On or aboul December 21, 1997, thc defendanl came 10 the plaintiff's home uninvited and refused 10 leave when sho lold him coming her 10 fear for her safely. The defendanl angrily grabbed their four year old daughlcr reckle8llly hitting her head on a porch pillar cauaing her 10 fear for their safety, When the defendant Ihen llIIgri/y grabbed the plaintiff's girlfriend and threw her oul the front door, the plaintiff look her daughter, ran oul the back door, and called 911 for help. When the police anivcd, they look the defendant to the station, charged him wilh harassment, and rcleased him warning him nollo go near the plaintiff. Thc dcfendanlleft the slation and inunediately retwned 10 the plaintiff's home, entered through the back door, and when the plaintiff's sisler called the police, he ran avoiding the police upon thcir arrival. Shortly thereafter, the defendanl repeatedly called the plaintiff's residence and threatened her saying, "You won'l make it 10 work Ionight. If you do, I'll kill you and the people you work with. I will blow your head off and make you a statistic." Shortly after the phone calls, Ihe police arrived to tpke the plaintiff and her children to another location becauae they had received a telephone call from the defendant's ex-wife stating that the defendanllold her he had a gWl in his car and was going 10 kill the plaintiff. The defendanl was picked up by the police who impounded his car to search for a gun and nm:sted the defendant placing him in Cumberland County Prison, b, In or about July 1997, the defendant grabbcd the plaintiff by her throat causing marks and shoved her against a refrigerator causing her pain. c. On several diffcrent occMions since approximately 1995, the defendant hM shoved thc plaintiff, choked her, slaPllCd her, and thrown and broken telephones causing her to fear. The defcndant hM threatened to kill the plaintiff and himself causing her to fear for her safety. 5. The plaintiffbelicves and therefore avel1l that she is in immediate and present danger of abuse from the defendant and that she is in need of protection from such abuse. 6. TIle plaintiff desires that the defendant be prohibited from ha~ng any direct or indirect contact with the plaintiff including, but not limited to, telephone and writtcn communications. 7. The plaintiff desires that the defendant be enjoined from harassing and sta1king the plaintiff, and from harassing the plaintifi's relatives, or her minor children. 8. The plaintiff desires that the defendant be restrained from entering her place of employment or the pre-school facility of her minor child. 9. .
