upon presentation and consideration of the within Petition, and upon finding that the Plaintiff, Suzanne
M. VlII1over, now residing at an undisclosed location in Cumberland County, Pennsylvania, is in
immediate and present danger of abuse from the Defendant, Lee E. Vanover, the following Temporary
Order is entered.
The Defendant, Lee E, Vanover, now residing at 308 Reno Street, Apartment lB, New
Cumberland, Cumberland County, Pennsylvania, is hereby enjoined from physically abusing the
Plaintiff, Suzanne M, Vanover, or placing her in fear of abuse and is excluded from the residence loeated
at 383 N. 19th Street, Camp Hill Borough, Cumberland County, Pennsylvania, a residence which is
owned solely by the Plaintiff. The Defendant is hereby notified that if he resides in the Plaintiffs
domicile contrary to this Order, he may be in indirect criminal contempt which is punishable by a fine
not to exceed $1,000.00 and/or by a sentence of up to six months in jail and any other appropriate
punishment. Consent of the Plaintiff to the Defendant's resumption of residence with the Plaintiff shall
not invalidate this Order. The Defendant shall seek modification (change) of this Order before resuming
residence in the Plaintifrs domicile, wherever it may be.

The Defendant is ordered to refrain from having any contact with the Plaintiff including, but not
limited to, restraining the Defendant from entering the place of employment or business or school of the
Plaintiff and from harassing the Plaintiff andlor Plaintiffs relatives.
This Order shall remain in effect until a final order is entered in this case, A hearing shall be
held on this matter on the ,s0' day of -J~ .19'( at 1 I' 0 o'clock f..M, in
Courtroom No, f) ,Cumberland County Courthouse, Carlisle, Pennsylvania.
The Cumberland County Sheriffs Office shall attempt to make service at the Plaintiffs request,
but service may be accomplished under any applicable rule of Civil Procedure.
The Camp Hill Police Department and the New Cumberland Police Department will be provided
with a copy of this Order by attorneys for Plaintiff. This Order shall be enforced by any law enforcement
agency where a violation occurs by arrest for indirect criminal contempt without warrant upon probable
cause that this Order has been violated, whether or not the violation is committed in the presence of the
police officer. In the event that an arrest is made under this section, the Defendant shall not be taken to
jail but shall be taken without unnecessary delay before the Court that issued the Order. When that Court
is unavailable, the Defendant shall be arraigned before a district justice who shall set bail according to
the provisions of Chapter 4000 of the Pennsylvania Rules of Criminal Procedure (23 Pa. C.S.A. Section
6113).

RELIEF UNDER THE PENNSYLVANIA PROTECTION FROM ABUSE ACT
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW COMES the Plaintiff, Suzanne M. Vanover, by and through her attorney Lisa Marie
Coyne, Esquire, and avers the following in support of her Petition for Protective Order pursuant to the
Protection from Abuse Act,23 Pa. C.S.A. Section 6101, el seq.
A. ABUSE
1. The Plaintiff, Suzanne M. Vanover, is an adult individual whose pennanent address is
383 N. 19th Street, Camp Hill, Cumberland County, Pennsylvania..
2. The Plaintiff is temporarily staying at an undisclosed location for her own protection and
to avoid further abuse as is more fully set forth herein. This address will be furnished to the court upon
request.
3. The Defendant is an adult individual residing at 308 Reno Street, Apartment I-B, New
Cumberland, Cumberland County, Pennsylvania.
4. The Defendant is the husband of the Plaintiff and on November 19, 1997, the Plaintiff
filed for a divorce from the Defendant which divorce action is docketed to No. 97-6439 Civil Tenn of
this Court.

5, Since January I, 1998, the Defendant has attempted to cause and has intentionally,

knowingly, or recklessly caused bodily injury, spousal sexual assault to the Plaintiff and by physical
menace has placed the Plaintiff in fear or imminent serious bodily injury. This has included but is not
limited to the following specific instances of abuse:

Prowling in an around Plaintiffs home.
e. Stalking the Plaintiff.
d. Breaking into the Plaintiffs home and sexually assaulting the Plaintiff and threatening
that, "if Plaintiff wants to live, then she must have sexual intercourse with Defendant."
e. Making repeated and harassing telephone calls to the Plaintiff at her place of
employment and residence.

On January 3, 1998, the Plaintiff left her residence at 383 N, 19th Street, Camp Hill,

Cumberland County, Pennsylvania in order to avoid further abuse.

7. The Plaintiff believes and therefore avers that she will be in immediate and present
danger of abuse from the Defendant should she return to the home and is in need of protection from such
abuse.
8. The plaintiff desires that the Defendant be restrained from entering her place of
employment, business or school having any contact with her, hamssing the Plaintiff or Plaintirrs
relatives.

WHEREFORE, pursuant to the provisions of the "I'rutcctlon Ihlln Abuse Act" of October 7,
1976,23 Pa. C.S.A. Section 6101 ~ WI., as amended, tbe 1'lalntlll'prllYs this lIonorahle Court to grant
the following relief:
A. Grant a Temporary Order pursuant to the "Protection from Ahuse Act:"
I, Requiring the Defendant to refruin from ahuslll11 the I'luintlff or placing her in fear of
abuse,
2. Requiring the Defendant to refrain (hill! having any contact with the Plaintiff,
including, but not limited to, restraining the Defendant from entering the place of employment or
business or school of the Plaintiff and from harassing the Plaintiff and Plaintiffs relatives.

Cumberland County, Pennsylvania to the Plaintiff to the exclusion of the Defendant pending a final order

B. Schedule a hearing in uecordunee with the provisions uf the "Protection from Abuse
Act", and, after such hearing, enter un order to he in effect for u period of one year:

Cumberland County, Pennsylvania to the Plaintiffto the exclusion of the Defendant pending a final order
in this matter;
4. Ordering the Defendant to stay away from any residence the Plaintiff may in the
future establish for herself; and
5, Ordering the Defendant to pay all costs of filing and service of this lawsuit and the
Plaintiff's attorney's fees.
The Plaintiff further asks that this Petition be filed and served without payment of costs, pending
a further order at the hearing, and that a copy of this Petition and Order be delivered to the Camp Hill
Police Department and the New Cumberland Police Department as the Police Departments with
jurisdiction to enforce this Order.
The Plaintiff prays for such other relief as may be just and proper.

AND NOW, this IS- day of January, 1998, upon consideration of the Consent
Agreement of the parties, the following Order is entered:
1. The Defendant, LEE E. VANOVER, is enjoined from physically abusing the
Plaintiff, SUZANNE M. VANOVER, and/or from placing her in fear of abuse.
2. The Defendant is enjoined from having any direct or indirect contact with the
Plaintiff including, but not limited to, telephone and written communications.
3. The Defendant is ordered to refrain from harassing, following, and/or stalking
the Plaintiff and from harassing the Plaintiffs relatives,
4. The Defendant is prohibited from entering the Plaintiffs place of employment.
5. The Defendant is prohibited from removing, damaging, destroying, or selling
any property owned by the Plaintiff or jointly owned by the parties.
6. The Defendant is excluded from the Plaintiffs residence located at 383 North
19th Street, Camp Hill, Cumberland County, Pennsylvania and any other residence the Plaintiff
may establish.
7. The Defendant is ordered to stay away from the Plaintiffs residence located at
383 North 19th Street, Camp Hill, Cumberland County, Pennsylvania and any other residence
the Plaintiff may establish.
8. The Defcndant is ordered to immediately reimburse the Plaintifrs out.of-poeket
court costs in the amount of $45,50. The Defendant understands that this award does not
constitute a bar to litigation for civil damages for other injuries sustained from thc acts of abusc
giving rise to this award.
9. This Ordcr shall rcmain in effect for a pcriod of one (I) ycar or until modified or
tenninated by the Court. The Order can be extended beyond its original expiration date if thc
Court finds that the Defendant has committcd another act of abuse or has engaged in a pattern or
practice that indicates continued risk ofhann to thc Plaintiff
10. A violation of this Order may subject the Defendant to: i) nrrest under 23 Pa.
C.S. Section 6113; ii) a private criminal complaint under 23 Pa. C.S. Section 6113.1; Hi) a charge
of indirect criminal contempt under 23 Pa. C.S. Section 6114, punishable by imprisonment up to
six (6) months and a fine of One Hundred Dollars ($100.00) to One Thousand Dollars
($1,000.00); and iv) civil contempt under 23 Pa. C.S. Section 6114,1. Resumption of co-
residence on thc part of the Plaintiff and Dcfendant shall not nullify the provisions of the court
order.
11. The Pennsylvania State PolicelPolice Department(s)/appropriate police
department(s) shall be provided with a certified copy(ies) of this Order by the Plaintiffs attorney
and may enforce this Order by arrest for indirect criminal contempt without warrant upon
probable cause that this Order has been violated, whether or not the violation is com,mitted in the
presence of a police officer. In the event that an arrest is made under this section, the Defendant

CONSENT AGREEMENT
This Agreement is entered on this 14th day of 1anuary, 1998, by the Plaintiff, SUZANNE M.
VANOVER, and the Pefendant, LEE E, VANOVER. The Plaintiff is represented by LISA MARIE
COYNE, ESQUIRE; the Defendant is reprucnled by WALTER L. CRESSLER, JR" ESQUIRE. 'n\e
parties agree that the following may be entered as an Order of Court.
1. The Defendant, LEE E, VANOVER, agrees to refrain from abusing the Plaintiff,
SUZANNE M. VANOVER, andlor placing her in fear of abuse,
2, The Defendant agrees not to have any direct or indirect contact with the Plaintiff
inoluding, but not limited to, telephone and written communications.
3, The Defendant agrees not to harass, follow, andlor stalk the Plaintiff and not to harass
the Plaintiffs relatives,
4. The Defendant agrees not to enter the Plaintiff's place of employment.
S. The Defendant agrees not to remove, damage, destroy, or sell any property owned by the
Plaintiff or jointly owned by the parties.
6, The Defendant agrees to stay away from the Plaintiffs residence located at 383 North
19th Street, Camp Hill. Cumberland County, Pennsylvania, and any other residence the Plaintiff Il1l1Y

7. The Defendant agrees to reimburse the Plaintiff's out. of-pocket coun costs in the
amoUnt of $45.50 immediately upon signing of this Agreement. The Defendant understands that this
award does not r.onstitute a bar to litigation for civil damages for other injuries SUSllIined !Tom the aCIll of
abuse givini rise to this award.
8. The Defendant agrees to pay all costs of filini and service fees of this lawsuit.
9. The Defendant, although entering into thiG Agreement, does not admit the allegations
made in the Petition.
10. The Defendmt understands that the Protection Order entered in this matter will be in
effect for a period of one (1) year and can be extended beyond its orillinal elqliration date if the Court
finds that the Defendant has committed another act of abuse or has engaged in a pattern or practice that
Indicates continued risk of harm to the Plaintiff. The Defendant understands that this Order will be
enforceable in the same manner as the Coun's prior Temporary Protection Order entered In this case.
11. Violation of the Protection Order may subject the Defendant to: i) mest under 23 Pa.
e,s. Section 6113; ii) a private criminal complaint under 23 Pa. C.S. Section 6113,1; iii) a charge of
Indirect criminal contempt under 23 Pa. C.S, Section 6114, puni,hable by imprisonment up to six (6)
months and a fine of One Hundred Dollars (5100.00) to One Thousand Dollars ($1,000.00); and iv) civil
contempt under 23 Pa. e.s. Section 6114,1.
