replace steering column U-jolnt; repair dash lights; and flush hearing core and required
hoses. .
4. At the time Defendant delivered the truck to Plaintiff for repairs, he was
given a written repair order and service agreement which stated, In part: that any costs
quoted are an estimate only, and are not binding: that - In the event of legal actIon to
collect any sums due. Defendants agree to pay costs of collection and fees Including
reasonable attorneys' fees: and that a finance charge of I 1/2% per month (18% per
year) wl11 be added to all balances 30 days past due. A true and copy of the repair order
and agreement Is attached hereto and identified as Exhibit "A".
5. On or about November 6, 1996, Plaintiff presented Defendant a bill for
services rendered and for parts totalling $11,623.40. A trust and correct copy of the
Invoice is attached hereto as Exhibit "B".
6. . On November 9, 1996, Defendant brought the same truck to Plaintiff for
additional repairs, which included repair to the Starter Operation and repair of the
engine oil leak. Defendant again signed a written repair order and service agreement.
A true and correct copy of the service agrement is attached hereto as Exhibit "C".
7. On November 14, 1996, Plaintiff presented Defendant a blll for services
rendered and for parts totalling $114.67. A true and correct copy of the Invoice is
attached hereto !Is Exhibit "D".
8. On April 7,1997, Defendant brought the same truck to Plaintiff for
additional repairs, which 'included repair to the right windshield wiper; perform B-PM

service; replacement of batteries and clean all connections; resecure headline In sleeper;
repair right side hcadlamp; install transmission bell housing cover; repair 011 leakage at
power steering pump area. A true and correct copy of thc repair order and agreement Is
attached. hereto as Elthiblt "E".
9. On or about May 30, 1997, Plaintiff presented Dcfendant a bill for services
rendered and for parts totalling $1,060.93. A true and correct copy of the invoice Is
attached hereto as Elthlbit "F",
10. Defendant made payments totalling $3,427.51.
11. The outstanding balance due on the invoice is $10,942.53, which Includes
accrued finance charges.
12. To date, Plaintiff has incurred or will incur collection and legal fees In the
amount of $2,735,63.
13. Despite Plaintifrs numerous attempts at collection of this amount,
Defendant has continuously refused to make payment to Plaintiff for the balance due.
WHEREFORE, Plaintiff demands judgment in an amount not In eltcess of
$25,000.00, which amount requires submission of this matter to compulsory arbitration,
plus interest and costs of suit.
