V. BEITZEL, of809 Yvcrdon Drivc, Camp Hill, Cumberland, County, Pcnnsylvania,
17011 (hereinafter "WIFE") and DONALD C. BEITZEL, of Eeumcnical Community,
Ine" Building #1, 68A, 624 Wilhelm Road, Harrisburg, Dauphin County, Pennsylvania,
17111 (hereinafter "HUSBAND");
WITNE S SETH:
WHEREAS, the parties hereto were married on March 10, 1963, in Harrisburg,
Pennsylvania; and

1. ADVICE OF COUNSEL.
'fhe provisions of this ngreell1ent nnd their legnl eITect hnve been fully
explnined to the pnrties by their respective counsel. WIFE is represented by Debl'U
Denison Cantor, Esquire, HUSBAND is represented by Lawrence J, Neary, Esquire,
The parties acknowledge that each has reeeived independent legal advice from counsel
of their selection and that they have been fully informed as to their legal rights and
obligations, including all rights available to them under the Pennsylvania Divorce
Code of 1980 and other applicable laws.
The parties further declare that eaeh is executing the Agreement freely
and voluntarily having obtained sufficient knowledge and disclosure of their respective
legal rights and obligations, The parties each acknowledge that this Agreement is fair
and equitable and is not the result of any fraud, coercion, duress, undue influence or
collusion.
2. DIVORCE ACTION.
An action seeking the dissolution of the marriage is pending in the
Cumberland County Court of Common Pleas and bears docket number 98-119 CML.
The parties hereby acknowledge that the marriage is irretrievably broken and agree
to execute Affidavits of Consent for divorce and Waivers of Notice of Intention to
Request Entry of a Divorce Deeree upon completion of the ninety-day waiting period
or the finalization of this Agreement, The parties aeknowledge the availability of

counseling IInd both pllrlies hllve wllived their right to counseling. 'I'he terms of this
AbTJ"eement shllll be incorporllted into IIny divorce decree, but shllll not be merged with
the divorce decree,
3, SEPARATION AND NONINTERFERENCE.
WIFE and HUSBAND may and shall, at all times hereafter, live separate
and apart. They shall be free from any interference, direct or indirect, by the other in
all respects as fully as if they were unrnarried. Eaeh may, for his or her separate use
or benefit, conduet, carryon and engage in any business, occupation, profession or
employment whieh to him or her may seem advisable. WIFE and HUSBAND shall not
harass, disturb or malign eaeh other or the respeetive families of eaeh other.
4. DATE OF EXECUTION.
The "date of exeeution" or "execution date" of this Agreement shall be
defined as the date upon which it is exeeuted by the parties if they have each executed
the Agreement on the same date. Otherwise, the "date of execution" or "execution
date" of this Agreement shall be defined as the date of execution by the party last
executing this Agreement.

G, M:U1'UAL RELEASES.
Each party absolutely and unconditionally releases the other and the
estate of the other from any and all rights and obligations which either may have for
past, present, or future obligations, arising out of the marital relationship or otherwise,
including all rights and benefits under the Pennsylvania Divorce Code of 1980, and
amendments except as deseribed herein.
Each party absolutely and unconditionally releases the other and his or
her heirs, executors and estate from any claims arising by virtue of the marital
relationship of the parties. The above release shall be effective whether such claims
arise by way of widow's or widower's rights, family exemption, or under the intestate
laws, or the right to take against the spouse's will, or the right to treat a lifetime
eonveyance by the other as testamentary, or all other rights of a surviving spouse to
participate in a deceased spouse's estate, whether arising under the laws of
Pennsylvania, any state, Commonwealth, or territory of the United States, or any other
country,
Exeept for any eause of action for divorce which either party may have or
claim to have, eaeh party gives to the other by the execution of this Agreement an
absolute and unconditional release from all claims whatsoever, in law or in equity
which either party now has against the other.

6. WARRANTY OF D1SCLOSUUE.
Elich pllrty hereby confirms thllt he or she fully undel'stnnds the terms,
conditions and provisions hereof and believes slime to be fair, just, adequllte IInd
reasonable under the existing facts and circumstances. The parties lIeknowledge their
respective rights pursuant to the Pennsylvania Divorce Code of 1980 to obtain formal
valuations and appraisals and to engage in formal discovery, including interrogatories.
The parties have determined that they will not undertake this expense and rely on the
disclosures thus given.
7. OTHER DOCUMENTATION.
Within ten (10) days after demand therefore, the parties will execute any
and all written instruments, assignments, releases, satisfaetions, deeds, notes or such
other writings as may be reasonable, necessary or desirable for the proper effectuation
of this Agreement.
8. NO WAIVER OF DEFAULT.
This Agreement shall remain in full force and effect unless terminated
under the terms of this Agreement. The failure of either party to insist upon strict
performance of any ofthe provisions of this Agreement shall in no way affect the right
of sueh party thereafter to enforce the same, nor shall the waiver of any breach of any
provision hereof be construed as a waiver of any subsequent default of the same or

9. ATrORNEYS' FEES FOR ENFORCEMENT.
In the event that either party breaches any provision of this Agreernent
and the other party retains counsel to assist in enforcing the terms thereof, the
breaehing party will pay all reasonable attorneys' fees, court eosts and expenses
(including interest and travel costs, if applicable) which are incurred by the other party
in enforcing the Agreement, whether enforcement is ultimately achieved by litigation
or by amicable resolution. It is the specifie Agreement and intent of the parties that
a breaehing or wrongdoing party shall bear the obligation of any and all costs, expenses
and reasonable eounsel fees incurred by the nonbreaehing party in proteeting and
enforcing his or her rights under this Agreement.
10. PERSONAL PROPERTY.
WIFE and HUSBAND have previously agreed to the distribution of all
items of personal property. WIFE agrees that all such property in the possession of
HUSBAND shall be the sole and separate property of HUSBAND. HUSBAND agrees
that all such property in possession of WIFE shall be the sole and separate pr::;perty
of WIFE, Each of the parties does hereby specifically waive, release and renounce any
further claims with respect to said items.

Notwithstanding the above, HUSBAND and WIFE l\I'e the owners of a
1992 Ford Crown Victoria which has n value of$10,103, HUSBAND hereby abrrees to
transfer any right, title and interest to said vehicle to WIFE. HUSBAND agrees to
execute the car title concurrently with the execution of this Agreement,
11. REAL PROPERTY.
HUSBAND and WIFE are the owners of real property located at 809

Yverdon Drive, Camp Hill, Pennsylvania 17011. The property has been appraised at
$121,000 and has no liens or eneumbrances against it. HUSBAND hereby agrees to
transfer his right, title and interest in the home to WIFE. HUSBAND agrees to
exeeute a deed prepared by WIFE's attorney eoncurrently with the execution of this

Agreement, thus effectuating this transfer.

12, RETIREMENT ACCOUNTS.
WIFE is the recipient of$I,771 per month from her PSERS pension which
is in pay status. HUSBAND is the recipient of $869 per month from his PSERS
pension which is in pay status. HUSBAND also receives $909 per month in Soeial
Security benefits. Each party hereby waives any right, title or interest in the other's

pension, HUSBAND is the owner of an Individual Retirement Account valued at
$23,642. WIFE is the owner of an Individual Retirement Account valued at $26,059,

WIFE wllivcs any right, titlc or intcrcst in HUSBAND's IRA. HUSBAND waivcs any
right, titlc or intcrcst in WIFE's IRA.
13, STOCK.
The parties are joint owners of twenty (20) shores of Tucson Electric and
Power stoek and one hundred (100) shares of Sunshine Mining stock. The parties
agree to sell the stoek and equally divide the proceeds. Eaeh party agrees to be
responsible for one-half the capital gains on said sale,
14, BONDS.
HUSBAND and WIFE are the owners of one hundred ninety-nine (199)
Series EE Savings Bonds valued as of December 1997 at $240,528. HUSBAND shall
receive the first $131,103 value of the bonds. The remaining value of the bonds shall
be divided equally between the parties. The summary of the bond distribution is
attached hereto as EXHIBIT A. The highlighted bonds shall be distributed to WIFE.
15. VANGUARD ACCOUNT.
The parties are the joint. owners of a Vanguard Tax-Free account valued
at approximately $20,532. WIFE and HUSBAND hereby agree to divide said account
equally,

determinat,ion for all time of either party's obligations to contribute to the support or
maintenance of the other. From the exeeution date of this AbFfeement forward, it shall
be the sole responsibility of each party to sustain himself or herself without seeking
any support from the other.
18. HEALTH INSURANCE.
Each party currently maintains their own individual health insurance
coverage and agrees to continue said responsibility from the execution of this
Agreement forward.
19. TAXES.
The parties aeknowledge that they have been separately advised by their
respective attorneys that there may be certain tax consequences pertaining to this
agreement, that neither attorney has furnished tax advice with respect to this
agreement, that each party has been directed and advised to obtain independent tax
advice from qualified tax aecountants or tax counsel prior to signing this agreement
and that they have had the opportunity to do so. All transfer of assets provided for
under this Agreement are pursuant to a marital separation agreement and are
intended to qualify for Section 1041(c) status as a tax free transfers.

20. ATl'ORNEY FEES. COURT COSTS.
Eaeh party hereby abrrees to be solely responsible for his or her own
counsel fees, costs and expenses. Neither shall seek any contribution thereto from the
other party except as otherwise expressly provided herein.
21. MUTUAL COOPERATION.
WIFE and HUSBAND shall mutually cooperate with eaeh other in order
to earry through the terms of this Agreement, including but not limited to, the signing
of doeuments.
22. AGREEMENT BINDING ON HEIRS.
This Agreement constitutes the final agreement of the parties and is
binding upon their heirs, assigns and successors in interest.
23, VOID CLAUSES.
If any ',erm, condition, clause or provision of this Agreement shall be
determined or declared to be void or invalid in law or otherwise, then only that term,
condition, clause or provision shall be strieken from this Agreement, and in all other
respects this Agreement shall be valid and continue in full force, effect and operation.

24, APPLICABLE LAW.
This Abrreement shall be construed under the laws of the Commonwealth
of Pennsylvania,
25. ENTIRE AGREEMENT.
This Agreement contains the entire understanding of the parties, and
there are no representations, warranties, covenants or undertakings other than those
expressly set forth herein.
26. CONTRACT INTERPRETATION,
For purposes of contract interpretation and for the purpose in resolving
any ambiguity herein, the parties agree that this Agreement was prepared jointly by
the parties.
