WHEREAS, Homestead Trust No.5, Michael Cherewka, Trustee and Mid Penn Bank and
Caldwell Development, Inc., are about to execute contemporaneously herewith, a contract with B.R.
Kreider & Son, Inc., of Manheim, Pennsylvania, for certain site work upon Lot 4, Cumberland
Business Park, Upper Allen Township, Cumberland County, Pennsylvania, as more particularly
described in Exhibit" An.
NOW, December :3 /
. 1997, at the time of and immedialely before execution of the
principal contract, and before any authority has been given by the said Owners to B.R. Kreider &
Sons, Inc., to commence limited site work of a non-substantial nature for the same in consideration
of the making of the said contract and the further consideration of One Dollar to B.R. Kreider &
Sons, Inc., paid by Owners, it is agreed that no lien shall be filed against the land and/or
improvements by the contractor, or any sub-contractor, nor by any of the material men or workmen
or any other person for any labor. or materials or purchases, or exlra labor or materials purchased for
the limited site work, the right to file such liens being expressly waived.
