AND NOW comes the Defelldant/Appellant, Paul Walterick, and files Preliminary
Objections to the Complaint of Plaintiff/Appellee, Michele D. Burns, filed January 22,
1998, pursuant to ~1028(a)(I) through (3) of the Pennsylvania Rules of Civil Procedure,
and states as follows:
1. Plaintiff/Appellee failed to properly effect service of the said Complaint
upon Defendant/Appellant, as required by the Pennsylvania Rules of Civil Procedure.
2, Plaintiff/Appellee's Complaint fails to conform to law in that:
(a) Complaint is not set forth in numerical paragraphs;
(b) No verification was provided to support Complaint;
(c) No Notice to Plead was provided with Complaint; and
(d) Plaintiff/Appellee failed to provide a return address on the face of
the Complaint.
3, Plaintiff/Appellee's Complaint fails to state a cause of action to which
Defendant/Appellant can plead.
4. Plaintiff/Appellee's Complaint lacks sufficient specificity concerning the
identity of the parties or the matters to which Plaintiff/Appellee complains of and,
therefore, Defendant/Appellant cannot plead to the Complaint.
