I. Basic Facts as to Liability
This accident occurred on July 7, 1997, on Simpson Ferry Road, Hampden
Townshlp, Cumberland County, The Defendant, Un aln You, driving a Mitsubishl truck
for Womay Trading of Brooklyn, New York, rear-ended a Ford Torino driven by Michael
Forsythe (who was waiting to turn left) and propelled It across the road, where It struck
Plaintiff Dennis Wilkinson's car head-on. (See Police Accident Report and pollee
photographS attached hereto as "Exhibit A,")
II. Basic Facts as to Damages
Mr. WiII<lnson's most serious Inlllries were deep lacerations to his left upper
forearm and in the area of his left elbow. A large chunk of flesh was gouged out of his
upper arm, He has big, permanent scars, (See photogrllphs and expert report attached
hereto as "Exhibit B.")

Dear Attorney Spf,laker:
Mr. Dennis Wilkinson was seen In my office today, at your request for evaluation'
of his left arm, Mr. Wilkinson was Involved In an automobile accident on July 7, 1997
when his car was struck by another car coming the opposite direction that was hit from
behind and forced into the path of Mr. Wilkinson's car, Mr. Wilkinson was taken to Holy
Spirit Hospital Emergency Room where he was evaluated by Dr, Michael Page of
Susquehanna Surgeons and then taken to the operating room for debridement of the
multiple lacerations that he sustained on his arm, Mr. Wilkinson underwent a second
debridement the following day with closure of the wounds over Penrose drains, He was
followed In Dr. Page's office one week later at which time sutures were removed, only
to have the wound reopen and require resuturlng, He went on to heal satisfactorily at
that lima, He Is right handed and at the present time he has returned to his regular job
as a printer, He at no time ha~ had any physical therapy following the accident.
Mr, Wilkinson relates that he no longer has any severe pain in his arm and that
his muscle strength Is essentially as it was prior to the accident. He does however,
when driving for long distances, develop numbness in his arm and hand as though it
were going to sleep, Also when he sleeps on his left side he develops numbness In the
left hand and arm, preventing him from sleeping on that side, Mr. Wilkinson also
experiences Itching and noted marked sun sensitivity in the area of the scars during this
past summer, which is not an uncommon finding.
On physical examination, Mr. Wilkinson showed numerous scars over the lateral
aspect of the left upper arm extending from the deltoid area down to the elbow, The
most obvious of these scars is an S,shaped scar measuring 13 1/2 cm x 1,75 em in
width, This scar is depressed and creates a marked depression in his upper arm, There
is a second scar adjacent to the elbow, triangular In shape, where skin is missing and
filled in with scar tissue measuring 2 1/2 x 2 cm in size, There are a number of smaller
scars that are up to 7 and 8 cm In length which are narrow, There are areas where
there Is a blackish foreign material tattooed Into the skin, Sensation and strength appear
to be normal. Q"

I - FACTS

of Summons on December 30, 1997. Plaintiffs f.lled their Complaint
on or about Apr.il 28, 1998.
This act.'ion arises out of an
automob.lle accident that occurred on July 7, 1997.
Plaintiffs
allege that Defendant, Lin Qin, You was driving Defendant, Womay
Trading, Inc.'s truck on Simpson Ferry Road, Hampton Towr.shlp,'
Cumberland County, Pennsylvania on July 7, 1997. An automobile
being driven by Michael Forsyth was stopped on Simpson Ferry Road
with its left turn signal on in the westbound lane.
Plaintiffs
allege that Lin Qin You st ruck the Forsyth vehicle in the rear,
causing the Forsyth vehicle to enter the eastbound lane of traffic
striking Plaintiff, Dennis Wilkinson's vehicle.
After impact, Plaintiff noticed that he was bleeding and that
his arm and face had sustained lacerations. Plaintiff was taken to
the emergency room at Holy Spirit, Hospital by ambulance. The
Plaintiff underwent surgery for debridement of multiple lacerations
on his arm. Plaintiff had a second debridement on the following

day. Plaintiff alleges that he had permanent scaring as a result
of this accident.
II. ISSUES
