COMPLAINT
AND NOW eomes Plaintiff, by and through its attorney, and makes this
Complaint, in support of which it avers as f'ollows:
L PlaintiIT, AUS Consult.ants, Inc, Weber Fick & Wilson Division is a
eorporation organized under the laws of' the State of New Jersey and authorized to
eonduet business in Pennsylvania with offiees at 1000 North Front Street, Suite 200,
Wormleysburg, Cumberland County, Pennsylvania"
2. Defendant, Franklin Manor Utilities, Ltd ("Franklin Manor") is a
Pennsylvania limited partnership and Defendant Blaine A. Beeghly is its general
partner with a registered plaee of business at 37 Highland Avenue, Washington,
Washington County, Pennsylvania,
3. AUS was retained by Defendants to provide professional consulting
services in an administrative agency proceeding in exchange for the payment of fees
and costs (hereinafter the "Services").
4. AUS opened a file number 96-24 as the client matter and reeorded the
billed time and costs as they accrued (hereinafter the "Aceount").
of $13,004.43 plus interest as it acerues at the rate of 1.5% per month, together with
the costs of this action, reasonable attorneys fees, and sueh other relief as this Court
shall deem appropriate.
COUNT II . Unjust Eqrichment
12, The averments in Paragraphs 1 through 11 are incorporated herein by
reference, as if fully set f'orth herein.
13. The Services rendel'ed by AUS, without f'ull payment therofor, constitutes
unjust enrichment to Defendants, which has retained tho value of'such services with
knowledge that ADS intended to be paid but nevert.heless Defendants have f'ailod and
refused to make payment.
14, 'l'he expense for the professional services provided by Plaintiff Was
elaimed by Defendant lo'ranklin Manor in rates charged to eonsumers, and the PUC
approved recovery in the rates,
WHEREFORE, AUS respectf'ully requests this Court to give judgment in favor
of' AUS and against Defendant Franklin Manor and Defendant Beeghly in the amount
of' $13,004.43, plus interest as it accrues at the rate of 1.5% pel' month, together with
the eosts of this action, reasonable attorneys fees, and such other relief as this Court
shall deem appropriate.
