CIVIL ACTION - LAW
JURY TRIAL DEMANDED
COMPLAINT
1. Plaintiff, Chirotech, Inc., t/d/b/a Boch Chiropractic Clinic, is a corporation organized
and existing under the laws of the Commonwealth of Pennsylvania. Chirotech's principal office is
located at 323 York Road, Carlisle, Pennsylvania.
2. Defendant, David R. Breschi, whose current business address is c/o Shumaker
Williams, P.C., 3425 Simpson Ferry Road, Camp Hill, Pennsylvania, 1701, is licensed to practice
law (attorney i.d. # 59001) in the Commonwealth of Peunsylvania.
3. Sometime on or about January 15, 1994, Joseph L. Rayhart and Lois Rayhart (the
"Rayharts") were injured in an automobile accident. At some point thereafter, but at all times
relevant to this Complaint, the Rayharts engaged Defendant as their attorney of record to prosecute
their personal injury claims.
4. The Rayharts were treated by Plaintiffs agent, Dr. Thomas Boch ("Dr. Boch"), fi.om
January 28, 1994, through June 22, 1994. Plaintiffs professional fees for the treatment provided to
the Rayharts totalled $6,147. Copies of Plaintiff's statements of services rendered and the related
charges to the Rayharts' are attached hereto, incorporated herein and marked Exhibits 'A-I' and 'A-2'.
5. On June 8, 1994, by way of two separate letter agreements, the Rayharts authorized
and directed the Defendant to pay Plaintiff for all professional services rendered by Dr. Both and to
withhold "such sum from any settlement, judgment or verdict as may be necessary to adequatley
[sic] protect" Plaintiff. Copies of the two letter agreements are attached hereto, incorporated herein
and marked Exhibits 'B-I' and 'B-2'. The Rayharts also granted Plaintiffa lien on any mounts
recovered and acknowledged that the agreement was made, inter alia, in consideration of Plaintiff
awaiting payment for services rendered, see Exhibits 'B-I' and 'B-2'.
6. On June 14, 1994, Defendant signed both of the letter agreements, see Exhibits 'B-I'
and 'B-2'. Defendant agreed to observe all the terms of the letter agreements and also agreed to
withhold monies fi.om any settlement, judgment or verdict to protect Plaintiff, see Exhibits 'B-I' and
'B-2'.
7. On April 21, 1995, Defendant, as the Rayhart's attorney of record, filed a complaint
(the "lawsuit") in this Court at No. 95-2045 against the Washington College of Maryland. An
amended complaint was filed by Defendant, as the Rayhart's attorney of record, on October 20,
1995.
8. On November 17, 1995, a $250,000. jury verdict was entered in favor of the Rayharts.
These verdicts were molded by the Honorable Judge Kevin A. Hess on August 9, 1996, to total
$240,000. by deleting the jury's award of $10,000. in past medical expenses for the Rayharts because
the Rayharts were ineligible to recover first party benefits as a matter of law.
9. Defendant filed a praecipe to satisfy and discontinue the lawsuit on September 30,
1996.
10. On or about September 20, 1996, Dr. Boch sent a certified letter to Defendant
requesting that the Rayhart's bills be paid, a copy of that letter is attached hereto, incorporated herein
and marked Exhibit 'C'.
11. On September 25, 1996, Defendant responded to Dr. Boch's request for payment by
writing that "[a]s soon as I receive the money from my clients, I will forward it to you promptly". A
copy of Defendant's letter is attached hereto, incorporated herein and marked Exh/bit 'D'.
12. A letter dated November 27, 1996, fi.om Fred H. Hait, Esquire, was sent to Defendant
requesting payment be made to Plaintiff, a copy of that letter is attached hereto, incorporated herein
and marked Exhibit 'E'.
13. Defendant responded by letter dated December 4, 1996, a copy of that letter is
attached hereto, incorporated herein and marked Exhibit 'F'. Defendant's letter included the statement
that "we did not recover any monies for past medical expenses due to Dr. Boch".
14. On June 12, 1997, a letter was faxed to Defendant requesting, inter alia, payment
15om Defendant of PlaintilTs professional fees of $6,147 for services rendered to the Rayharts, a
copy of that letter is attached hereto, incorporated herein and marked Exhibit 'G'.
15. Defendant responded by letter dated June 13, 1997, reiterating the position taken six
months earlier that "the facts in this matter indicate that our clients were not awarded any money
forpast medical expenses", arguing that his performance was somehow excused by the Rayharts
withdrawal of authority to pay Plaintiff and then requesting that Plaintiff demonstrate "... how our
actions were improper under the circumstances". A copy of that letter is attached hereto,
incorporated herein and marked Exhibit 'H'.
16. On June 20, 1997, a letter was faxed to Defendant in response to Defendant's letter
of June 13, 1997, requesting that Defendant agree in writing to the settlement terms contained in
Plaintiffs letter of June 12, 1997, by June 23, 1997. A copy of that letter is attached hereto,
incorporated herein and marked Exhibit T.
17. Defendant has refused and continues to refuse to pay Plaintiff.

protecting Plaintiffs professional fees out of any settlement, judgment or verdict obtained in the
lawsuit.
20. Defendant's disbursement to the Rayharts of the proceeds of the lawsuit without
retaining sufficient funds to pay Plaintiff was a breach of Defendant's contractual obligation to
Plaintiff.
21. As a result of Defendant's failure to fulfill his promises to Plaintiff, Plaintiffhas been
injured in an amount of $6,147.
WHEREFORE, Plaintiff demands judgment against Defendant in an amount of Six
Thousand One Hundred Forty-Seven ($6,147.) Dollars, plus interest and costs of suit, including

lawsuit proceeds which he also has failed to do.
25. As a direct and proximate result of Defendant's failure to notify Plaintiff, to deliver
and account for Plaintiffs interest in the lawsuit proceeds, Plaintiffhas been injured in an amount of
$6,147.
WHEREFORE, Plaintiff demands judgment against Defendant/n an amount of Six
Thousand One Hundred Forty-Seven ($6,147.) Dollars, plus interest and costs of suit, including

26. The averments set forth in Paragraphs 1 through 25 of this Complaint are
incorporated by reference as though the same were fully set forth herein.

this action to recover its professional fees.
28. The actions of the Defendant described herein above constitute a flagrant breach of
his contractual, professional and fiduciary responsibilities to Plaintiff such that punitive damages
should be assessed against him.
WHEREFORE, Plaintiff demands judgment against Defendant for punitive damages in
an amount in excess of the amount required for compulsory arbitration and any other relief deemed
proper by the Court.

Re: Boch Chiropractic Clinic v. Joseph & Lois Rayhart
Dear Mr. Breschi:
On 6/$/94 y,~,.~ agreed in writing to acknowledge Boch Chiropractic Clinic's lien on proceeds of any
settlement, judgment, or verdict collected on behalf of the Rayharts, to the extent necessary to pay
outstanding charges due Both Chiropractic Clinic, and to withhold fi-om any settlement, judgment,
or verdict sums sufficient to pay monies owed to Boch Chiropractic Clinic. It is my understanding
that subsequently, you did obtain a monies on account of the Rayhart's claims, and distributed the
funds to the Rayharts without making payment to Boch Chiropractic Clinic. The amount due at the
time from Joseph Rayhart was $3,207.00, and the amount due from Lois Rayhart was $2,940.00. If
in fact you did obtain funds and pay them over to the Rayharts without protecting the interest of
Boch Chiropractic Clinic, I believe that you would then be liable for the monies due to Boch
Chiropractic Clinic.
On behalf of Boch Chiropractic Clinic, I am hereby requesting payment of $6,147.00, representing
monies due on account of service rendered to Joseph and Lois Rayhart.

Dear Mr. Hait:
I received your correspondence dated November 27, 1996. In light of the fact that I am
currently in trial until the week of December 16, 1996, I cannot respond in detail to your
allegations. However, please be advised that we did not recover any monies for past medical
expenses due to Dr. Boch. All monies recovered were resulting from pain and suffering and
future medical expenses.
I will contact you during the week of December 16, 1996 to discuss this matter in more
detail. I thank you for your time and patience in this matter.

Re: Provider's lien of Boch Chiropractic Clinic
against accident case of Joseph and Lois Rayhart
Dear Mr. Breschi:
For the past nine months both you and Shumaker Williams have failed to honor my client's lien
against the Rayhart's personal injury case. You had personal knowledge of this lien and in fact
signed the lien, yet chose to disburse the settlement proceeds in contravention of my client's lien.
I believe that you became personally liable to my client at that point as did your firm. Your letter
of December 4, 1996 to Attorney I-Iait denying your responsibility on the basis that "we did not
recover any monies for past medical expenses due to Dr. Boch" is rather singular. This may
expose both you and your firm to further consequences if you are unwilling to settle this matter
without resort to litigation.
As you know, my client's lien is for $6,147. Any settlement offer must also reimburse my client
for out-of-pocket expenses in pursuing this matter as well as include interest from the date your
client's case settled.
I look forward to receiving a considered response from you by no later than the morning of
Tuesday, lune 17.
Sincerely,
Scott M. Dinner, Esquire

Re: Our File No. 698-95
Dear Mr. Dinner:
We received your correspondence dated June 12, 1997. Before we prepare a formal
response to you, we are requesting that you send to us your legal authority for your position that
what we did in this matter somehow makes me and this firm responsible to your client. The facts
in this matter indicate that our clients were not awarded any money for past medical expenses.
I have included a copy of Judge Hess' final Order in this matter that denied any award for past
medical expenses to our clients. After receiving this Order, our clients refused to provide us the
authority to pay your client the sums owed to him. Please demonstrate to us, with references to
legal authority, how our actions were improper under the circumstances.
We ask that your letter explain to us your legal and hctual basis for your position that (1)
we had the obligation to disregard our clients' clear directive not to pay your client any sums of
money, and (2) we are obligated to pay the sums owed to your client.
When we receive an appropriate response from you regarding these requests, we will
provide you with a response as to how we will proceed in this matter.
Very truly yours,
