C., and respectfully avers as follows: PARTIES 1. plaintiff, Mark Isenberg is an adult individual residing at 216 Hill street, Mount Holly springs, Cumberland County, Pennsylvania. 2. Defendant, Ruby Tuesday, Inc., (hereinafter "Ruby Tuesday") is a corporation incorporated under the laws of Georgia which operates a chain of restaurants one of which is located at the Hampden Centre in Cumberland County, Pennsylvania. 3. Prior to April 2, 1996, Ruby Tuesday restaurants were owned by a series of corporations incorporated in various states. 4. On or about April 2, 1996 various Ruby Tuesday corporations merged into a single entity, Ruby Tuesday, Inc., incorporated under the laws of Georgia with a mailing address of 4721 Morrison Drive, Mobile, Alabama and a registered office at 100 Peachtree street, Atlanta, Fulton County, Georgia. FACTS 5. On March 25, 1996 at approximately 11:45 p.m. Mark Isenberg was dining at the Hampden Centre Ruby Tuesday restaurant, eating an entre consisting of mashed potatoes, chicken, and shredded onions. 6. Employees of Ruby Tuesday had prepared the meal which Mark Isenberg was eating on the evening of March 25, 1996. 7. As Mark ISenberg placed a bite food into his mouth and began to chew, he bit into a sharp stone--about 1/4 inch in diameter--which had been within the shredded onions. 8. Mark Isenberg did not observe the stone until he bit into the stone. 9. Mark Isenberg's meal was adulterated by the presence of the stone, a foreign object, located in the onions. COUNT I - NEGLIGENCE 10. At all relevant times, Ruby Tuesday employees had a duty of care to insure that no adulterated food was served to Ruby Tuesday diners such as Mark Isenberg. 11. At all relevant times, Ruby Tuesday employees had a duty of care not to serve adulterated food to Mark Isenberg. 12. Ruby Tuesday employees breached their duty of care to Mark Isenberg on March 25, 1996 by serving to him a meal containing a stone. 2 13. At all relevant times while preparing and serving the moal to Mark Isenberg, the Ruby Tuesday employees wore acting within the scope of their duties as employees of Ruby Tuesday. 14. As a direct and proximate result of the negligence of Ruby Tuesday employees, Mark Isenberg has suffered the following injuries: a. A broken tooth; b. Headaches; and c. Temporomandibular joint disorder. 15. As a direct and proximate result of the negligence of Ruby Tuesday employees, Mark Isenberg has undergone in the past and will continue to undergo in the future great pain and suffering. 16. As a direct and proximate result of the negligence of Ruby Tuesday employees, Mark Isenberg has expended in the past and is likely to expend in the future sums of money for medical expenses. 17. As a direct and proximate result of the negligence of Ruby Tuesday employees, Mark Isenberg has undergone surgery for the temporomandibular joint disorder. 18. As a result of the surgery made necessary by the negligence of Ruby Tuesday employees, Mark Isenberg currently has developed a lump on the right side of his head which he believes and therefore avers is permanent in nature. 3 19. As a direct and proximate result of the negligence of Ruby Tuesday employees, Mark Isenberg has suffered a pormanont diminution of his ability to enjoy life and life's pleasures. 20. The Plaintiff, Mark Isenberg, has been advised and therefore avers that the temporomandibular joint disorder from which he suffers is permanent in nature. 21. As a direct and proximate result of the negligence of Ruby Tuesday employees, Mark Isenberg may suffer in the future loss of wages and/or a loss of earning capacity due to the permanence of his injuries. 22. The Defendant, Ruby Tuesday, Inc., is vicariously liable for the negligence of its employees while acting within the scope of their employment. 23. Ruby Tuesday, Inc., the survivor corporation after the April 1996 merger, is liable for the torts of its predecessor corporations as a successor or survivor corporation. WHEREFORE, the Plaintiff, MARK ISENBERG, demands jUdgment against the Defendant, RUBY TUESDAY, INC., in an amount in excess of the amount required for compulsory arbitration, together with interest and costs. i 4 <"i ~j."l ~ >, ~. COUNT II - IMPLImD WARRANTY 24. Paragraphs 1 - 23 of this complaint are incorporated within this Count by reference. 25. According to 13 Pa. C.S. S 2104 (Definitions), a "merchant" is a person who deals in goods of the kind. 26. On March 25, 1996, Ruby Tuesday, Inc., dealt in and continues to deal in the serving for value food products for immediate consumption. 27. On March 25, 1996, Ruby Tuesday, Inc., was a "merchant" for purposes of applying the Pennsylvania Commercial Code. 28. Title 13 Pa.C.S. S 2314 of the Pennsylvania commercial Code states: 2314. Implied warranty; merchantability; usage of trade (a) Sale by merchant.--Unless excluded or modified (section 2316), a warranty that the goods shall be merchantable is implied in a contract for their sale if the seller is a merchant with respect to goods of that kind. Under this section the serving tor value of food or drink to be consumed either on the premises or elsewhere is a sale. (b) Merchantability standards for goods. --Goods to be merchantable must be at least such as: (1) pass without objection in the trade under the contract description; (2) in the case of fungible goods, are of fair average quality within the description; (3) are fit for the ordinary purposes for which such goods are used; (4) run, within the agreement, of even within each unit and variations permitted by the kind, quality and quantity among all units involved; 5 (5) are adequately contained, packaged, and labeled as the agroement may require; and (6) conform to the promises or affirmations of fact made on the container or label if any. (c) Course of dealing or usage of trade.--Unless excluded or modified (section 2316) other implied warranties may arise from course of dealing or usage of trade. (Emphasis supplied). 29. Ruby Tuesday, Inc., served for value to Mark Isenberg on March 25, 1996 a dinner which was to be consumed on the premises of the Ruby Tuesday restaurant. 30. The serving for value of the above-described dinner was a "sale" pursuant to 13 Pa.C.S. S 2314. 31. The 13 Pa.C.S. S 2314 sale was entered into between Ruby Tuesday, Inc., and Mark Isenberg on March 25, 1996. 32. According to 13 Pa. C.S. S 2314, Ruby Tuesday, Inc., automatically warranted that the food it served and sold to Mark Isenberg was fit for its ordinary purpose, immediate consumption. 33. Pursuant to 13 Pa.C.S. ~ 2314 of Pennsylvania's Commercial Code, Ruby Tuesday, Inc., had a duty of care to serve Mark Isenberg food which was fit for human consumption on March 25, 1996. 34. Ruby Tuesday, Inc., breached the implied warranty of merchantability by serving to Mark Isenberg a meal containing a foreign object which caused the injuries described above. 6 35. The presence of the foreign object, a stone, in the onions of the meal caused the food served to Mark Isenberg on March 25, 1996 to be unfit for human consumption. 36. The breach of warranty by Ruby Tuesday, Inc., was the actual and proximate cause of Mark Isenberg'S injuries described above in Count I. WHEREFORE, the plaintiff, MARK ISENBERG, demands judgment against the Defendant, RUBY TUESDAY, INC., in an amount in excess of the amount required for compulsory arbitration, together with interest and costs. RUBY TUESDAY, INC., Defendant . JURY TRIAL DEMANDED PLAINTIFFS' PRE-TRIAL MEMORANDUM X. BASIC PACTS AS TO LIABILITY This is a case of strict products liability and negligence based on Plaintiff's injuries suffered as a result of eating adulterated food at the Defendant's restaurant. Plaintif.f, Mark Isenberg, and a friend, Pietro Leone, went to Ruby Tuesday'S restaurant located in the Hampden Center in Camp Hill, Pennsylvania, at about 11:00 p.m. on Monday, March 25, 1996. The restaurant is owned by the Defendant, Ruby Tuesday, Inc. Plaintiff and Mr. Leone ordered beverages and an appetizer. After the appetizer, the men ordered entrees. The Plaintiff ordered Ruby Tuesday's Ranchero Chicken Dinner which consists of chicken, mashed potatoes, and onions which are shredded, breaded, and fried (known as "Tumbleweed Onion Straws"). Plaintiff, Mark Isenberg was injured when he bit into a stone which was located in the Tumbleweed Onion straws that he had been served to Plaintiff by the Ruby Tuesday, Inc., wait staff. IX. BASIC FACTS AS TO DAMAGES. Plaintiff suffered a fractured molar which was repaired by Robert F. Cosgriff, D.D.S., M.A.G.D. Plaintiff also has been diagnosed with bilateral temporomandibular joint derangement, with primarily right-sided jaw problems, by Michael T. Reedy, D.D.S. Plaintiff has undergone arthroscopic surgery on the right ~ temporomandibular joint. Plaintiff's total medical bills to date are $10,753.39. Additional surgery, arthroplasty with meniscectomy, is believed necessary and had an estimated cost in 1996 of between $14,500.00 and $20,250.00. The Plaintiff is required to wear a mandibular anterior decompressive splint, has undergone physical therapy, and eventually is likely to require total right temporomandibular joint replacement surgery which has an estimated cost in 1996 of between $15,625.00 and $23,125.00. Joint replacement surgery would also require the expense of a prosthetic joint which was estimated by Dr. Reedy to cost between $5,000.00 and $8,000.00 in 1996. If Plaintiff is required to undergo both surgeries in the future, Plaintiff's will incur a minimum of $35,125.00 in additional medical expenses. Currently, the Plaintiff's jaw locks, he suffers severe headaches and jaw pain, and cannot eat hard foods without pain and problems, and continues to wear the orthotic splint at night. Plaintiff's injury-related headaches occasionally cause him to miss work and Plaintiff has suffered small wage losses as a result. III. PRINCIPAL ISSUES OF LIABILITY AND DAMAGES. Plaintiff was a business invitee of Ruby Tuesday, Inc., at the time of his injury as he entered the Ruby Tuesday restaurant as a customer and was seated and served in normal fashion. There is no direct evidence of when, where, or how the stone got into the breaded onion straws. Plaintiff's counsel is in possession of the stone and will present it as an exhibit at trial. Pietro 2 . Leone will testify that he saw Mark Isenberg take the stone out of his mouth after attempting to eat the Ranchero Chicken Dinner. Plaintiff has alleged two theories of liability in this case, negligence and strict liability. The strict liability theory is encompassed in Plaintiff's implied warranty of m:;rChantability alle9ations within the comPlaint.~;laintiff intends to proceed at trial on the theory of strict liability. Under the theory of strict liability, evidence of due care by Ruby Tuesday, Inc., or its employees is irrelevant. Additionally under the theory of implied warranty/strict liability the Plaintiff is entitled to all damages which stem from the Defendant's breach of warranty, inclUding his medical expenses, pain and SUffering, and other damages. Defendant has not denied that Plaintiff bit into a stone that was located in Tumbleweed Onion straws at the subject Ruby Tuesday restaurant. The Defendant's manager-on-duty, Cathy Guyer, who investigated the incident has no recollection of the events of March 25, 1996. Witness Pete Leone will testify that he heard the "crack" when Mark Isenberg bit the stone and saw the stone immediately afterward. The Defendant's theory regarding damages is that a person cannot suffer bilateral temporomandibular joint derangement as the result of biting into a hard object on only one side of the jaw, according to the expert witness report of John R. Should this Court rule that plaintiff may not collect all consequential damages under the theory of breach of implied warranty, then Plaintiff will seek leave to amend the Complaint to include a claim of strict liability. I feel your letter is accurate in outlining our discussions concerning Mr. Isenberg's injury and treatment. As you are aware, Mr. Isenberg sustained an injury while dining at Ruby Tuesday's, resulting in internal derangement of the right temporomandibular joint. Prior to this incident, the patient had had no history of temporomandibular joint disorder, and it is clear from his discussion of the events that the injury of the right temporomandibular joint resulted from heavy occlusal forces against a foreign object while masticating. The internal derangement of the right temporomandibular joint with anterior dislocation of the meniscus has been confirmed, both clinically and by magnetic resonance imaging. As a result of this injury, Mark's ability to have normal jaw functions has been severely limited, and has resulted in chronic pain of the joint, headaches, limited ability to open, along with a severe, loud, early reciprotory click of the right temporomandibular joint. He was started immediately on a conservative treatment plan consisting of a mandibular anterior decompression splint and anti-inflammatory medication. The patient has, in the interim, developed two episodes of open locking of the right temporomandibular joint. His conservative therapy was then supplemented with muscle relaxers during this period. Mr. Isenberg's pain and cracking of the joint has continued to increase, and it had been decided, at that time, to perform arthroscopic surgery with lysis and lavage of the right temporomandibular joint. Following the arthroscopic surgery, he has only had one episode of locking, which cccurred on June 2nd in a closed lock position. He has since been started on physical therapy, and I have enclosed a copy of the physical therapist's report for your records. I have recommended that Mr. Isenberg consider biofeedback and relaxation techniques. He continues to wear the mandibular decompression splint. Mark I..Db.rq paq. a I feel that Mark could benefit from arthrocentesis of the right temporomandibular joint, consisting of debridement and flushing of the joint, and placement of a lubricating agent. Hark is aware that his prognosis is poor and that it will probably be necessary in the future to perform open joint surgery. However, Mark is aware that it may not be possible to repair the dislocated meniscus, therefore requiring a meniscectomy and arthroplasty of the right temporomandibular joint. In view of the current status regarding alloplastic materials, we are limited in the replacement of the meniscus, and therefore, open joint surgery would be recommended only if Mark'S temporomandibular joint disorder continues to degenerate to the point where he can no longer tolerate the pain and dysfunction. It is not uncommon for temporomandibular joint patients to undergo multiple surgical procedures, with final surgery consisting of joint replacement. If arthroplasty with meniscectomy is necessary for Mark, I would anticipate that the cost for the surgical professional services would be approximately $3600 to $4200 for the primary surgeon, plus surgical assistant fees of 25%. Obviously, this does not include the cost of hospitalization, which would be between $10,000 to $15,000 for a 2-3 day hospital stay, plus anesthesia costs. If a total joint replacement would become necessary, then the cost for the surgery would be between $4500 and $6500 for the primary surgeon, plUS 25% for surgical assistant's fees. The hospital stay would require additional days, and the cost for the prosthesis would be between $5,000 and $8,000, depending upon whether or not this is a partial or total joint replacement. I have discussed with Mark that he cannot look upon open joint surgery as only a one-time procedure, but that there may be as many as three or more surgeries of this type over the course of this disability. In closing, as you can see, the future for Mark's temporomandibular joint disability is poor, at best, and he can only look at this as a permanent disability, which will require changes in his lifestyle and learning to live with this disability. I have enclosed copies of the patient's medical records dated after April 17, 1996, along with a copy of his present billing status with our practice. The patient, while eating at a local restaurant, bit down on a hard object resulting in severe pain to the right temporomandibular joint area. He was seen in the office on April 3rd, as a result of this injury. Auscultation of the right temporomandibular joint revealed a severe loud early reciperatory click, with deviation of the mandible to the let side upon opening. The patient was experiencing severe pain of the right temporomandibular joint radiating into the temporal area. Jaw function measurements at that time revealed a maximal incisal opening of 45mm, right lateral 12mm, left lateral 10mm, with a protrusive of 4mm. Both lateral tomography and magnetic resonance imaging was ordered to evaluate the temporomandibular joint. I have enclosed a copy of the MRI report which supports a bilateral internal derangement of the temporomandibular joint with anterior dislocation of the meniscus. On April 8th I constructed a mandibular anterior decompression splint. The patient is presently wearing this orthopedic appliance to relieve the pressure from the temporomandibular joint. He is being followed on a weekly basis in this acute trauma period. Depending upon the patient's response to the conservative therapy, it mayor may not be necessary to either perform arthroscopic surgery or possible open joint surgery in the future. There is minor anterior hypertrophic bony change at the left mandibular condyle. With the jaw closed, there is anterior meniscal dislocation bilaterally. The posterior margin of the right meniscus is located at 9:00-10:00 and the posterior margin of the left meniscus is located at 9:00- 9:00. The left meniscus is smaller than the right and there is medial displacement of both menisci. CLINICAL HISTORY: PREVIOUS STUDIES: MRI PULSE SEQUENCES: With jaw opening, there is normal anterior motion of the mandibular condyle on the temporal eminence bilaterally. The left meniscus remains dislocated anterior to the mandibular condyle and partly folded. The meniscus is somewhat difficult to visualize on the right but there is prObable reduction in the sagittal plane. CONCLUSION: Anterior and medial meniscal dislocation bilaterally. There is no reduction on the left with jaw opening and the meniscus remains folded anterior to the mandibular condyle. There is reduction in the sagittal plane on the right with jaw opening.
