COMPLAINT
1. The plaintiffs, John 1'. Descours and Maria 0, Descours, are adult
individuals residing at 523 Appalachian Ave., Mechanicsburg, CUlllberland
County, Pa, 17055-5506.
2, The defendant, Cleve H, Hostetter, is an individual residing at 30
Front St., New Buffalo, Perry County, Pa.
3. On April 30, 1996, the plaintiffs were the owners of their hOllle
localed at 523 Appalachian Ave., Mechanicsburg, Cumberland County, PA
17055-5506,
4. On April 30, 1996, the plaintiffs entered into a written agreement
with the defendant, Cleve H, Hostetler, to remove and install windows in
their home at a conlract price of $4,400, Said agreement is attached hereto as
Exhibit A.
5, The agreement specifically requested a down payment be paid for
the windows to be ordered, and the said down payment of $2,200 was paid to
the defendant on April 30, 1996, The defendant made an additional request to
the plaintiffs for an additional $500,00, which was paid on August 16, 1996, for
a total down payment of $2,700.00,
6, The attached agreement specifically stated that the work would be
completed as soon as the windows were received by the defendant,
7. Despite numerous requests from the plaintiffs, the windows have
never been installed, nor has any payment been returned to the plaintiffs.
8, In order to finance the window replacement in their home, the
plaintiffs obtained financing from Fulton Bank, which required an interest
amount of 7,9%. A copy of the Truth and Lending statement is attached
hereto as Exhibit B,
9, As a result of the defendant's failure to complete the said window
replacement or return the amount paid by the plaintiffs, the plaintiffs have
sustained a loss of $2,700.00 plus interest calculated at 7,9%, plus any
attorney's fees, and costs of suit, which were necessary to collect the said
amount,
