CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE Mellon Bank, N,A., by its attorneys, Grenen & Birsic, P.C., files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff is Mellon Bank, N,A., which has its principal place of business at One Mellon Bank Center, Pittsburgh, Pennsylvania 15219. 2. The Defendants are Ronald Turner and Craig Turner, Executors of the Estate of Kathryn E, zink, individuals whose last I known addLess is R.R. #1, Box 193, Elliotsburg, Pennsylvania 17024. J, On or about June 12, 1995, Kathryn E,zink executed a Mellon Secured Personal c;redit Line Agreement ("Agreement") with Plaintiff having a credit limit of $54,449.00. A true and correct copy of said Agreement is ,marked Exhibit "A", attached hereto and made a part hereof. 4. On or about June 12, 1995, as security for payment of the aforesaid Agreement, Kathryn E, Zink, made, executed and delivered to Plaintiff a Mortgage in the original principal amount of $54,449.00 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on June 15, 1995, in Mortgage Book volume 1267, Page 233. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibi~ "B", attached hereto and made a part hereof. s. On May 29, 1996, Kathryn E. Zink died, and was the record and real owner of the aforesaid mortgaged premises until her death and the premises is currently an asset of her Estate. 6. Defendants are in default under the terms of the aforesaid Mortgage and Agreement for, inter alia, failure to pay the monthly installments of prlncipal and .interest on said Note when due. The Agreement is due for the r, ~bruary 3, 1997 payment. 7. On or about October 29, 1997, Defendants were mailed Notices of Homeowner's Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowner's Emergency Mortgage ASlolistance Act, Act 91 of 1983, True and correct copies of said Notices are marked Exhibit "C", attached hereto and made a part hereof. 10, On or about October 29, 1997, Defendants were mailed Notices of Intention to Foreclose Mortgage in compliance with Act 6 of 1974, 41 P.S. ~101, et seq, True and correct copies of said Notices are marked Exhibit "D", attached hereto and made a part hereof. 12. The plaintiff is Mellon Bank, N.A., which has its principal place of business at One Mellon Bank Center, pittsburgh, Pennsylvania 15219. 2. The Defendants are Ronald Turner and Craig Turner I Executors of the Estate of Kathryn E. zink; individuals whose last. known address is R.R. #1, Box 193, Elliotsburg, Pennsylvania 17024. 3. On or about June 12, 1995, Kathryn E.Zink executed a Mellon secured personal Credit Line Agreement ("Agreement") with Plaintiff having a credit limit of $54,449.00. A true and correct copy of said Agreement is marked Exhibit "A", attached hereto and made a part hereof. 4. On or about June 12, 1995, as security for payment of the aforesaid Agreement, Kathryn E. Zink, made, executed and delivered to plaintiff a Mortgage in the original principal amount of $54,449.00 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of cumberland county on June lS, 1995, in Mortgage Book volume 1267, Page 233. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "B", attached hereto and made a part hereof. 5. On May 29, 1996, Kathryn E. ZJ.nk died, and was the record and real owner of the aforesaid mortgaged premises until her death and the premises is currently an asset of her Estate. 6. Defendants are in default, under the terms of the aforesaid Mortgage and Agreement for, inter alia, failure to pay the monthly installments of principal and interest on said Note when due. The Agreement is due for the February 3, 1997 payment. 7. On or about October 29, 1997, Defendants were mailed Notices of Homeowner's Emergency Mortgage Assistance Act of 1983, i.n compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983. True and correct copies of said Notices are marked Exhibit "C", attached hereto and made a part hereof. 10. On or about October 29, 1997, Defendants were mailed Notices of Intention to Foreclosa Mortgage in compliance with Act 6 of 1974, 41 P.S. S101, et seq. On or about June 12, 1995, Kathryn E,Zink executed a Mellon Secured Personal Credit Line Agreement ("Agreement") with plaintiff having a credit limit of $54,449.00, A true and correct copy of ealdAgreement is marked-EXhibit "A", attached hereto and made a part hereof. 4. On or about June 12, 1995, as security for payment of the a foresaid Agreement, Kathryn E. Zink, made, executed and delivered to Plaintiff a Mortgage in the original principal amount of $54,449.00 on the premises hereinafter described, said Mortgage being recorded in the Office of the Recorder of Deeds of Cunwerland County on June 15, 1995, in Mortgage Book Volume 1267, Page 233. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "B", attached hereto and made a part hereof. 5. On May 29, 1996, Kathryn E, Zink died, and was the record and real owner of the aforesaid mortgaged premises until her death and the premises is currently an asset of her Estate. 6. Defendants are in default under the terms of the aforesaid Mortgage and Agreement for, inter alia, failure to pay the monthly installments of principal and interest on said Note when due. The Agreement is due for the February 3, 1997 payment. 7. On or about October 29, 1997, Defendants were mailed Notices of Homeowner's Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983.
