In support of the motion, Mr. Mongeluzzo states as follows: 1. On or about October 29, 2004, a lawsuit was filed by the Plaintiff before the Honorable Paula P. Correal, a District Justice located in Carlisle, PA. The lawsuit sought damages for a'n alleged breach of contract wherein the Plaintiff purported to have provided legal services to Mr. Mongeluzzo. Subsequently, on January 31, 2005, a default judgment was entered against Mr. Mongeluzzo. More recently on January 16, 2007 the aforesaid default judgment was filed of record before this Court. 2. Reasons for Seeking Relief: Although this Court is empowered to 1 2 at this first opportunity. Second, several defenses exist to the underlying claim. Mr. Mongeluzzo never retained the services of the plaintiff law firm here. Mr. Mongeluzzo never contracted with the law firm. Mr. Mongeluzzo never entered into any agreement within the geographic boundaries or jurisdiction of the district justice who is located outside Harrisburg, PA. WHEREFORE, JOHN A.
