At that time and place, decedent Dorothy Jauss was residing in a three-room apartment she and her husband rented under lease from Defendants. A warranty of habitability is implied in said lease by operation of law. 7. West Fairview Inn is a two-story structure with five apartments and several rooms for rent. In addition, there is a kitchen and bar on the first floor. 8. West Fairview Inn is a structure subject to the provisions of the Fire and Panic Act, 35 P.S. 9 1221 et seg. 9. Specifically, West Fairview Inn is a Class IV building as defined by the Fire and Panic act, 35 P.S. 9 1222. 10. Class IV buildings include U[t]enement houses, apartment houses, apartment hotels, club houses, lodging houses, and rooming houses.u 35 P.s. 9 1222. 11. At all times relevant to this Complaint, Defendants West Fairview Inn, Inc., DJP Enterprises and Peter Patruzo, Jr., were responsible for the care, custody, control, maintenance and repair of the premises known as West Fairview Inn. 12. The Jauss' apartment had a non-functioning smoke detector in the kitchen. 13. Defendant Peter Patruzo, Jr. had placed a battery in the kitchen smoke detector, however, the detector remained non- functioning. 14. There was an additional smoke detector in the hall of the apartment. 2 " 15. The hallway detector had neither a cover nor a battery and was also non-functioning. 16. The Defendants had notice of the non-functioning fire/smoke detectors and Defendants had reasonable opportunity to make the necessary repairs but they failed to do so. 17. Several months prior to Dorothy Jauss' death, there had been a fire in another apartment of the West Fairview Inn. 18. The Jauss' apartment was damaged as a result of this previous fire. 19. Specifically, there was smoke damage to the Jauss' kitchen that had not been repaired as of January 27, 1997. 20. The previous fire had also damaged the door to a fire escape in West Fairview Inn. 21. Defendant Peter Patruzo stated that the door to the fire escape would be replaced. 22. The fire escape door was neither replaced nor repaired. Instead the door was nailed shut thereby preventing access to the fire escape. 23. The Defendants had notice of the defective fire escape and the dangerous condition it caused. 24. Furthermore, the Defendants had reasonable opportunity to make the necessary repairs to the fire escape door but they failed to do so. 25. On January 27, 1997, a second fire broke out in West Fairview Inn. 3 " . " 26. The fire began in Jauss' apartment while decedent Dorothy \ I . P Jauss was in the apartment. 27. The non-functioning smoke detectors failed to warn ." , ' ";\ J I I decedent Dorothy Jauss of the fire. 28. Decedent Dorothy Jauss attempted to leave her apartment by way of the fire escape but was unable to because the door to the fire escape was nailed shut. 29. Decedent Dorothy Jauss was unable to escape her burning apartment and died as a result of smoke inhalation. COUNT I - RICHARD MOYER. Administrator of the Estate Dorothv Jauss v. WEST FAIRVIEW INN. INC. 30. Paragraphs 1 through 29 of Plaintiff's Complaint are incorporated herein by reference. , I. CLAIM I - NEGLIGENCE ') I .' I 31. The aforementioned accident and all of the injuries and damages set forth hereinafter sustained by Plaintiff Richard Moyer, as Administrator of the Estate of Dorothy Jauss, are the direct and proximate result of the negligent, careless, wanton and reckless manner in which Defendant West Fairview Inn, Inc. maintained, operated and inspected the West Fairview Inn as follows: a. Failing to maintain the premises in a safe condition; b. Failing to inspect the premises of West Fairview Inn to determine whether there were any conditions which posed a hazard to its tenants; 4 ",~ '"' c. Failing to maintain the promises of West Fairview Inn in a manner which would have reduced the likelihood of fires; d. Failing to provide adequate devices to warn tenants of fire; e. Failing to provide proper and sufficient means of escape from fire; f. Failing to provide access to the fire escapes located on the premises; g. Failing to properly repair or replace the damaged door to the fire escape; h. Failing to provide properly functioning smoke detectors; i. Failing to properly repair or replace non- functioning smoke detectors. CLAIM II - BREACH OF IMPLIED WARRANTY OF HABITABILITY 32. The aforementioned incident and all of the injuries and damages set forth hereinafter sustained by Richard Moyer, as Administrator of the Estate of Dorothy Jauss, are the result of the failure of West Fairview Inn, Inc. to provide the facilities and services vital to the life, health and safety of its tenants and to the use of the premises for residential purposes as follows: a. Failing to maintain the premises in a safe condition; b. Failing to provide access to the fire escapes located on the premises; 5 c. Failing to provide adequate devices to warn tenants of the fire; d. Failing to properly repair or replace the damaged door to the fire escape; e. Failing to provide properly functioning smoke detectors; f. Failing to properly repair or replace non- functioning smoke detectors; g. Failing to provide proper and sufficient means of escape from fire; h. Failing to maintain the Jauss' apartment in a habitable condition. CLAIM III - STRICT LIABILITY UNDER THE FIRE AND PANIC ACT 33. Defendant West Fairview Inn, Inc. is strictly liable to Plaintiff Richard Moyer, as Administrator of the Estate of Dorothy Jauss, for violating the Fire and Panic Act, 35 P.S. 9 1221 et seq., as follows: a. Failing to install functioning automatic fire detection devices within each dwelling unit and in . . , I each hall and stairwell in violation of 35 P.S. 9 1223.2(a); b. Failing to inspect the automatic fire detection devices on a yearly basis in violation of 35 P.S. 9 1223.2 (d) ; . , , 6 c. Failing to provide proper and sufficient ways of egress and means of escape from fire and panic in violation of 35 P.S. ~ 1224; d. Failing to maintain proper ways of egress free from obstruction in violation of 35 P.S. ~ 1224; e. Failing to keep fire escapes in a safe condition and up to standard requirements as specified by the Department of Labor and Industry in violation of 35 P.S, ~ 1224. COUNT II - RICHARD MOYER. Administrator of the Estate Dorothv Jauss v. DJP ENTERPRISES 34. Paragraphs 1 through 29 of Plaintiff's Complaint are incorporated herein by reference. CLAIM I - NEGLIGENCE 35. The aforementioned accident and all of the injuries and damages set forth hereinafter sustained by Plaintiff Richard Moyer, as Administrator of the Estate of Dorothy Jauss, are the direct and proximate result of the negligent, careless, wanton and reckless manner in which Defendant DJP Enterprises maintained, operated and inspected West Fairview Inn as follows: a. Failing to maintain the premises in a safe condition; b. Failing to inspect the premises of West Fairview Inn to determine whether there were any conditions which posed a hazard to its tenants; L I, 7 c. Defendant DJP Enterprises is strictly liable to Plaintiff Richard Moyer, as Administrator of the Estate of Dorothy Jauss, for violating the Fire and Panic Act, 35 P.S. 9 1221 et seq., as follows: 9 " c. Failing to provide proper and sufficient ways of egress and means of escape from fire and panic in violation of 35 P.S. ~ 1224; d. Failing to maintain proper ways of egress free from obstruction in violation of 35 P.S. ~ 1224; e. Failing to keep fire escapes in a safe condition and up to standard requirements as specified by the Department of Labor and Industry in violation of 35 P.S. ~ 1224. COUNT III _ RICHARD MOYER. as Administrator of the Estate of Dorothv Jauss v. PETER PATRUZO. JR. 38. paragraphs 1 through 29 of Plaintiff's complaint are incorporated herein by reference. CLAIM I - NEGLIGENCE 39. The aforementioned accident and all of the injuries and damages set forth hereinafter sustained by plaintiff Richard Moyer, as Administrator of the Estate of Dorothy Jauss, are the direct and proximate result of the negligent, careless, wanton and reckless manner in which Defendant Peter Patruzo, Jr., maintained, operated and inspected the West Fairview Inn as follows: a. Failing to maintain the premises in a safe condition; b. Failing to inspect the premises of West Fairview Inn to determine whether there were any conditions which posed a hazard to its tenants; 10 c. Failing to maintain the premises of West Fairview Inn in a manner which would have reduced the likelihood of fires; d. Failing to provide adequate devices to warn tenants of fire; e. Failing to provide proper and sufficient means of escape from fire; f. Failing to provide access to the fire escape located on the premises; g. Failing to properly repair or replace the damaged door to the fire escape; h. Failing to provide properly functioning smoke detectors; i. The aforementioned incident and all of the injuries and damages set forth hereinafter sustained by Plaintiff Richard Moyer I as Administrator of the Estate of Dorothy Jauss, are the result of the failure of Peter Patruzo, Jr. to provide the facilities and services vital to the life, health and safety of the tenants of West Fairview Inn and to the use of the premises for residential purposes as follows: a. Failing to maintain the premises in a safe condition; 11 b. Failing to provide access to the fire escapes located on the premises; c. Failing to provide adequate devices to warn tenants of the fire; d. Failing to properly repair or replace the damaged door to the fire escape; e. Failing to provide properly functioning smoke detectors; f. Failing to properly repair or replace non- functioning smoke detectors; g. Failing to provide proper and sufficient means of escape from fire; h. Failing to maintain the Jauss' apartment in a habitable condition. CLAIM III - STRICT LIABILITY UNDER THE FIRE AND PANIC ACT 41. Defendant Peter Patruzo, Jr. is strictly liable to Plaintiff Richard Moyer, as Administrator of the Estate of Dorothy Jauss, for violating the Fire and Panic Act, 35 P.S. ~ 1221 et seq., as follows: a. Failing to install automatic fire detection devices within each dwelling unit and in each hall and stairwell in violation of 35 P.S. ~ l223.2(a); b. Failing to inspect the automatic fire protection devices on a yearly basis in violation of 35 P.S. ~ 1223.2(d); 12 c. Plaintiff Richard Moyer, Administrator of the Estate of Dorothy Jauss, brings this action on behalf of the Estate of Dorothy Jauss under and by virtue of the Act of 1976, July 9, P.L. 586, No. 142, ~ 2, 42 Pa.C.S.A. ~ 8302. 44. Defendants' negligence, as alleged herein, was the legal cause of Dorothy Jauss' death. 45. Plaintiff Richard Moyer, Administrator of the Estate of Dorothy Jauss, claims, on behalf of the Estate, the damages suffered by said Estate by reason of the death of Dorothy Jauss, . West Fairvie1o' Inn is a t1o'0-story structure with five apartments and several rooms for rent. kitchen and bar on the first floor. In addition, there is a B. West Fairview Inn is a structure subject to the provisions of the Fire and Panic Act, 35 P.S. ~ 1221 et seq. 9. Specifically, West F'airview Inn is a Class IV building as defined by the Fire and ~anic act, 35 P.S. ~ 1222. 10. Class IV buildings inc~ude "(t]enement houses, apartment houses, apartment hotels, club houses, lodging houses, and rooming houses." 35 P.S. ~ 1222. 11. At all times relevant to this Complaint, Defendants West Fairview Inn, Inc., DJP Enterprises and Peter Patruzo, Jr., were responsible for the care, custody, control, maintenance and repair of the premises known as West Fairview Inn. 12. The Jauss' apartment had a non-functioning smoke detector in the kitchen. 13. Defendant Peter Patruzo, Jr. had placed a battery in the kitchen smoke detector, however, the detector remained non- functioning. 14. The hallway detector h~d neither a cover nor a battery '- and was also non-tunctioning. 16, The Defendants had notice of the non-functioning fire/smoke detectors and Defendants had reasonable opportunity to make the necessary repairs but they failed to do so. 17. Several months prior to Dorothy Jauss' death, there had been a fire in another apartment of the West Fairview Inn. 1S. The Jauss' apartment was damaged as a result of this previous fire. 19. Specifically, there was smoke damage to the Jauss' kitchen that had not been repaired as of January 27, 1997. 20. The previous fire had"also damaged the door to a fire escape in West Fairview Inn. 21. Defendant Peter Patruzo stated that the door to the fire escape would be replaced. 22. The fire escape door was neither replaced nor repaired. Instead the door was nailed shut thereby preventing access to the fire escape. 23. The Defendants had notice of the defective fire escape and the dangerous condition it caused. 24. Furthermore, the Defendants had reasonable opportunity to make the necessary repairs to the fire escape door but they failed to do so. 25.
