1. Plaintiff, Law Offices of Patrick F. Lauer, Jr., a law
firm conducting business at 2108 Market Street, Camp Hill,
Cumberland County, Pennsylvania, 17011.
2. John Fishel, Sr. is an adult individual who currently
resides at 438 Water Street, New Cumberland, Cumberland County,
Pennsylvania 17070.
3. On or about February 8, 1996, the Defendant requested
Plaintiff to represent the Defendant's son, John Fishel, regarding
criminal charges that were filed against Defendant's son in the
Court of Common Pleae of York County, Pennsylvania.
4. The Plaintiff and the Defendant agreed that the Plaintiff
would provide legal services in representing the Defendant's son on
the charges of burglary, theft by unlawful taking or deception and
receiving stolen property.
5. The Plaintiff and the Defendant agreed that the Defendant
would compensate Plaintiff $6000.00 for services to be
rendered on the aforesaid matter.
6. Plaintiff represented the Defendant's son in a three day
jury trial in York County, Pennsylvania.
7. PlaJ.ntiff obtained an acquittal for the Defendant's son.
8. At the time the Plaintiff was conducting the jury trial on
the aforesaid c~se for Defendant's Bon, the Defendant was still
obligated to pay Plaintiff $3000.00 for services rendered.
9, The Defendant promised he would compensate Plaintiff for
services rendered on the aforesaid matter.
10. Subsequent to the jury trial, which led to the acquittal
of the Defendant's son, the Plaintiff and Defendant entered into a
written agreement on February 19, 1997 whereby the Defendant agreed
to reimburse Plaintiff $400.00 on February 28, 1997. (See att~ched
Exhibit A)
11. The Defendant did compensate Plaintiff $400.00 on
February 28, 1997 leaving a balance owing to the Plaintiff in the
amount $2600.00.
12. The Defendant agreed that he would make monthly payments
of something until the $2600.00 was paid in full.
13. This written agreement was signed by John Fishel, Sr.,
Defendant, on February 19, 1997.
14. The Defendant has compensated the Plaintiff $400.00
from that date.
15. The Defendant is in breach of the aforesaid agreement in
that he has not compensated the Defendant any SumB of money since
28th day of February 1997.
16. Wherefore, Plaintiff demands judgement against the
Defendant in the amount of $2600.00, the legal rate of interest
since February, 19, 1997, court costs and otheJ:' appropriate relief.

18. The Plaintiff performed services for Defendant's benefit.
