COMPLAINT
AND NOW, comes Financial Trust Company, through its attorney, William A,
Duncan, Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a
statement:
I, Plaintiff is Financial Trust Company, a corporation organized and existing under
the laws of the Commonwealth of Pennsylvania with its main office and principal place of
business located at I West High Street, Carlisle, Cumberland County, Pennsylvania 17013,
2, Defendant, Walter Crone, an adult individual, and Defendant, Sally A, Crone, an
adult individual, are husband and wife, and reside at 216 Wesley Drive, Mechanicsburg,
Cumberland County, Pennsylvania
3, On or about December 24, 1991, Defendants made, executed and delivered to
Plaintiff a note and a real estate mortgage financing One Hundred Thirty Seven Thousand and
00/100 Dollars ($137,000,00), a copy of said note and said real estate mortgage being attached
hereto as Exhibits "A" and "B", respectively, and are incorporated herein by reference as
though fully set forth,
4, Said note and said real estate mortgage have not been assigned,
5, Walter Crone and Sally A, Crone are the sole record owners in fee simple of sllid
premises subject to said mortgage, by virtue of a Deed dated June 16, 1983 and recorded in the
Cumberland County Recorder's Ol1ice in Deed Book "1''', Volume 30, Page 1097, more
specifically set forth in Exhibit "C", all ached hereto and made a part hereof by reference,
6, Said note lInd said real estate mortgage arc in default because Defendants herein
have failed to pay the payments that were due and owing for the months of April 1997, May
1997, June 1997. July 1997, August 1997, September 1997, October 1997 and November
1997 and December 1997,
7, The PlaintilThas given to the Defendants wrillen notice of intention to foreclose on
said mortgage as required by law under Act 6, dated December 4, 1997, a copy of which is
marked Exhibits "D" and "E", and allached hereto and made a part hereof by reference,
8, The PlaintilT has given wrillen notice of default as required by the Homeowner's
Emergency Assistance Act of 1983, dated December 4, 1997, a copy of which is marked
Exhibits "F" and "G", and all ached hereto and made a part hereofby reference,
9, By reason of the aforesaid default, the entire principal balance of One Hundred
Twenty-eight Thousand Four Hundred Seventy-one and 67/100 ($128,471.67) Dollars, with
interest thereon at the rate of 9,75 % per annum computed from April 24, 1997, including late
charges and allorney's fees are now due and payable,
10, The Defendants are liable to the PlaintilT for the following on said mortgage loan:
A. Principal amount and interest
due to date $119,669,20
B, Late Charges 2,684,77
C, Attorney's Collection fee: 6,117,70

together with interest thereon, costs and all other amounts advanced by Plaintiff,

PURSUANT TO PA,R.C.P. NO.3129(b)
1. The property to be sold pursuant to the above captioned judgment is all that certain
tract of real estate situate in the Township of Lower Allen, Cumberland County, Pennsylvania,
as more fully described in Exhibit II A" attached hereto and made a part hereof. The said
property is improved with a single family dwclling.
2. The judgment of the Court in which the sale is being held is Civil Term 98-234 in
the Court of Common Pleas of Cumberland County, Pennsylvania.
3. The names of the owners of the property to be sold pursuant to the above
captioned judgment are Walter Crone and Sally A. Crone, husband and wife, of216 Wesley
Drive, Mechanicsburg, Pennsylvania.

letter was mailed under the date of March 31, 1998 and never returned to the Sheriff s Office.

real Estate Writ Notice Poster and Description in the following manner: The sheriff mailed one

I. The property to be sold pursuant to the above captioned judgment is all that certain
tract of real estate situate in the Township of Lower Allen, Cumberland County, Pennsylvania,
as more fully described in Exhibit II A" attached hereto and made a part hereof. The said
property is improved with a single family dwelling.
2. Thejudgment of the Court in which the sale is being held is Civil Term 98-234 in
the Court of Common Pleas of Cumberland County, Pennsylvania.
3. The names of the owners of the property to be sold pursuant to the above
captioned judgment arc Walter Crone and Sally A. Crone, husband and wife, of216 Wesley
Drive, Mechanicsburg, Pennsylvania.
4. The time and the place of the Sheriff Sale is 10 o'clock A.M., June 3, 1998 in the
County Commissionerls Conference Room, Second Floor, Cumberland County Court House,
Carlisle, Pennsylvania.
S. A Schedule of Distribution will be filed by the Sheriff on a date specified by the
