supervision, lobar, goods, materials and facilities and the attaching of the lien therefor ore Exel
Logistics. Inc., 420 Solem Church Rood, 1'.0. !lox 1129, Mechonicsburg, Pennsylvania 170SS.
3. The Claimant contracted with Cumberland Equitics, Inc., pursuant to 0 written
contract, to supply supervision, labor, goods, materials and facilities for the original construction
and installation of the improvemcllls on lhe property described in paragraph 7 herein. If it is
detennined that Exel L.ogistics, Inc. is not the owner ofthc premiscs subject to lien, then David
Aiello has been advised, believes and therefor overs that Cumberland Equities, Inc. was acting as
agent for the owner(s) in entering into this contract. A true flnd correct copy of the contract is
attached hereto, mode 0 port hereof and marked Exhibit" A::.
4. The nature and character ofthe materials furnished pursuant to the contract were all
materials necessary for the installation and construction of 11 municiplll domestic water main llnd
11 municipal sanitary sewer main, including, but not limited to, the piping, fittings, valves,
manholes, stone bedding, plans, drawings, specifications and penn its. Claimant agreed to furnish
and install the improvements os specified in the plans and drawings supplied. The price charged
forthe materials and installation, specifically set forth in Exhibit "A", was $14S,OOO.00.
S. The amount or sum claimed to be due for the labor, goods, materials and structures is
$14S,OOO.OO, plus interest at the rate of two percent (2%) per month on the unpaid balance from
the date of completion of the structures.
6. Claimant delivered goods, materials and structures on September 9,1997, and
completed the installation lInd construction of the improvements described hereinafter on
December IS, 1997.
