BRESCIII, ESQUIRE Defendant JURY TRIAL DEMANDED COMl'LAINl' I, Plaintiff, Chirotech, Jnc" t/d/b/a Boch Chiropractic Clinic, is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania. Chirotech's principal oflice is located at 323 York Road, Carlisle, Pennsylvania. 2. Defendant, David R, Breschi, whose current business address is c/o Shumaker Williams, P,C" 3425 Simpson Ferry Road, Camp Hill, Pennsylvania, 170 I, is licensed to practice law (attomey i.d, # 59001) in the Commonwealth of Pennsylvania. 3. Sometime on or about January IS, 1994, Joseph L. Rayhart and Lois Rayhart (the "Rayharts") were injured in an automobile accident. At some point thereafter, but at all times relevant to this Complaint, the Rayharts engaged Defendant as their attomey of record to prosecute their personal injury claims. 4, The Rayharts were treated by Plaintiffs agent, Dr. Thomas Boch ("01', Boch"), from January 28, 1994, through June 22, 1994. Plaintiffs professional fecs for the treatment provided to thc Rayharts totalled $6,147. Copies of Plaintitfs statements of services rendered and the related charges to the Rayharts' are attached hereto, incorporated hcrcin and marked Exhibits 'A-I' and 'A-2'. 5. On June 8, 1994, by way of two separate Icttcr agrcements, the Rayharts authorized and directed the Defcndant to pay Plaintiff for all professional scrvices rendcred by Dr. Boch and to " withhold "sllch sum from allV selllemen(, jlld~lIlen( or verdict as may he necessmy to adequatley {.vic} protect" PlaintitI Copics ofthc two Icttcr agrccmcnts arc attachcd hereto, incorporatcd hercin and marked Exhibits 'B-1' and 'B-2', Thc Rayharts also granted Plaintiff a licn on any amounts rceovcred and acknowlcdged that the agreement was made, iI/IeI' alia, in considcration of Plaintiff awaiting payment for serviccs rcndered, see Exhibits 'B-1' and 'B-2'. 6. On June 14, 1994, Dcfendant signed both of the lettcr agrecmcnts, sec Exhibits 'B-1' and 'B-2', Defendant ab'Teed to observe all the tenns of the letter agreements and also agrced to withhold monies ITom any settlcment, judgment or vcrdict to protcct Plaintiff, see Exhibits 'B-1' and 'B-2'. 7. On April 21, 1995, Defendant, as t.he Rayhart's attol11cy of rccord, filed a complaint (the "lawsuit") in this Court at No, 95-2045 against thc Washington Collcgc of Maryland. An amended complaint was filed by Dcfcndant, as the Rayhart's attomey ofrccord, on Octobcr 20, 1995. 8. On Novembcr 17. 1995, a $250,000, jury verdict was cntcred in favor ofthc Rayharts. Thcse verdicts were moldcd by thc Honorable Judge Kcvin A. Hess on August 9, 1996, to total $240,000, by deleting the jury's award of $1 0,000. in past mcdical cxpenses for thc Rayharts bccause the Rayharts were ineligible to recover first party bcncfits as a mattcr oflaw, 9. Defendant filed a praecipc to satisfY and discontinue the lawsuit on Septembcr 30, 1996, 10. On or about September 20, 1996, Dr. Boch sent a ccrtified letter to Defendant requesting that the Rayhart's bills be paid, a copy of that lcttcr is attached hereto, incorporatcd hcrcin and markcd Exhibit 'e', 11, On September 25, 1996, Defendant rcspondcd to Dr, Boch's rcqucst for paymcnt by writing that "[als soon as I receive the //Iol/ey from my c1ient.~, I willforwl7rd it to you promptly". A copy of Defendant's letter is attached hereto, incorporated herein and marked Exhibit 'D'. 12, A letter dated Novcmbcr 27, 1996, from Fred H. Hait, Esquire, was sent to Defendant requesting payment be made to PlaintilT, a copy of that letter is attached hereto, incorporated herein and marked Exhibit 'E'. . 13, Defendant responded by letter dated Deccmber 4, 1996, a copy of that Ictter is attached hereto, incorporatcd hercin and mark cd Exhibit 'F'. DefendiUlt's lettcr includcd the statement that "we did nol recover any monies lor pasl medical expenses due 10 Dr. Boch" , 14. On June 12, 1997, a letter was faxed to Defendant requesting, inler alia, payment from Defendant of Plaintiffs professional fees of$6,147 for services rendered to the Rayharts, a copy of that letter is attachcd hereto, incorporated herein and marked Exhibit 'G', 15, Defendant responded by letter dated June 13, 1997, reiterating the position taken six months earlier that "Ihelacls in Ihis mailer indicale Ihat our clients were not awarded any money lor past medical expenses", arguing that his perfonnance was somehow excused by the Rayharts withdrawal of authority to pay Plaintiff and then requesting that Plaintiff demonstrate "... how our actions were improper under the circumstances", A copy of that letter is attached hereto, incorporated herein and marked Exhibit 'H'. 16, On June 20, 1997, a letter was faxed to Defendant in response to Defendant's letter of June 13, 1997, requesting that Defendant agree in writing to the settlement tenns contained in Plaintiffs letter of June 12, 1997, by June 23,1997, A copy of that letter is attached hereto, incorporated herein and marked Exhibit'\" 17, Defendant has rcfused and continues to refuse to pay Plaintiff. COUNT I Breach Qf Contract 18. The avennents set forth in Paragraphs I through 17 of this Complaint are incorporated by reference as though the same were fully set forth herein. 19, Defendant promised to observe all of the tenns of the letter agreements, including protecting Plaintiff's professional fees out of any settlement, judgment or verdict obtained in the lawsuit. , . . 20, Defcndant's disburscment to the Rayharts of the proceeds of the lawsuit without retaining sufficient funds to pay Plaintiff was a breach of Defendant's contractual obligation to Plaintiff, 21. As a resul( of Defendant's failure to fultill his promises to Plaintiff, Plaintiff has been injured in an amount of$6,147, WHEREFORE, Plaintiff demands judgment against Dcfendant in an amOlUlt of Six Thousand One Hundred Forty-Seven ($6,147,) Dollars, plus interest and costs of suit, including counsel fees, and any other relief deemed proper, COUNT II Negligence 22. The avennents set forth in Paragraphs 1 through 21 of this Complaint are incorporated by reference as though the same were fully set forth herein, 23, Defendant had a duty to promptly notify Plaintiff upon Defendant's receipt ofthe lawsuit proceeds which he has failed to do. 24. Defendant had a further duty to deliver and account for Plaintiff's interest in the lawsuit proceeds which he also has failed to do, 25. As a direct and proximate result of Defendant's failure to notifY Plaintiff, to deliver and account for Plaintiff's interest in the lawsuit proceeds, Plaintiff has been injured in an amount of $6,147. WHEREFORE, Plaintiff demands judgment against Defendant in an amount of Six Thousand One Hundred Forty-Seven ($6,147,) Dollars, plus interest and costs of suit, including counsel fees, and any other relief deemed proper. . Plaintiff, Chirotech, Inc., t/d/b/a Boch Chiropractic Clinic, is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania. Chirotech's principal office is located at 323 York Road, Carlisle, Pennsylvania. 2. Defendant, David R. Breschi, whose current business address is c/o Shumaker Williams, P.C., 3425 Simpson Ferry Road, Camp Hill, Pennsylvania, 1701, is licensed to practice law (attorney i.d. # 59001) in the Commonwealth of Peunsylvania. 3. Sometime on or about January 15, 1994, Joseph L. Rayhart and Lois Rayhart (the "Rayharts") were injured in an automobile accident. At some point thereafter, but at all times relevant to this Complaint, the Rayharts engaged Defendant as their attorney of record to prosecute their personal injury claims. 4. The Rayharts were treated by Plaintiffs agent, Dr. Thomas Boch ("Dr. Boch"), fi.om January 28, 1994, through June 22, 1994. Plaintiffs professional fees for the treatment provided to the Rayharts totalled $6,147. Copies of Plaintiff's statements of services rendered and the related charges to the Rayharts' are attached hereto, incorporated herein and marked Exhibits 'A-I' and 'A-2'. 5. On June 8, 1994, by way of two separate letter agreements, the Rayharts authorized and directed the Defendant to pay Plaintiff for all professional services rendered by Dr. Both and to withhold "such sum from any settlement, judgment or verdict as may be necessary to adequatley [sic] protect" Plaintiff. Copies of the two letter agreements are attached hereto, incorporated herein and marked Exhibits 'B-I' and 'B-2'. The Rayharts also granted Plaintiffa lien on any mounts recovered and acknowledged that the agreement was made, inter alia, in consideration of Plaintiff awaiting payment for services rendered, see Exhibits 'B-I' and 'B-2'. 6. On June 14, 1994, Defendant signed both of the letter agreements, see Exhibits 'B-I' and 'B-2'. Defendant agreed to observe all the terms of the letter agreements and also agreed to withhold monies fi.om any settlement, judgment or verdict to protect Plaintiff, see Exhibits 'B-I' and 'B-2'. 7. On April 21, 1995, Defendant, as the Rayhart's attorney of record, filed a complaint (the "lawsuit") in this Court at No. 95-2045 against the Washington College of Maryland. An amended complaint was filed by Defendant, as the Rayhart's attorney of record, on October 20, 1995. 8. On November 17, 1995, a $250,000. jury verdict was entered in favor of the Rayharts. These verdicts were molded by the Honorable Judge Kevin A. Hess on August 9, 1996, to total $240,000. by deleting the jury's award of $10,000. in past medical expenses for the Rayharts because the Rayharts were ineligible to recover first party benefits as a matter of law. 9. Defendant filed a praecipe to satisfy and discontinue the lawsuit on September 30, 1996. 10. On or about September 20, 1996, Dr. Boch sent a certified letter to Defendant requesting that the Rayhart's bills be paid, a copy of that letter is attached hereto, incorporated herein and marked Exhibit 'C'. 11. On September 25, 1996, Defendant responded to Dr. Boch's request for payment by writing that "[a]s soon as I receive the money from my clients, I will forward it to you promptly". A copy of Defendant's letter is attached hereto, incorporated herein and marked Exh/bit 'D'. 12. A letter dated November 27, 1996, fi.om Fred H. Hait, Esquire, was sent to Defendant requesting payment be made to Plaintiff, a copy of that letter is attached hereto, incorporated herein and marked Exhibit 'E'. 13. Defendant responded by letter dated December 4, 1996, a copy of that letter is attached hereto, incorporated herein and marked Exhibit 'F'. Defendant's letter included the statement that "we did not recover any monies for past medical expenses due to Dr. Boch". 14. On June 12, 1997, a letter was faxed to Defendant requesting, inter alia, payment 15om Defendant of PlaintilTs professional fees of $6,147 for services rendered to the Rayharts, a copy of that letter is attached hereto, incorporated herein and marked Exhibit 'G'. 15. Defendant responded by letter dated June 13, 1997, reiterating the position taken six months earlier that "the facts in this matter indicate that our clients were not awarded any money forpast medical expenses", arguing that his performance was somehow excused by the Rayharts withdrawal of authority to pay Plaintiff and then requesting that Plaintiff demonstrate "... how our actions were improper under the circumstances". A copy of that letter is attached hereto, incorporated herein and marked Exhibit 'H'. 16. On June 20, 1997, a letter was faxed to Defendant in response to Defendant's letter of June 13, 1997, requesting that Defendant agree in writing to the settlement terms contained in Plaintiffs letter of June 12, 1997, by June 23, 1997. A copy of that letter is attached hereto, incorporated herein and marked Exhibit T. 17. Defendant has refused and continues to refuse to pay Plaintiff. COUNT I Breach Of Contract 18. The averments set forth in Paragraphs 1 through 17 of this Complaint are incorporated by reference as though the same were fully set forth herein. 19. Defendant promised to observe all of the terms of the letter agreements, including protecting Plaintiffs professional fees out of any settlement, judgment or verdict obtained in the lawsuit. 20. Defendant's disbursement to the Rayharts of the proceeds of the lawsuit without retaining sufficient funds to pay Plaintiff was a breach of Defendant's contractual obligation to Plaintiff. 21. As a result of Defendant's failure to fulfill his promises to Plaintiff, Plaintiffhas been injured in an amount of $6,147. WHEREFORE, Plaintiff demands judgment against Defendant in an amount of Six Thousand One Hundred Forty-Seven ($6,147.) Dollars, plus interest and costs of suit, including counsel fees, and any other relief deemed proper. COUNT II Negligence 22.
