The Cumberland County Sherill's Department shall attempt to make service at the plaintitl's requesl and wilhout pre-Ilaymcnt of Ices, but service may be accomplished WIder any applicable rulc of Civill'mcedw'c, a, On or about January 9, 1998, the defendant repeatedly telephoned the plaintifI at her residence hUl'assing her. On or about January 10, 1998, when the defendant came to bed, he pulled the plaintill's hair, repeatedly hit her in the head and face causing soreness and pain, choked her, and while holding her by the hair and throat sexually assaulted her, When the defendant went to the batlu'oom, the plaintiff grabbed the portable telephone, ran outside, and called 911, 111C plaintiff was taken to Harrisburg Hospital for treatment of her injUlies, The defendant was selVed with an emergency protection order issued by District Justice Klair which is attached as Exhibit A and incorporated herein by reference, b. In 0\' about June 1997, the defendant grabbed the plaintiff by her hair, pulled her arms behind her back, and sexually assaulted her causing her pain, c. On several diflerent occasions during the past year, the defendant has threatened to sexually assault the plaintiff, and to shoot her, and he has repeatedly threatened her by saying "Don't make me hurt you," causing the plaintiff to fear for her safety. 6, On or about January 10, 1998, lhe plaintiff and the three minor children left their residence at 104 E, Simpson Street, Mechanicsburg, Cumberland County, Pennsylvania, in order to avoid further abuse, 2 7, Tlie plaintiff believes and therefore avers that she is in immediate and present danger of allUse from the defendant should she return to the home without the defendant's being ordered to stay away and that she is in need of protection from such abuse, 8. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written commwrlcations. 9, The plaintiff desires that the defendant be enjoined from harassing and stalking the plaintiff, and from harassing the plaintiff's relatives, or her minor children, 10, The plaintilf desires that the defendant be restrained from entering her place of employment or the schools and day care facility of the minor children, 11, The plaintift' desires that the defendant be el\ioined from removing, damaging, destroying or selling any property owned solely by the plaintiff, 12, The home which the plaintiff is asking the Court to order the defendant to stay away from is not owned or leased in the defendant's name, 13. The plainti1fis unaware of the defendant's present whereabouts but believes that the defendant has moved to his sister's, Ann Marie Ward, residence located at Kenningslon Heights, Hanisburg, Peltnsylvania. B. Ordering the defendant to refrain from having any direct 01' indirect contact with the plaintiff including, but not limited to, telephone and writtcn communications, 3. The Order can be extended beyond its original expiration date if the Court finds that the defendant has committed anodler act of abuse or has engaged in a pattern or practice that indicates continued risk of hann to the plaintiff, 9, A violation of this Order may subject the defendant to: i) al1'Cst under 23 Pa,C,S. ~6113; il) a private criminal complaint under 23 l'a.e.S. ~6J 13.1; iii) a charge of indirect criminal contempt under 23 Pa.C.S, ~6114, punishable by impriBonment up to six months and a fine of $100.00-$1,000.00; and Iv) civil contempt under 23 l'a.e.S. ~6114.1. Simpson Street, Mechanicsburg, Cumberland COWlty, Pennsylvania, and any other residence the plainliff may llstablish. 7. 'The costs of reimblU'Sing one of Legal Services, Inc. 's funding sources in the amount of $250.00 is waived. 8, The defendant, allhough entering into this Agreement, does not admit the allegations made in the Petition. 9. The defendant understands that the Protection Order entered in tltis matter will be in effect fo\' a period of one year and can be extended beyond it original expiration date if the Court finds that the defendant has committed another act of abuse or has engaged in a pattern or practice that indicates continued risk of hann to the plaintiff: The defendant understands that this Order will be enforceable in the same manner as the Court's prior Temporal)' Protection Order entered in this case. 10.
