PETITION
AND NOW, comes the following Petitioners, residents of East Pennsboro Township,
through the undersigned counsel, and hereby petition this Honorable Court for the division of
East Pennsboro Lower Precinct into two election districts pursuant to Sections 502 and 503 of
the Pennsylvania Election Code, 25 P.S. §§ 2702 and 2703, and in support thereof state as
follows:
1. East Pennsboro Lower Precinct is a duly organized and existing First Class
Township of the Commonwealth of Pennsylvania, with its principal place of business being
located at its Township offices located at 98 S. Enola Drive, Enola, Pennsylvania, 17025.
2. According to the precinct registration summaries as of May 14, 2002, East
Pennsboro Lower Precinct consists of one election district that serves 3,251 registered voters.
3. East Pennsboro Lower Precinct is the 9th largest of the 9,426 voting districts in the
State and has the most registered voters of any voting district in Cumberland County.
4. According to the April 1, 2000 census, 5,152 people reside in this voting district.
East Pennsboro Lower Precinct has the 33rd highest population of the 9,426 voting districts in the
State.

5. Currently, voting for the East Pennsboro Lower Precinct is held at West Creek
Hills Elementary School located at 400 Erford Road, Camp Hill, PA. 17011.
6. Section 502 of the Pennsylvania Election Code, 25 P.S. § 2702 (Supp.), provides
in part as follows:
[T]he court of common pleas of the county in which the same are located,
may form or create new election districts by dividing or redividing any
borough, township, ward or election district into two or more election
districts of compact and contiguous territory .... Except for good cause
shown, election districts so formed shall not contain more than one
thousand two hundred (1,200) registered electors.
7. Section 503 of the Pennsylvania Election Code,25 P.S. § 2703 (Supp.), further
provides in part, that:
Upon the petition of twenty registered electors of any township, borough,
ward or election district, to the court of the proper county, praying for the
division or redivision of such township, borough, ward or election district
... the said court shall refer the said petition to the county bohrd of
elections, which shall make a full investigation of the facts, and shall
report to the court its findings and recommendations as to the division ...
prayed for. If the county board shall find that a division ... of election
districts will promote the convenience of the electors and the public
interests, it shall recommend a proper division ... which must have clearly
visible physical boundaries, and shall accompany its report with a map and
a verbal description of the boundaries, as well as a certification of the
number of electors registered in each of the resulting election districts for
the immediately preceding general or municipal election.
8. The undersigned Petitioners, attached hereto as Exhibit "A", residents of East
Pennsboro Lower Precinct, believe and therefore aver, that it is necessary and appropriate to
divide the East Pennsboro Lower Precinct into two election districts so as to promote the
convenience of the electors and the public interest, for the following reasons:
a. The East Pennsboro Lower Precinct with 3,251 registered voters is
currently the largest of all voting precincts in Cumberland County, and as such, is

more than 2.5 times the statutorily recommended size of 1,200 registered voters
for election districts;
b. The large number of registered voters who must cast their votes at this
single polling place creates delays in voting during primary and general elections
and discourages prospective voters from exercising their right to vote. In fact, in
the 2002 primary and general elections, numerous voters in this precinct
came and left without voting because of the long lines and length of time to
cast their votes. It is also believed is therefore averred, that some voters do
not even bother to vote because of their knowledge of these long lines.
c. The East Pennsboro Lower Precinct continues to experience growth in
both its housing and population and it is therefore believed and averred, that the
present situation which discourages residents from voting, will only worsen,
unless relief is granted and the precinct spit;
d. Adding additional election booths or polling tables may not alleviate the
long lines or unreasonable waits by voters in East Pennsboro Lower Precinct,
since Section 1220 of the Pennsylvania Election Code, 25 P.S. § 3060(a),
prohibits more than ten (10) voters at any one time in the polling place (the room
provided for voting), outside of the enclosed space at any primary or general
election;
f. The western and eastern portions of the East Pennsboro Lower Precinct
are not presently contiguous to each other, but rather are divided by the East
Pennsboro Upper Precinct. The polling place for the lower precinct is located in
the eastern portion of the precinct;

g. The location of the polling place in the eastern portion of the precinct has
and continues to become more inconvenient to the growing population in the
western portion of the East Pennsboro Lower Precinct;
h. The county committees of both the Republican and Democrat Parties are
organized by electing one male and one female committee person at the voting
district level. The registered Republicans and Democrats in this voting district are
under-represented on their respective county committees for organizational and
endorsement purposes;
i. Since each party elects only two county committee members for this
voting district the large population creates an undue burden upon them in
communications with the voters of this voting district;
9. Based on the April 1, 2000 census, the East Pennsboro Lower Precinct contains
5,152 people. It is believed and therefore averred, that the eastern part of the lower precinct
contains a population of approximately 3,362 people with approximately 2,059 registered voters.
It is believed and therefore averred, that the western part of the lower precinct contains a
population of approximately 1,520 people with approximately 1,192 registered voters.
10. The existing geography and demographics of the East Pennsboro Lower Precinct
naturally suggest that the aforesaid western and eastern portions could easily be separated to
constitute their own election precincts, and be referred to as "East Pennsboro Lower West" and
East Pennsboro Lower East".

11. The western and eastern portions of the East Pennsboro Lower Precinct, which
may constitute the new voting districts, are as depicted on the East Pennsboro Township map
attached hereto as Exhibit "B", which illustrates the township and its voting precincts.
12. Petitioners believe and therefore aver, that the Oyster Mill Playhouse, located at
1001 Oyster Mill Road, Camp Hill, PA. 17011, would be suitable and is available as a polling
place to serve the suggested "East Pennsboro Lower West" precinct, and that such place is also
handicapped accessible. The suggested "East Pennsboro Lower East" precinct could continue to
be served by the existing polling place at West Creek Hills Elementary School.
13. Although dividing the East Pennsboro Lower Precinct between its western and
eastern portions as suggested may result in each half exceeding the recommended 1,200
registered electors for each district as provided for under 25 P.S. § 2702, the petitioners believe
and therefore aver, that good cause exists as that term is used under section 2702, to exceed this
recommendation. Many other voting precincts in Cumberland County, with voter registration
numbers like those being proposed, presently exceed 1,200 electors in their districts and do not
experience voter inconvenience and delay like that presently being experienced in the East
Pennsboro Lower Precinct.
14. For all the foregoing reasons, it is respectfully submitted that the East Pennsboro
Lower Precinct must be divided in order to accommodate the convenience of the electors and to
promote the public interest.
WHEREFORE, the Petitioners, through the undersigned counsel, respectfully pray that
this Honorable Court direct the County Board of Elections to investigate fully and promptly the
facts as alleged in this Petition and to report to this Honorable Court its findings and

serve the convenience of the electors and public interest.

Pursuant to a conference call with Robbie March, myself and Attorney
Stabile, enclosed please find a proposed Order, which I have prepared to set a
Hearing date and to extend the time which the Board of Elections has to file a
report in response to the Petition. The Board requested this extension of time, as
the Election Bureau staff will be busy with the primary at this particular time of
year. Attorney Stabile concurs in the extension of time and the setting of the
Hearing date.

REPORT OF THE
CUMBERLAND COUNTY BOARD OF ELECTIONS
The Board of Elections was directed pursuant to a Petition filed by residents of East
Pennsboro Township to make a full investigation of the facts presented in said Petition and to
report to the Court its findings and recommendations as to the division, redivision, alteration,
formation or consolidation of the election district prayed for by Petitioners.
The Board of Elections has determined that the election district known as East Pennsboro
Lower had a total registered electorate of 3,272 at the time of the November 2002 general
election.
The Board of Elections is aware that some voters of the East Pennsboro Lower precinct
have experienced delays during the voting process in primary and general elections including the
2002 primary and general elections.
The Board of Elections has determined that the convenience of the voting public in East
Pennsboro Township would be better served by the creation of an additional voting precinct with
a convenient polling place.
The Board of Elections recommends creating an additional election district in East
Pennsboro Township by splitting the current East Pennsboro Lower election district thereby
making the total number of voting precincts for East Pennsboro Township six.
The proposed new precincts shall be known as East Pennsboro Lower East and East
Pennsboro Lower West.
The newly created voting precincts will consist of the following registered voters:
East Pennsboro Lower East approximately 2,036
East Pennsboro Lower West approximately 1,236
The new boundaries of the proposed voting precincts are set forth in the attached Exhibit
"A" and as shown on the attached map marked as Exhibit "B".
The Board of Elections shall post the attached Notice, marked Exhibit "C" in at least five
conspicuous places in East Pennsboro Lower precinct, one of which shall be posted at the West
Creek Elementary School, 400 Erford Road, Camp Hill, PA, the current polling place for East
Pennsboro Lower as required by the Election Code, 25 P.S. 2704. In addition the Board of
Elections shall advertise said Notice in the Patriot News and The Sentinel newspapers.

Conodoguinet Creek. The Boroughs of Wormleysburg and Lemoyne define the Eastern
Border of the Precinct. The Routes 11 & 15 define the Southern Border. The Borough of
Camp Hill and the Conodoguinet Creek define the Western Border.

East Pennsboro, Lower East Precinct
The northern border of the East Permsboro Lower East Precinct is defined by the Conodoguinet
Creek. The Boroughs of Wormleysburg and Lemoyne define the eastern border of the Precinct.
The Routes 11 & 15 defines the soathern border. The Borough of Camp Hill and the
Conodoguinet Creek define the western border.
Number of registered electors for the November 2003 Municipal Election: 2,065
East Pennsboro, Lower West Precinct
The northern border of the East Pennsboro Lower West Precinct is defined by the Conodoguinet
Creek. The Conodoguinet Creek and the Borough of Camp Hill defines the eastern border of the
Precinct. The Township of Lower Allen defines the southern border. The Township of
Hampden and the Conodoguinet Creek defines the western border.

NOTICE
Notice is hereby given that a Petition praying for the creation of an additional election district in
East Pennsboro Township, Cumberland County pennsylvania has been presented to the Court of
Common Pleas, Civil Division, Cumberland County, peunsylvan[a, by residents of East
Permsboro Township, Cumberland County Permsylvania. East Permsboro Township, Lower
Precinct, has approximately 3,345 registered voters. The proposed dividing line between the two
precincts will be the Conodoguinet Creek. The Court has set the 29th day of July, 2004, at 11:00
a.m. at the Courthouse, Carlisle Pennsylvania, as the time and place for a hearing on said
Petition, at which time objects thereto will be heard and considered. Any person desiring to
object to the division of East Pennsboro Township, Lower Precinct must file his objections with
the Cumberland County Prothonotary prior to the date of the hearing. (Case No.: 2003-363

AND NOW, this /'/' day of July, 2004, the Cumberland County Board of
Elections having filed its report and recommendations in the above matter, IT IS HEREBY
ORDERED, ADJUDGED AND DECREED, pursuant to Sections 503 and 504 of the
Pennsylvania Election Code, 25 P.S. § 2703, 2704 that:
a. A hearing on the within petition shall be held at 11:00 a.m. on Thursday, July 29,
2004, in Courtroom Number 4; and
b. That the County Board of Elections shall, at least ten (10) days before said hearing,
post in at least five public and conspicuous places in East Pennsboro Lower Precinct, one of
which shall be posted in the polling place in East Pennsboro Lower Precinct, a notice containing
a brief description of the proposed division recommended by the Board, the date upon which this
matter will be considered by this Court and a warning that any persons objecting thereto must

the Petition to determine whether the division of East Pennsboro Lower Precinct into two
election districts should be approved. The Order of the Court is ss follows:
A. East Permsboro Lower election district shall be split thereby creating two new
election districts, as set forth in Exhibits A and B of the Revised Report of the Cumberland
County Board of Elections pursuant to this Petition, making the total number of voting precincts
for East Pennsboro Township six.
B. The newly created precincts shall be known as East Pennsboro Lower East and
East Pennsboro Lower West.
C. The polling places for the newly created precincts shall be as follows:
