TO: Wilma O. Hoover:
You have been sued in Court. If you wish to defend against
the claims set forth in the following pages, you must take prompt
action. You are warned that if you fail to do so, the case may
proceed without you and a decree of divorce or annulment may be
entered against you by the Court. A judgment may also be entered
against you for any other claim or relief requested in these
papers by the Plaintiff. You may lose money or property or other
rights important to you.
When the grounds for divorce is indignities or irretrievable
breakdown of the marriage, you may request marriage counseling.
A list of marriage counselors is available in the Office of the
Prothonotary, Cumberland County Courthouse, Carlisle, PA 17013.
If you do not file a claim for alimony, division of

You should take this paper to your lawyer at once. If you

Defendant, and respectfully represents:
COUNT I: DIVORCE
A. Section 3301(c) or 3301(d) of Divorce Code.
1. The Plaintiff is William K. Hoover, a competent adult
individual who currently resides at 10 Elm Street, Frederick
County, Thurmont, Maryland.
2. The Defendant is Wilma O. Hoover, a competent adult
individual who currently resides at 8 Ladnor Lane, Mt. Holly
Springs, Cumberland County, Pennsylvania 17065.
3. Plaintiff has been a bona fide resident of the State of
Maryland for at least six (6) months immediately previous to the
filing of this Complaint.
4. Plaintiff and Defendant were married on April 30, 1955
at Lock Bourne A.F. Base, Ohio, in accordance with the laws of
that state.

5. Plaintiff and Defendant are separated and have
vol untaril r lived apart since November 19, 1995.
6. There are three emancipated children of this marriage.

7. There have been no prior actions for divorce or
annulment with respect to this marriage in this or in any other
jurisdiction.
8. The marriage is irretrievably broken.
9.
Plaintiff has been advised that counseling is available

and the Plaintiff may have the right to request that the Court
require the parties to participate in counseling.
WHEREFORE, Plaintiff requests the Court to enter a decree of
divorce.

By order of Court of President Judge George E. Hoffer
dated April 13, 1999, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on January 7, 1998, r~ising
grounds for divorce of irretrievable breakdown of the marr~age.
No economic claims were raised in the complaint. The complaint
avers that the parties separated November 19, 1995.
On April 28, 1999, attorney McKnight, on behalf of the
Defendant, filed a petition for economic relief raising the
economic claims of equitable distribution, alimony, and counsel
fees and costs.
I am going to proceed on the assumption that grounds for
divorce are not an issue since the parties have been separated
for a period in excess of two years. If the parties will not
both agree to sign affidavits of consent, then I ask that one of
the attorneys file an affidavit under section 3301(d) averring
the date of separation in excess of two years.
Inasmuch as economic claims have now been raised by
petition for economic relief, I am directing each counsel in
accordance with P.R.C.P. 1920.33(b) to file a pre-trial
statement on or before Friday, May 28, 1999. Upon receipt of

Present for the Plaintiff, William K, Hoover, is
attorney Kevin G. Robinson, and present for the Defendant,
Wilma o. Hoover, is attorne~ Marcus A. McKnight, III.
A divorce complaint was filed on January 7, 1998,
ra~s~ng grounds for divorce of irretrievable breakdown of
the marriage. Although a 3301(d) affidavit was filed on
January 7, 1998, averring a separation in excess of two
years, counsel have indicated that the parties will sign and
file affidavits of consent and waivers of notice of
intention to request entry of divorce decree prior to the
hearing so that the divorce can be concluded under Section
3301(c)of the Domestic Relations Code.
The Defendant filed a petition on April 28, 1999,
ra~s~ng the economic claims of equitable distribution,
alimony, and counsel fees, costs and expenses. With
respect to the factor of marital misconduct as it relates to
the alimony claim, counsel for wife is going to prepare a
stipulation regarding husband's extra marital relationship
to see if the parties can stipulate to that relationship to
obviate the need for testimony on that issue. If the
stipulation cannot be worked out, then counsel should notify
the Master so that we can devote some part of the hearing
time to take testimony on the factor of marital misconduct.
Also counsel should provide each other with a list of
witnesses on that issue prior to the hearing.
Husband is 69 years of age and resides at 10 Elm
street, Thurmont, Maryland 21788 where he lives with a
female friend. He is a high school graduate and is
currently working part-time as a salesman selling Xerox and
other business supplies. He is also retired from the
military and IBM. His income is as follows:
Military retirement, $733.00 per month (gross);
IBM, $72.00 per month (net);

Social Security benefit, $760.00 per month.
Husband is paying wife spousal support in the amount of
$500.00 per month. He has no health problems affecting his
ability to engage in his daily activities; however, his
counsel indicated that he has been treating a rhythm problem
with his heart.
Wife is 69 years of age and resides at 8 Landor
Lane, Mt. Holly Springs, Pennsylvania, where she lives
alone. She is a high school graduate and has a real estate
license, which has not been active for some time. She
currently works part-time with the Salvation Army and has
reported her biweekly net income to be $179.62. She also
receives a social security benefit of $423.00 per month. In
addition, as previously noted, she is getting spousal
support from husband in the amount of $500.00 per month.
Wife has not raised any health issues.
Both parties are currently covered under Medicare
and other medical insurance. There has been a question
raised as to whether or not wife is entitled to any medical
insurance benefits through husband's military service and
counsel are going to make that appropriate inquiry to see if
any such insurance benefit is available.
Subsequent to the separation, the parties made
some transfer of real estate so that each would own a
property in his or her name individually. Wife received 8
Ladnor Lane, Mt. Holly Springs, Pennsylvania, which was
appraised by Steven Barrett on August 3, 1998, for
$83,000.00. Husband received the property at 10 Elm Street,
Thurmont, Maryland, which after reducing the market value by
the mortgage loan shows an equity at the time of transfer of
$19,000.00.
Neither of the parties are going to raise any
issues with respect to the value or disposition of vehicles
and household tangible personal property, each party to
retain the property presently in his or her possession free
of any claims of the either party.
Husband has reported an IRA on his pretrial
statement and claims that that is a nonmarital asset which
was purchased using funds from his mother's estate. Mr.
Robinson is going to provide Mr. McKnight data and
supporting documentation to show the tracing of those funds
from the mother's estate to the purchase of the IRA so that
we can determine if it is a marital or nonmarital asset.

The parties own 200 shares of IBM stock and as of
September 30, 1999, the value of the stock was $32,760.00.
Husband has been receiving dividends on that stock since
separation and he is directed to provide an accounting of
those dividends received.

The military pension and the IBM pension most
likely will be distributed using a Qualified Domestic
Relations Order. Husband has been receiving the benefit
from the pensions since separation; however, his counsel has
pointed that his client has been making payments by way of
spousal support to wife which have been funded primarily
from the pension benefits.

There has been a question about the life insurance
policies, if any, owned by either or both parties and Mr.
Robinson apparently has provided some preliminary
information but is going to give Mr. McKnight written data
showing the cash surrender value of any of the policies
which are currently in existence.

The parties have not reported that there are any
marital debts which need to be addressed.
A hearing is scheduled for Tuesday, May 9, 2000,
at 9:00 a.m. Notices will be sent to counsel and the
parties. The Master has advised counsel that when
discovery is complete and all documentation and valuations
have been provided, they should prepare a worksheet and if
they desire, request a conference with the parties and
counsel at the Master's office which can be scheduled very
quickly upon request, in an effort to try to resolve the
outstanding issues.

HISTORY:
The parties were married on 30th April 1955 at Lockbourne
AFB in ohio according to the laws of that state. They were
separated and have continued to live separate and apart since
November 1995.
For verification of date of separation see

Exhibi t "A" and attached hereto and incorporated herein.
There are no minor children as a result of this marriage.
ASSETS:
1.) A.) 140 shares of IBM stock owned by Plaintiff/Husband.
(Note: IBM stock is due to split at the end of May 1999 which
would increase the abovementioned shares to 2BO.)
B.) In 199B Husband sold 146 shares to of IBM stock (for
an explanation see 3.), Para. 4, below).
2.) Pennsylvania Property at B Ladnor Lane, Mt. Holly
Springs, Pennsylvania is owned currently by Defendant/Wife.
Approximate current value is Eighty Thousand Dollars
($BO,OOO), Approximate equity is Eighty Thousand Dollars
($BO ,000) .
3.) Maryland Property at 10 Elm street, Thurmont, Maryland is
owned currently as joint tenants, by Plaintiff/ Husband and
Dorthy J. Miller. Approximate current value is Ninety Three
Thousand ($93,000), approximate equity is Twenty Thousand
Dollars ($20,000).
N.B. HISTORY OF PENNSYLVANIA and MARYLAND PROPERTIES.
Plaintiff/Husband and Defendant/Wife bought home in
Pennsylvania in 1992, for Sixty Nine Thousand ($69,000) plus
improvements and is currently appraised at Eighty Thousand
Dollars ($BO,OOO);
Husband and Wife bought home in Maryland in 1995, Ninety
Three Thousand Dollars ($93,000); Thirteen Thousand Dollars
($13,000) down payment obtained by Home Equity Loan on
Pennsylvania House; Seller held mortgage for Eighty Thousand
Dollars ($BO,OOO);
On 3rd of February 199B, Plaintiff/Husband paid off Home
Equity Loan to Members 1st Federal Credit union in the amount
of Thirteen Thousand Dollars plus/minus ($13,000 +/-) via sale

On 21st of April 199B Maryland house was deeded to

THE MASTER:
Today is Tuesday, May 9, 2000.
This is tho dato sot for a Master's hearing in the above
captionod divorce.
Prosent in the hearing room are the
Plaintiff, William K. Hoover, and his counsel Kevin G.
Robinson, and tho Defendant, Wilma O. Hoover, and her

counsel Marcus A. McKnight, III.
This action was commenced by the filing of a
divorce complaint on January 7, 1998, raising grounds for
divorce of irretrievable breakdown of the marriage.
Counsel have provided the Master with signed affidavits of
consent and waivers of notice of intention to request entry
of divorce decree today. The Master will file the
affidavits and waivers with the Prothonotary so that the
divorce can be concluded under Section 3301(c) of the
Domestic Relations Code.
An affidavit under Section 3301(d) was filed
on January 7, 1998, averring a separation in excess of two
years; however, we will not proceed under that section of
the code but as noted will proceed with the filing of the
mutual affidavits of consents under Section 3301(c),
No economic claims were raised in the

divorce complaint; however, on April 28, 1999, the Defendant
wife filed a petition raising the claims of equitable
distribution, alimony, and counsel fees and expenses,
The Master has been advised that after
negotiations today the parties have reached a settlelnent
resolving the outstanding economic issues. An agreement is
going to be placed on the record in the presence of the
parties, The agreement as placed on the record will be
considered the substantive agreement of the parties not
sUbject to any changes or modifications except for
correction of typographical errors which may be made during
the transcription. After the agreement is placed on the
record, the parties and counsel wil1 be asked to return to
review the draft for typographical errors, make any
corrections as required, and then affix their signatures
affirming the terms of settlement as pI aced on the record.
It is specifically noted, however, that when the parties
leave the hearing room today they are bound by the terms of
the agreement even though they subsequently do not sign the
agreement.
The parties were married on April 3D, 1955,
and separated September 21, 1996. The parties are the
parents of three adult children.
After the agreement has been reviewed for
typographical errors and returned to the Master, the Master
will prepare an order vacating his appointment so that
counsel can file a praecipe transmitting the record to the
Court requesting the entry of a final decree in divorce.
Mr. McKnight.
MR. McKNIGHT: The parties have, after
extensive meeting and negotiations this morning, arrived at
the following settlement:
1. With regard to equitable distribution, it is agreed
that the Defendant wife wil1 waive all right, title and
interest in the real estate purchased at 10 Elm street,
Thurmont, Maryland, which is currently owned by the
Plaintiff husband and his girlfriend.
2. Plaintiff husband has agreed to waive all right, title
and interest he has in the real estate located at 8 Landor
Lane, Mt. Holly Spring, Cumberland County, Pennsylvania,

Plaintiff husband further indicates that all marital
has been refinanced into his name alone and he will
wife harmless from any claim thereon.
4. The parties have agreed that they have distributed
their personal property, each one will be keeping their own
furniture, any automobiles which they own currently and have
possession of, as well as their individual bank accounts.
Each party waives any right, title and interest in the
personal property or assets of the other.

5, There is, however, some IBM stock in the amount of at
least 280 shares, and the parties have agreed that 50% of
that IBM stock will be distributed in kind from the name of
William K. Hoover to the Defendant, Wilma O. Hoover, If at
all possible, the stock is not to be sold but simply
ownership of 50% of those shares, which we believe are at
least 282 or more shares currently will be distributed to
wife in her name alone and her social security number is
280-26-3646, Within 20 days the Plaintiff William K.
Hoover wil1 provide to counsel for the wife all information
required to make and complete that transfer including the
name and address of the place in which those requests should
be done and husband agrees to sign any documents he needs to

6. With regard to alimony, the parties agree for the entry
of an indefinite alimony award in the amount of $600.00 per
month and effective June 1, 2000, and that will continue
until the death of either party or the cohabitation or
remarriage of the Defendant Wilma O. Hoover. The alimony
payments will be sUbject to modification upon a showing by
either party of changed circumstances of a substantial and
continuing nature. The current circumstances of the parties
are that the Plaintiff husband is not working, he is
receiving his social security benefits! he is receiving
military benefits, and a small IBM pension. His total
income per month is around $1,600,00. Wife has a part-time
job. She receives about $418.00 in social security and she
receives the alimony award. Those are her circumstances.
The payment for alimony will be paid through the
Pennsylvania Domestic Relations System as it currently is
being paid.
7. The Defendant Wilma O. Hoover does expressly waive any
claim she has for counsel fees, costs or expenses.
8. Wife waives any and all interest in husband's IRA, IBM
retirement, and military retirement.
9. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.
MR. McKNIGHT: I am Marcus A. McKnight, III,
and I represent the Defendant Wife, Wilma O. Hoover, Wilma,
have you heard the terms of the settlement that we have
discussed this morning and that we have reached an agreement
about?

you?
MS, HOOVER: Yes.
MR. McKNIGHT: Are you satisfied with
representation of your counsel in this case?
MS. HOOVER: The only thing I don't like is
remarriage. I think that stinks.
MR. McKNIGHT: Well, that is the law about
alimony.
MS. HOOVER: I understand.
MR. McKNIGHT: But you are satisfied with the
provisions of the terms of the agreement?
MS. HOOVER: Yes.
MR. ROBINSON: For the record, Kevin Robinson
representing Wil1iam Hoover. Mr. Hoover, you've heard the
terms of settlement today. Do you understand those terms?
MR. HOOVER: I do.
MR. ROBINSON: Are they acceptable to you?
MR, HOOVER: Yes,
MR, ROBINSON: Do you have problems with the
representation of your counsel?
MR, HOOVER: No.
I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend
to bind myself to the settlement as a contract obligating
myself to the terms of settlement and sUbjecting myself to
the methods and procedures of enforcement which may be
imposed by law and in particular Section 3105 of the
Domestic Relations Code.
