Failure to Serve In Accord with Rules of ClYll Procedure
Defendant Incorporates by reference the allegations contained above as If fully
set forth herein, and avers as follows:
6. The Pennsylvania Rules of CIvil Procedure, specifically Rule'400, require
Service of Original Process to be made by the sheriff of the county In which the
defendant is located,
7, Plaintiff has not alleged a rule of civil procedure which allows service of
. Plaln~ffs complaint by mall.
8. Plaintiff has failed to make service up~n the Defendant in accordance
with the Rules of Civil Procedure, and thus this Court has no jurisdiction over
Defendant.
Wherefore, Defendant respectfully requests that Plaintiffs Complaint be
dismissed, or, in the alternative, that Plaintiff be required to serve Defendant In
