COMPLAINT IN CIVIL ACTION AND NOW COMES, Plaintiff, Ohio National Financial Services, by and through its counsel, WELTMAN, WEINBERG & REIS, CO., L.P.A., and hereby files this Complaint against Defendant, Benedette A. Karwaski. In support thereof, Plaintiff avers as follows: 1. Plaintiff is an Insurance Company with offices located at One Financial Way, Cincinnati, Ohio 45242. 2. Defendant is an individual residing at 6202 Stanford Court, Mechanicsburg, PA 17050. 3. Anthony Ciullo was the primary beneficiary of Immediate Annuity P0069885. 4. Lois L. Ciullo was the secondary beneficiary of Immediate Annuity P0069885. 5. Immediate Annuity P0069885 was an annuity, which provided payments in the monthly amount of $141.48 to Anthony Ciullo for his lifetime with at least 180 monthly payments guaranteed. 6. At the time of his death, Anthony Ciullo received 122 such payments. 7. Upon his death, Anthony Ciullo's wife, Lois Ciullo, was entitled to the remaining 58 guarantee payments as per the terms of the annuity. 3 8. Lois Ciullo received 29 monthly payments of $141.48 until her death in October 24, 2002. 9. Since Lois Ciullo's was the last named beneficiary, the commuted value for the remaining payments is due to her Estate upon death. 10. Since Plaintiff was not notified of Lois Ciullo's death, Plaintiff continued to make 23 monthly payments after Defendant's death. 11. Despite her death, Lois Ciullo's monthly distribution checks were negotiated through an account held jointly by the decedent, Lois Ciullo, and the defendant, Benedette Karwarski. 12. Plaintiff avers that Defendant forged the endorsement and then fraudulently deposited 23 checks made payable to the decedent, Lois Ciullo, into the joint account. 13. As of October 24, 2002, Defendant was the only living person with access to the above referenced account. 14. Pursuant to 13 Pa.C.S.A. §4208 and 13 Pa.C.S.A. §3417, Plaintiff, by paying on the aforementioned check, received the presentment warranties from Defendant that the checks deposited were neither forged nor fraudulent. 15. Defendant is liable for damages for breach of warranty equal to the amount paid by the Plaintiff, namely $ 3,254.04, as well as for expenses and loss of interest resulting from the breach pursuant to 13 Pa.C.S.A. §4208(a)-(b) and 13 Pa.C.S.A. § 3417(a)-(b). 16. Plaintiff avers that its Attorney Fees will amount to $500. 17. Defendant was not entitled to these funds, yet failed to notify either bank of the unauthorized deposits. 18. Although requested to do so by Plaintiff, Defendant has willfully failed and/or refused to return the fraudulently deposited funds. 4 19. As a result of Defendant's retention of the funds, Defendant has become unjustly enriched at Plaintiffls expense in the amount of $3,254.04. 20. Defendant has neither an ownership right nor an interest in the funds deposited into her account. An injustice would result if Plaintiff were denied recovery for the enrichment bestowed upon the defendant. WHEREFORE, Plaintiff requests judgment against the defendant in the amount of $3,254.04, plus attorneys' fees of $500, interest at the legal rate of 6% from the date of interest, plus costs. Karwaski. In support thereof, Plaintiff avers as follows: 1. Plaintiff is an Insurance Company with offices located at One Financial Way, Cincinnati, Ohio 45242. 2. Defendant is an individual residing at 6202 Stanford Court, Mechanicsburg, PA 17050. 3. Anthony Ciullo was the primary beneficiary of Immediate Annuity P0069885. 4. Lois L. Ciullo was the secondary beneficiary of Immediate Annuity P0069885. 5. Immediate Annuity P0069885 was an annuity, which provided payments in the monthly amount of $141.48 to Anthony Ciullo for his lifetime with at least 180 monthly payments guaranteed. 6. At the time of his death, Anthony Ciullo received 122 such payments. 7. Upon his death, Anthony Ciullo's wife, Lois Ciullo, was entitled to the remaining 58 guarantee payments as per the terms of the annuity. 3 ' 8. Lois Ciullo received 29 monthly payments of $141.48 until her death in October 24, 2002. 9. Since Lois Ciullo's was the last named beneficiary, the commuted value for the remaining payments is due to her Estate upon death. 10. Since Plaintiff was not notified of Lois Ciullo's death, Plaintiff continued to make 23 monthly payments after Defendant's death. 11. Despite her death, Lois Ciullo's monthly distribution checks were negotiated through an account held jointly by the decedent, Lois Ciullo, and the defendant, Benedette Karwazski. 12. Plaintiff avers that Defendant forged the endorsement and then fraudulently deposited 23 checks made payable to the decedent, Lois Ciullo, into the joint account. 13. As of October 24, 2002, Defendant was the only living person with access to the above referenced account. 14. Pursuant to 13 Pa.C.S.A. §4208 and 13 Pa.C.S.A. §3417, Plaintiff, by paying on the aforementioned check, received the presentment warranties from Defendant that the checks deposited were neither forged nor fraudulent. 15. Defendant is liable for damages for breach of warranty equal to the amount paid by the Plaintiff, namely $ 3,254.04, as well as for expenses and loss of interest resulting from the breach pursuant to 13 Pa.C.S.A. §4208(a)-(b) and 13 Pa.C.S.A. § 3417(a)-(b). 16. Plaintiff avers that its Attorney Fees will amount to $500. 17. Defendant was not entitled to these funds, yet failed to notify either bank of the unauthorized deposits. 18. Although requested to do so by Plaintiff, Defendant has willfully failed and/or refused to return the fraudulently deposited funds. 4 ' 19. As a result of Defendant's retention of the funds, Defendant has become unjustly enri~ned at Plaintiff's expense in the amount of $3,254.04. 20. Defendant has neither an ownership right nor an interest in the funds deposited into her account. An injustice would result if Plaintiff were denied recovery for the enrichment bestowed upon the defendant. WHEREFORE, Plaintiff requests judgment against the defendant in the amount of $3,254.04, plus attorneys' fees of $500, interest at the legal rate of 6% from the date of interest, plus costs.
