, Recorder's Office In
Mortgage Book 1283, Page 727. A true and correct copy of said Mortgage Is attached
hereto, made a part hereof, Incorporated herein by reference, and marked "EXHIBIT A".

monthly payments of principal and Interest due and owing on their loan from February

the delinquency balance due and owing prior to February 1, 1997.
7. Plaintiff hereby exercises Its option to declare the entire amount owing

Emergency Assistance Act, Act of December 23, 1963, P.L. 385, No. 91 (35 P,S, !}
1680.401c m ~.), as amended, was sent to Defendant Alan p, Intrieri on April 4, 1997
and said Defendant failed to exercise his rights under said Act. A true and correct copy
of said Notice Is attached hereto, made a part hereof, Incorporated herein by reference,

Inapplicability of Loan Interest and Protection Law
1 O. This Action Is not subject to the provisions of Pennsylvania's Loan Interest
and Protection Law, Act of January 30, 1974, P,L. 13, No.6 (41 P.S. !} 101 m ~.), as
amended, nor are notices required to be sent to Defendants pursuant to said Act,
because said Mortgage Is not a "residential mortgage" within the meaning of said Act.
WHEREFORE, Plaintiff York Federal Savings and Loan Association prays for
judgment In Its favor and against Defendants Alan P. Intrieri and Michelle S. Intrieri In
the amount of One Hundred Twenty Four Thousand Six Hundred Forty Two and 74/100
Dollars ($124,642.74), with Interest thereon until paid at such rate or rates as
established by Plaintiff pursuant to the terms of the Adjustable Rate Note, currently
$21.6021 per diem, from 12/20/97, late charges at 5% of the monthly payment amount,
