4, On or about December 2B, 1995, plaintiff was the owner
of a 1988 Chevrolet Beretta, VIM IGILVIIWXJY242698, thus
travelling lawfully in all respects southbound on Route 114
attempting to turn left onto Route 111 from th~ outer of two left
turning lanes of Route 114 in the city of Mechanicsburg, county
of cumberland, commonwealth of Pennsylvania.
5. At all times material hereto, Defendant, Bolus Freight
systems, Inc. owned, possessed, controlled and maintained a 1994
Mack Tractor involved in the accident described in this
Complaint.
6. On or about December 28, 1995, Defendant, Bolus Freight
systems, Inc., was the owner of a certain motor vehicle which was
then and there being operated by its agent, servant, workman, and
employee, Jack Lee Morris, in the course and scope of his
employment, travelling on Route 114 at or near its intersection
with Route 111 in the city of Mechanicsburg, county of
Cumberland, commonwealth of Pennsylvania.
7. At the time and place stated above, Defendant, Jack Lee
Morris, was operating a 1994 Mack Tractor travelling southbound
on Route 114 at or near its intersection with Route 111, when the
motor vehicle he was operating negligently, carelessly, and
recklessly while making a left from the inner left turning lane
of Route 114 struck the plaintiff's motor vehicle which was
legally turning left, striking Plaintiff's motor vehicle on the
side, resulting in severe property damage to the Plaintiff,
8. The aforesaid occurrence was caused solely by the
negligence of the Defendant and the Plaintiff was in no manner
contributorily negligent.
9. On the aforesaid accident date, the negligence,
carelessness, and recklessness of the Defendant consisted inter
alia of:
(a) operating said vehicle in a careless, reckless, and
negligent manner;
(b) operating said vehicle without due regard for the
rights, safety and position of the Plaintiff;
(e) failure to operate vehiclC;l in an attentive manner;
(d) failure to keep proper look-out;
(e) failure to use due care under the circumstances;
(f) failure to yield;
(g) ,failure to stop;
(h) failure to have proper taillights;
(i) violating the motor vehicle statutes of Pennsylvania.
10, As a result of the aforesaid occurrence, the
Plaintiff's motor vehicle was damaged in and about its pertinent
parts the fair and reasonable value of the repairs amounting to
$2,241.23, Attached hereto and marked as Exhibit "A" is an
estimate of repairs,
