COUNT I - DIVORCE UNDER 3301(c) OF THE DIVORCE CODE
AND NOW cornes Donnn L. Atwood by nnd Ihrough Frey and Tiley, nllOl'l1eys for
Plaintiff, and makes thc following statement:
I. Plaintiff is Donna L. Alwood, who currently resides nt 860 Coon Road, Gnrdners.
Cumbelland County. Pennsylvanin.
2. Defendant is Rodger T. Atwood, who currently resides m Allenwood Prison. White
Deer, Pennsylvnnia.
3. Plaintiff and Defendant have been bona fide residents in the Commonwealth of
Pennsylvania for at least six (6) months immediately previous 10 Ihe filing of Ihis Complnint.
4. Plaintiff and Defendant were married on September 5, 1964 in Carlisle.
Cumberland County. Pennsylvania.
5. A prior aclion in Divorce was filed by Defendant against Plaintiff in Ihe Office of
the Prothonotary of Cum bell and County 10 file no. 4054 Civil 1991. This action wns purged for
inactivity on October 25, 1994. There have been no other nctions of divorce or for nnnulment
between the parties.
6. The mnrriage is irrelrievably broken.
7. Plaintiff has been ndvised Ihm counseling is available and thaI Plainliffmay have the
right to request that the Court require the pnrties to parlicipate in counseling.
WHEREFORE, Plaintiff requests your Honorable Court 10 enter a Decree in Divorce,
Divorcing Plaintiff and Defendant.
