"t)L.: ~c: U) th@" o R D E R This is the time scheduled for N :. ~ :; hearings on cross protections from abuse filed by Barry' Wilkinson for himself and on behalf of Michael Wilkinson versus Debra Wilkinson as well as Debra Wilkinson versus Barry Wilkinson. We note that Ms, Wilkinson apparently had 1 ."': t -:'II . .:..~.~~ .... ~ '. , ' filed in Cumberland County originally. This case is now refiled in York County, so our decision here would be binding on Cumberland County. In reference to the petition of Barry Wilkinson against Debra Wilkinson and also on behalf of Michael Wilkinson, Mr. Wilkinson testified, and initially primarily his testimony concerned violations of his property rights with Mrs. Wilkinson. And after we heard from Mrs. Wilkinson, we obviously had a credibility issue to resolve. We resolved that matter of credibility in favor of Debra Wilkinson, and, accordingly, we dismiss the petition filed by Barry Wilkinson and also on behalf of his son, Michael Wilkinson, against Debra Wilkinson. We, however, after hearing testimony, find that Debra Wilkinson has been abused within the meaning of the Protection From Abuse Act, and, accordingly, the following order will be entered: The Defendant, Barry Wilkinson, is hereby enjoined and prohibited from abusing, harassing and/or threatening Plaintiff or placing her in fear of abuse or having any contact whatsoever with her at any place where she may be found, including her residence, her place of employment or any other place during the term of this order, This conduct includes, but is not limited 2 to, directly or indirectly through third persons, attempting to cause or intentionally and knowingly or recklessly causing any bodily injury or serious bodi~y injury to the Plaintiff, that would be Debra Wilkinson, either with or without a deadly weapon. The sheriff's office has already confiscated firearms from Mr. Wilkinson, We direct that Mr. Wilkinson will not possess or purchase any firearms during the term of this order, The Defendant, Barry Wilkinson, will pay the costs of filing, copying and service of these petitions to the treasurer's of York County located on the fourth floor, One West Marketway, York. These costs are to be paid within 90 days of today's date. It will be his responsibility to contact the treasurer's office to determine the exact amount of the costs and to notify the treasurer's office within 48 hours of any change in his mailing address or place of residence, The Defendant, Barry Wilkinson, is directed to contact the Advance program through Lutheran Social Services for a batterers' evaluation within 14 days of today's date, It will be his responsibility to follow through with any therapy or program which may be recommended, In other words, he's directed to follow through with any therapy or program that may be 3 recommended. This order shall remain in full force and effect for a period of one year from this date or until further order of Court. We direct that copies of this order will be sent to the Plaintiff, Debra Wilkinson, at 1109 Byverdon Drive, apartment B-7, Camp Hill, PA 17011, Send a copy as well to the Defendant, Barry Wilkinson, at 446 Big Sky Drive, Etters, PA 17319. Send a copy to Attorney Kathleen Prendergast, to York County Control, York County Sheriff's Department, Newberry Township Police Department and West Shore Regional Police, ACCESS and the York County Treasurer's Office as well as Advance. We now want to advise the Defendant that if he violates any of the terms of this order, he may be arrested without a warrant and charged with indirect criminal contempt.
