consideration of the Appellant's Appeal From License Suspension,
and the Appellant having failed to appear for the hearing on the
appeal, and the Court having waited in excess of 15 minutes
beyond the time scheduled for the hearing to facilitate the
Appellant's appearance, and upon motion of the Commonwealth in
the person of George H. Kabusk, Esquire, the Appellant's Appeal

1. The Appellant, Libero Marinelli, Jr., is an adult individual who currently
resides at 2908 Westbury Court, #809, Camp Hill, Cumberland County, Pennsylvania.
2. The Commonwealth of Pennsylvania, Pennsylvania Department of
Transportation, Bureau of Driver Licensing, Harrisburg, Dauphin County, Pennsylvania,
17123, is a state agency.
3. The appellant was arrested on September 29, 1997 allegedly for
knowingly operating his motor vehicle after suspension of registration.
4. The Appellant pleaded guilty to the alleged offense and paid a fine for the
alleged offense as a matter of convenience, without knowing the collateral
consequences of a conviction for the alleged offense, i.e., the suspension of his
driver's license.
5. The Appellant was notified on or about December 12, 1997, that his
license was being suspended for a period three months, and that such suspension
would go into effect on January 23, at 12:01 A,M. A true and correct copy of the
Notice from the Appellee is attached as Exhibit "A" to this Notice of Appeal.
6. At the time of his arrest, the Appellant was not aware that the registration
for his motor vehicle had been suspended.
7. The suspension of the Appellant's driver's license would cause him
extreme hardship.

Simultaneously with the filing of this notice of appeal, the Appellant Is
2 filing a notice of appaal to Initiate an appaal nunc pro tunc of his conviction for the
3 alloged offense of driving his motor vehicle subsequent to the suspension of the
4 registration for that motor vehicle, and believes that If an appeal pursuant to that
5 notlca Is grant, It will be found to have substantial merit and result in the reversal of
6 his conviction.
7 WHEREFORE, the Appellant respectfully requests that this Honorable Court
8 grant him a hearing and order the Appellee to rescind its order suspending the
9 Appellee's driver's license.

Dear Motorist:
As a result of your conviction on 11/18/1997 of violating
Section 1371 of the Vehicle Code, DRIVE WHILE REG.SUSP/REVO
on 09/29/]997, your driving privilege is being SUSPENDED for
a period of 3 MONTH(S) as mandated by Section 1532B of the
Vehicle Code.
In order to comply with this sanction yOU are required to
return any current driver's license, learner's permit and/or
temporary driver's license (camera card) in your possession
no later than the effective date listed. If yoU cannot com-
ply with the requirements stated above, you are required to
submit a DL16LC Form or a sworn affidavit stating that you
are aware of the sanction against your driving privilege.
Failure to comply with this notice shall result in this Bu-
reau referring this matter to the Pennsylvania State Police
for prosecution under SECTION l57I(a)(4) of the Vehicle Code.

Although the 1all mandates that your driving privilege is un-
der suspension even if you do not surrender your license,
Credit will not begin until all current driver's license
product(s), the DL16LC Form, or a letter acknowledging your
sanction is received in this Bureau.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGEMENT,
WE WILL SEND YOU A RECEIPT. IF YOU DO NOT RECEIVE THIS RECEIPT
WITHIN 15 DAYS CONTACT THE DEPARTMENT IMMEDIATELY. OTHERWISE,
YOU WILL NOT BE GIVEN CREDIT TOWARD SERVING THIS SANCTION.
