COMPLAINT - CIVIL ACTION
AND NOW, COMES the Plaintiff, Ford Motor Credit Company, by its
attorneys, Law Offices of Donald S. Mazzotta,
P.C., and
respectfully presents its complaint in civil action against the
Defendants above-named upon a cause of action whereof the following
is a statement:
1. Ford Motor Credit Company is a corporation doing business

at P.O Box 1722 Dearborn, MI 48121, and is hereinafter referred to

2. William C. Bomberger, Jr. is an individ~al residing at 400

agreement allached to Plelntlff's Complaint, however It Is denied that Plaintiff Is entitled to payment under
the terms thereof, based on the fact that Plaintiff supplied a defective vehicle to the Defendant and failed to

6, Paragraphs 1 through 7 of Defendant, Bomberger's Answer are Incorporated by reference as

9. At all times material hereto, Defendant Bomberger was lead to believe by an authorized
dealer and agent of Plaintiff that the vehicle that he was purchasing was new and free from defects,
10. Subsequent to taking possession of the subject vehicle, Defendant Bomberger had numerous
prOblems with the vehicle, Including problems with Its transmission and drlveablllty.
11. The vehicle was taken to the dealership where It was purchased to be worked on no less than
10 limes for these reoccurring problems.
12. Defendant Bomberger subsequently found out In the course of having the car worked on, that
on February 14, 1994, prior to his purchase, the vehicle was worked on by the dealership for Its drlveablllty.
13, The dealership Is an authorized agent of the Plaintiff and was aware of problems with this
vehicle prior to Its sale to Defendant Bomberger, yet either failed or refused to disclose said defects and
Instead misrepresented to Defendant Bomberger that he was purchasing a new, defect free vehicle with only
10 miles on II.
14. Despite the repeated visits to the dealership for the same complaints Involving the vehicle,
the vehicle was never adequately repaired as required by the Pennsylvania Automobile Lemon Law, 73
P.S. ~ 1951 et seg,
15. Plaintiff, and Its authorized dealership and agent are in violation of the Pennsylvania
Automobile Lemon Law, for failing to adequately repair the defective vehicle sold to Defendant Bomberger,
despite his requests pursuant to ~ 1955 of the Lemon Law that the Plaintiff either refund the full purchase
price paid or replace the vehicle with a comparable vehicle at Plaintiffs cosl.
16, Plaintiff, through the actions of lis authorized dealership and agent, has violated the
Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 P.S, ~ 201-1 et seg.. by
misrepresenting the true character of the vehicle, and failing to disclose known defects and making
misrepresentations to Defendant Bomberger which led him to believe that the vehicle was new and defect
free,
17, As a resull of the Plaintiffs violation of the Pennsylvania Lemon law and the Pennsylvania
Unfair Trade Practices Act, Defendant Bomberger seeks treble damages based on the total payments made
for the defective vehicle, cost of suit and allorney fees,

AND NOW, comes Defendant, William C. Bomberger, Jr., by and through his undersigned attorney,
Joseph L. Hitchings, Esq. and Answers Plaintiffs Complaint as follows:
1. Denied. Defendant, William C, Bomberger, Jr, Is without sufficient knowledge or Information
to form a belief as to the truth of this averment, and the same Is therefore denied and strict proof thereof Is
demanded at time of trial.
2. Denied, It is denied that Defendant, Bomberger resides at 400 David Drive, Camp Hili,
Cumberland County, Pennsylvania 17011, but rather Defendant Bomberger currently has not permanent
residence, although he does maintain a mailing address of P.O, Box 100 Enola, Cumberland County,
Pennsylvania 17025. The remainder of this paragraph relates to another Defendant.
3. Denied. To the extent that the averments of paragraph 3 state anything different from the
terms of the agreement attached to the Complaint, the same Is denied as the agreement speaks for Itself.
4. Admitted In part. Denied In part. It Is admitted that the Plaintiff Is the holder of the
agreement attached to Plalntltrs Complaint, how6ver It Is denied that Plaintiff Is entitled to payment under
the tenns thereof, based on the fact that Plaintiff supplied a defective vehicle to the Defendant and failed to
disclose defects.
5. Denied. By way of further answer, Plaintiffs defaulted under the agreement, as It was Implied
In the agreemont that the Defendant would be receiving a new vehicle free from defects, which proved not to
be true.

9. At all times material hereto, Defendant Bomberger was lead to believe by an authorized
dealer and agent of Plaintiff that the vehicle that he was purchasing was new and free from defects.
10. Subsequent to taking posseSSion of the subject vehicle, Defendant Bomberger had numerous
problems with the vehicle, including problems with Its transmission and drlveablllty,
11. The vehicle was taken to Ihe dealership where il was purchased to be worked on no less than
10 times for these reoccurring problems,
WHEREFORE, Defendsnt, WIlliam C. Bomberger, Jr., demands Judgment against Plalnllff for refund
In the total amount of payments made for the defective vehicle under the Pennsylvania Lemon Law as well
as treble damages, costs and attorney fees under the Pennsylvania Unfair Trade Practices Act.
