between Lee C. Armstrong and Michele E. Armstrong, Husband and Wife, (hereinafter referred to as
"Condemnees") and the Township of East Pennsboro, Cumberland County, Pennsylvania (hereinafter
referred to as "Condemnor"):
WIT N E SSE T H:
WHEREAS, on September 4, 1997, the Condemnor and Condemnees entcred into an Agreement
of Sale in Lieu of Condemnation concerning a portion of their propcrty located at 315 Center Street,
Enola, Cumberland County, Pennsylvania in which the parties agreed to a sale price of Four Thousand
Five Hundred Dollars ($4,500.00) and Condemnces agreed to convey title to said property free and clear
of all encumbrances, mortgages, and liens;
WHEREAS despite the good faith efforts on the part of the Condemnees, Condemnees were
unable to convey the said parcel free and clear of encumbrances to title and therefore, on January 9,
1998, lhe Condemnor filed a Declaration of Taking in this matter concerning a portion of the
Condemnee's property as annotated therein and referred to in the Plan as Parcel No. 24, Stations 185 to
186; and

WHEREAS, by said condcmnation thc Condcmnor acquircd title in fce simple in said propcrty
for highway purposes as shown on the plot plan allached to the Declaration of Taking which is
incorporated and made a part hereof; and
WHEREAS, the parties hereby agree to abide by the agreed sale price of Four Thousand Five
Hundred Dollars ($4,500.00) as the just compensation for the property identified in the said Agreement
of Sale and the declaration of taking; and
WHEREAS, the said just compensation of Four Thousand Five Hundred Dollars ($4,500.00) has
been deposited on account with the Prothonotary of Cumberland County and awaits confinnation of
distribution to Condemnees, mortgage holder and/or lien holders and which said just compensation
represents the amount of just compensation in this mailer pursuant to Section 407, 521 and/or 522 of the
Pennsylvania Eminent Domain Code, 26 Pa. C.S.A. Sections 1-407, 1-521 and/or 1-522; and
WHEREAS, the parties agreement as to the total compensation due to the Condemnee per this
Eminent Domain action is Four Thousand Five Hundred Dollars ($4,500.00) which represents full
satisfaction of all monies, damages, fees claimed under the Pennsylvania Eminent Domain Code, Act of
June 22,1964, P.L. 84, as amended, (26 Pa. C.S. Sections 1-101, et seq, as amended); and
WHEREAS, constrUction has not commenced upon Condemnees' property concerning the
relocation of Center Street and there are no delay damages due or owing the Condemnees;
NOW, THEREFORE, in that it is stipulated and agreed that in consideration of the total sum of
Four Thousand Five Hundred Dollars ($4,500.00) which the Condemnor agrees to pay the Condemnees,
or to those mortgage or lien holders entitled to said funds or portions thereof, who does hereby remise,
release, quitclaim and forever discbarge the Condemnor or its assignees or its or their employees or
representatives of and from all suits, damages, claims, fees and demands which the Condemnees might
otherwise have been entitle to assert under the provision of the Pennsylvania Eminent Domain Code,

ALLOCATE THE JUST COMPENSATION OF PROCEEDS DERIVED
FROM THE ABOVE-REFERENCED EMINENT DOMAIN PROCEEDINGS
AND NOW, this 25th day of August, 1998, comes the
Pennsylvania Department of Revenue, through its Office of Chief
Counsel, and its Assistant Counsel, Nicholas J. Lamberti,
(hereinafter "Department"), and petitions this Honorable Court to
allocate the $4,000.00 in just compensation proceeds it has
received as custodian from the condemnor, East pennsboro
Township, in regards to the above-referenced condemnation
proceeding, as follows:
(1) First National Bank of Marysvil1e $1,500.00
(2) Pennsylvania Department of Revenue $1,250.00
(3) East Pennsboro Township $ 250.00
(4) East pennsboro School District $ 250.00
(Delinquent Taxes)

1. Based on a review of the subject real estate parcel's
title/lien report and the priorities and amounts of the
liens/judgment listed on the title search for the parcel and
applying this information to the partial taking condemnation
statutory language found at Title 26 Pa. C.S.A. ~~1-521, it is
the Department's position that its proposed allocation is
correct.
2. To the extent the condemnees, the condemnor, or any of
the lien/judgment creditors believe that an alternate allocation
of the just compensation proceeds should be made, they are
requested to file an Objection to this petition and submit their
alternate distribution schedule to this Court, along with their
legal basis, for its review and approval.
WHEREFORE, the Department respectfully requests this
Honorable Court to allocate the $4,000.00 in just compensation
proceeds derived from this condemnation proceeding based upon the

allocation schedule referenced above.

CONDEMNOR'S PETITION FOR DEPOSIT OF ADDITIONAL JUST COMPENSATION
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW COMES, the Condemnor, the Township of East Pennsboro, by and through its
attorney, Henry F. Coyne, and avers the following in support of this Petition for Deposit of Additional
Just Compensation.
1. On September 4, 1997, the Township and Mr, and Mrs, Lee C, Armstrong, the
Condemnees, entered into an Agreement of Sale concerning the required property for the relocation of
Center Street and agreed to the total compensation of Four Thousand Five Hundred Dollars ($4,500.00),
A copy of the Agreement is attached hereto as Exhibit "A".
2, Although Mr. and Mrs, Armstrong executed the Agreement of Sale and clearly desired to
abide by that Agreement wherein they would convey the designated property free and clear of all liens
and the Township would pay the Armstrongs $4,500.00, the Condemnees were unable to convey clear
title due to numerous mortgages, judgments, and liens of record and the Township of East Pennsboro

was left with no other recourse but to commence a condemnation action against Mr. and Mrs, Armstrong

in order to timely acquire title in said property.
3. On January 9, 1998, a Declaration of Taking was filed in the above-captioned term and
number by the Township of East Pennsboro.

1. PUMISES: The Seller agrees to sell and convey to the Buyer who agrees to
purchase the premises in East PCIII1Sboro Township, Cumberland Co\D1ty reflected on Center
Street Construction Project which is attached hereto arid incorporated herein by reference as
Exhibit "A". 'Ibis acquisition is in lieu of condemnation.
2. PURCHASE PRICE: The Buyer agrees to pay for the said property the sum of
Four Thousand Five Hundred and 00/100 Dollars
($ 4,500.00 ).
3. SETfLEMENT: Settlement will be held within ninety (90) days of this
Agreement and settlement will be hr.ld at a location and time selected by the Buyer.
4. ENC1JMBRANCES: The premises arc to be conveyed clear of all mortgages,
judgments. liens, and encumbrances. The premises m:e to be conveyed clear of all easements
except those appearing of record and visible on the premises.
5. POSSESSION: Possession will be given on the date of settlement.
6. APPORTIONMENT: Real estate taxes will be apportioned as of the date of
settlement, if applicable.
7. REAL ESTATE TRANSFER TAXES: Real Estate Transfer Taxes, if
applicable, wi1\ be paid and shared equa1\y by Seller and Buyer,

TITLE: The title is to be conveyed in fee simple and to be good and

martketable and such quality as will be insured by any reputable title insurance company at

PETITION TO DEPOSIT ESTIMATED JUST COMPENSATION
TO THE HONORABLE, THE JUDGES OF SAID COURT:

AND NOW comes the Township of East Pennsboro, the Condemnor, in this matter, and avers
the following in support of this Petition to Deposit Estimated Just Compensation:
1. On January 9, 1998, a Declaration of Taking was filed to the above-captioned tenn and
number by the Township of East Pennsboro.
2.
The Township has offered Mr, and Mrs, Annstrong, the Condemnees, the full amount of

the Township's estimated just compensation; however, the Condemnees have refused the estimated just
compensation because they cannot convey clear title due to numerous mortgages, judgments, and liens of

record,
3, A draft in the total amount of just compensation due the Condemnees, as estimated by
the Township made payable to the Prothonotary of this Court is attached hereto, (Check No, 2207911 in
the amount of $3,200,00)
4, The Condemnees' property is currently encumbered as noted in the title abstract attached
hereto as exhibit "A".
WHEREFORE, in order to assure possession of the Condemnees property, if required, by your
Petitioner to which it is entitlcd under Section 407 of the Eminent Domain Code, 26 Pa. C,S,A. Section
1-407, your Petitioner prays that your Honorable Court direct payment of the aforesaid estimated just
compensation to be held until further Order of Court directing payment of said amount to the said
Condemnees and/or person(s) entitled thereto pursuant to Sections 407,521 and/or 522, of the Eminent
Domain Code, 26 Pa, C,S,A, Sections 1-407, 1-521 and/or 1-522, as they may apply.

DECLARATION OF TAKING
TO TIlE HONORABLE, TIIE JUDGES OF SAID COURT:
The Township of East Pennsboro, a municipal corporation within the County of
Cumberland, organized under the laws of the Commonwealth of Pennsylvania, files this
Declaration of Taking and specifically declarcs as follows:
I. The Condemnor is the Township of East Pennsboro, a Township of the First
Class, whose office and principal place of business is located at 98 South Enola Drive, Enola,
Township of East Pennsboro, Cumberland County, Pennsylvania,
2, This Declaration is filed pursuant to authority of Section 190 I of the First Class
Township Code, Act of June 24,1931, P.L. 1206 (53 P.S, 56901),
3. This Declaration is made by virtue of a Resolution duly authorizing the taking
adopted by the Board of Commissioners of the said Township at a meeting held on the 27th day
of August, 1997, as will appear by reference to the minutes of said meeting filed at the aforesaid
office of the said Township, where the record of the adoption of the Resolution may be
examined. (See Exhibit "A")

4, The purpose of the condemnation and this Declaration of Taking li\ed incident
thereto is to secure property for the Township of East Pennsboro, which property is nceded for
the completion and relocation of Center Street Relocation Project.
S. Attached hereto as Exhibit "B" and made a part hereof, is a plan of the necessary
land to be procured for the completion of the Center Street Relocation Project. The properties on
which the said partial taking is located are situate within the Township of East Pel1nsboro,
Cumberland County, Pennsylvania; and copies of the aforesaid plan is, as of the date hereof,
being filed in the Office of the Recorder of Deeds, Cumberland County, Pennsylvania, in
accordance with Section 404 of the Eminent Domain Code, Act of June 22, 1964, (Special
Session), P.L. 84, Article IV; as amended,
6, The nature of the title acquired is fee simple as to the partial taking, across and
through the property described for the purpose of constructing. erecting and maintaining the
aforesaid Center Street Relocation Project.
7. A plan describing the lands whereby condemned is available and may be
inspected at the office of the Township, 98, South Enola Drive, Enola, Township of East
ÿPennsboro, Cumberland County, Pennsylvania,

8, Just compensation of the condemnation of said premises is secured by the power
of taxation of the Township of East Pennsboro, whereupon the funds raised, or lawful to be
raised, ore deemed pledged and mode security for the payment of damages os sholl be
determined by low.
WHEREFORE, fee simple title is hereby condemned in part from the above-identified
property owned by Lee C. Armstrong and Michele E, Armstrong, his wife,

proj ect.
Mr. Gill re:;:c:ted that on }'-uqust 12 he received a phone call
from E'ennDOT for a s'tatus report with the right-of-way takinqs
anc how it was proceeding. PennDOT is required, by the first
week of Septembe:, to file a form callec. with t.~e Fec.e:al
government which allocates IIIo:c.ey for COI'.struction pll..,"?oses of the
Feceral funded p:ojects, of which Cente::- street is one. 11. for:
a.lso is being file::' for the OVer-.riew Bricge project tho.::
qua.rantees and sets aside the construction money unde: the
Feceral rules anc. :equlations. It must be done, accor::i!lg' to
PeI".nDOT, in the fi:st week of septembe::: i!l order to ~.!a..-antee
tr..ese funds for the ~ext: construction year.
We reassessed our evaluation of property owners that have
either full taki:.g's or partial takings with regard to the Center
Street relocation. We got letters out to the propertv c;,ners
outlining a revised offer trying to settle with them: !:. that
letter it was st!!::ed the tOWD:lhip is unc.e::: the deadli:lB of August
31 and if we did not receive at least a verbal co=1t:le.."1t, that
we would have to file declarations of taking because the township
must guarantee wl:e.'1 Per.nDOT submits, to the Federal qove=ent the
right-of-way for Center Street relocation.
