ORDER OF COURT
AND NOW, this 9th day of February, 1999, the
defendant having presented himself for sentence in connection
with a contempt citation for violation of P.F.A., and the Court
being in receipt of a pre-sentence investigation report, the
sentence of the Court is that the defendant pay the costs of
prosecution, a fine of $250.00, and undergo a period of
supervised probation for six months.
Conditions of probation are that he comply with
all instructions of his probation officer, and that he have no
contact whatsoever with Audrey Stevenson by phone, by letter or
in person. He is not allowed within one-quarter of a mile of
her residence, nor within 1,000 feet of her person. If he sees
her on the street, he is to turn around and run the other way.
In the event that she has contact with him, he
is to hang-up or send the letter to his lawyer. If she wants
this condition of probation removed, the defendant or she may
contact Mr. Althouse, otherwise this condition is to be strictly
complied with.

hearing, the Court finds beyond a reasonable doubt that the
Defendant has violated Paragraphs 2 and 6 of its order dated
January 20, 1998, and he is adjudicated to be in contempt.
The Defendant is directed to appear for sentence on
Tuesday, February 9, 1999, at 9:00 a.m. A sentencing report is
ordered. Pending sentence, the Defendant is released on
existing bail on the same express condition that he have no
contact whatsoever with the Plaintiff in this case, Audrey E.
Stevenson.

Pennsylvania, brings the following Petition for a hearing on charges ofIndirect Criminal
Contempt:
I. A Protection from Abuse Order was issued by the Court. A true and correct
copy of the Order is attached.
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonweallh is requesting a hearing on the charges ofIndirect Criminal
Contempt pursuant to 23 Pa.C.S.A. ~ 6113.
6. The plaintiffandlor the defendant may seek modification of the Order based on
the filing of this petition as the Court deems appropriate following the trial in addition to

PROBABLE CAUSE BELIEF IS BASED ON THE FOLLOWING FACJ'S AND CIRCUMSTANCES:
On 25 December 1998 at approximately 2230 hours, the defcndant showed up at the home of the
plaintiff, Audrey Stevenson, 146 Dauphin Strcet, Enola, PA 17025. The plainliffopened the door, keeping the
chain across the door. When the plaintiff refused to allow the defendant into residence, the defendant forced his
way in, pulling the screws from the wall which held the chain lock. The plaintiff allempted to keep the
defendant from entering her home and a struggle ensued between the parties. The defcndant entered the home
of the plaintiff, at which time he grabbcd a lamp from an end table and demanded the return ofa pair of blue
jeans and a pair of scissors. The plaintiff stated that the items wcrc given to the defendant and an extended
verbal battle took place, prior to the dcfendant leaving the residence. As a result of the struggle, the plaintiff
sustained multiple scratchcs, bruising and soreness on various parts of her body.
On 26 December 1998, the defendant telephoned the plainti ff at her residence, leaving a message on the
answering machine that stated the following, "Thanks for hilling me on Christmas." Additionally, the plaintiff
realized the defendant had taken $30.00 off the coffee table in the living room.
On 29 Deccmber 1998, this affiant spoke to the defendant by telephone at which time he admitted to
going to the plaintiffs residence for the purpose of retrieving the itcms mentioned abovc, forcing his way into
her home and struggling with the plaintiff.
In lieu oflhe above stated facts, this affiant rcspcctfully rcqucsts the dcfendant to be summoned to
appear before this Court on a chargc of Indirect Criminal Contcmpt.

PROTECTION ORDER

of the Consent Agreement of the parties, the following Order is
entered:
1. The defendant, Michael W. Knoll, III, is enjoined from
physically abusing the plaintiff, Audrey E. Stevenson, or from
placing her in fear of abuse.
2. The defendant is enjoined from having any direct or
indirect contact with the plaintiff including, but not limited
to, telephone and written communications.
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relatives.
4. The defendant is prohibited from entering the
plain~iff's place of employment.
S. The defendant is prohibited from removing, damaging,
destroying or selling any property owned by the plaintiff.
6. The defendant is ordered to stay away from the
plaintiff's residence located at 44 Grant Street, Enola,
Cumberland County, Pennsylvania, and any other residence the
plaintiff may establish.

8. This Order shall remain in effect for a period of ono
year or until modified or terminated by the Court. The Order can
be extended beyond its original expiration date if the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff.
9. A violation of this Order may sUbject tho defendant tOI
i) arrest under 23 Pa.C.S. 66113; ii) a private criminal
complaint under 23 Pa.C.S. 66113.1; iii) a charge of indirect
criminal contempt under 23 Pa.C.S. 66114, punishable by
imprisonment up to six months and a fine of $100.00-$1,000.001
and iv) civil contempt under 23 Pa.C.S. 66114.1. Resumption of
co-residence on the part of the plaintiff and defendant shall not

10. The Pennsylvania State, East Pennsboro, and Hampden

Township Police Departments shall be provided with certified
copies of this Order by the plaintiff's attorney and may enforce
this Order by arrest for indirect criminal contempt without

whether or not the violation is committed in the presence of a
police officer. In the event that an arrest is made under this
section. the defendant shall be taken without unnecessary delay

of the Consent Agreement of the parties, the fOllowing Order is
entered:
1. The defendant, Michael W. Knoll, III, is enjoined from
physically abusing the plaintiff, AUdrey E. Stevenson, or from
placing her in fear of abuse.
2. The defendant is enjoined from having any direct or
indirect contact with the plaintiff including, but not limited
to, telephone and written communications.
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relatives.
4. The defendant is prohibited from entering the
plaintiff's place of employment.
5. The defendant is prohibited from removing, damaging,
destroYing or selling any property owned by the plaintiff.
6. The defendant is ordered to stay away from the
plaintiff's residence located at 44 Grant Street, Enola,
Cumberland County, PennsYlvania, and any other residence the
plaintiff may establish.

7. The court costs and fees arc waived.
8. This Order shall remain In effect for a period of one
year or until modified or terminated by the Court. The Order can
be extended beyond its original expiration date If the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued

9. A violation of this Order may subject the defendant to:

copies of this Order by the plaintiff's attorney and may enforce
this Order by arrest for indirect criminal contempt without
warrant upon probable cause that this Order has been violated,
whether or not the violation is committed in the presence of a
police officer. In the event that an arrest is made under this
section, the defendant shall be taken without unnecessary delay
before the court that issued the order. When that court is
unavailable, the defendant shall be taken before the appropriate

RELIEF UNDER THE PROTECTION FROM ABUSE
ACT, 23 Pa.C.s. 6 6101 et seq.
A. ABUSE
1. The plaintiff, AUdrey E. Stevenson, is an adult
individual residing at 44 Grant Street, Enola, Cumberland County,
Pennsylvania 17025.
2. The defendant, Michael W. Knoll, III, (SSN: 270-62-
4311)(Date of Birth: 9119/72), is an adult individual residing at
an address unknown to the plaintiff.
3. The defendant has had an intimate relationship with the
plaint i ff.
4. Since approximately the winter of 1995, the defendant
has attempted to cause and has intentionally, knowingly, or
recklessly caused bOdily injury to the plaintiff, has placed the
plaintiff in reasonable fear of imminent serious bodily injury,
and has knowingly engaged in a course of conduct or repeatedly
committed acts toward the plaintiff including fOllowing the
plaintiff, without proper authorization, under circumstances
which have placed the plaintiff in reasonable fear of bodily
injury. This has inclUded, but is not limited to, the following
specific instances of abuse:
a.
On or about December 28, 1997, after an argument,

the plaintiff barricaded hcrsclf in her bcdroom fenr
for her safety. Thc defcndant forccd his wny into the
bedroom, grabbcd the plaintiff, and pullcd hcr out of
thc room. The defcndant threw the plaintiff onto the
floor, pulled her hair, and threw her onto the floor
approximatcly seven or eight times as she tried to
stand up. The defendant picked up the plaintiff, threw
her onto the couch, and held her down on the couch by
pressing his knees into her stomach. The defendant
spit in the plaintiff's face, held her down on the
floor, and pushed her several times as she attempted to
escape the residence causing her to fall into the
Christmas tree and knock over a table. When the
plaintiff finally reach the door to leave, the
defendant grabbed her from behind and pushed her down
the stairs causing her purse strap to catch on the hand
rail and wrap around her neck choking her. The
defendant ignored the plaintiff's pleas for help as she
struggled to free herself from her purse strap and
leave and residence. This incident resulted in the
plaintiff having a swollen eye and forehead, bruised
arms and legs, scraped knees, and a strap mark around
her neck.
b. On or about December 19, 1997, the defendant
became angry, pushed the plaintiff several times,

threw Christmas gifts nround thc room, hit the
Christmas tree with his hands causing ornaments to fall
to the floor and break, threatcncd to physically throw
the plaintiff out of the house, and pulled the phone
out of the wall causing her to fear for her safety. A
neighbor calied the police who escorted the defendant
from the residence.
c. In or about September 1997, the defendant became
angry, refused to allow the plaintiff to leave in her
car, and grabbed the steering wheei several times
causing her to fear for her safety. The defendant
ripped a bracelet from the piaintiff's wrist and
punched her in the mouth causing a laceration on her
hand and a swollen, laceration on her lip. When the
plaintiff arrived at her parent's home, she called the
police and charges were filed.
d. On several occasions Rince the winter of 1995, the
defendant has punched, kicked, choked, and slapped the
plaintiff, pulled her hair, and restrained her by
hOiding her down.
5. On or about December 28, 1997, thc plaintiff left her
residence at 600 Third street, West Fairview, Cumberland County,
Pennsylvania, in order to avoid further abuse.
6. The plaintiff believes and therefore avers that she is
in immediate and present danger of abuse from the defendant and

The defendant violated the PROTECTION FROM ABUSE ORDER #123 Civil 1998,
issued on January 20, 1998, by the Honorable Judge Edward E. Guido, to wit:
The defendant was ordered to stay away from any residence Audrey E. Stevenson
established for herself and to enjoin from having any direct contact with
Stevenson. The defendant was found at 146 E. Dauphin Street, Apt. #4, the
residence of Stevp,nson.
PROBABLE CAUSE: I was called to 146 E. Dauphin Street, Apt. #4 for a 911 Hang Up
Upon arrival Stevenson advised she currently resided at the residence and that
she had a P.F.A. against Knoll, prohibiting him from being at the residence.
