Description in the above entitled action on the property located at 1908 Carlisle Road, Camp
Hill, Cumberland County, Pennsylvania according to law.
Steve M. Whistler, Deputy Sheriff who being duly sworn according to law, says on July 6,
1998 at 7:09 o'clock P.M. E. D. S. T., he served a true copy of real Estate Writ Notice Poster and
Description in the above entitled action upon one of the within named defendants to wit: Susan
E. Fasick, by handing to Susan Fasick at 321 Hummel Avenue 2nd Floor, Lemoyne
Cumberland County, Pennsylvania, its contents and at the same time handing to her personally
the said true and attested copies of the same.
R. Thomas Kline, Sheriff, who being duly sworn according to law, says he made diligent
search and inquiry for one of the within named defendants to wit: James M. Fasick
but was unable to locate him in his bailiwick. He therefore deputized the Sheriff of Lebanon
County to serve the within Real Estate Writ Notice Poster and Description according to law.
LEBANON COUNTY RETURN: Danny L. Heilman, Deputy Sheriff, being duly sworn
according to law, deposes and says that after due and diligent search by him having been made in
his bailiwick and after having exhausted all known facets to locate defendant, as stipulated under
Rule of Civil Procedure, Rule 430."good faith effort" he was unable to find .Tanles M. Fasick, the
within named defendant, and he therefore returns same Not Found as to said .Tames M. Fasick,

WELCOME TO BENEFICIAL - In this Agreement, Ihe words I, you, your and yours mean the Borrower, and the words we, our, and UI mean the
Cred~or. This Is an Open End Cred~ Account, The amount of cred~ available 10 you at any point In lime Is the difference between the Cred~ Line and
the Unpaid Balanco. There are no IIm~ations on e~her the number or on the dollar amount of the extensions of cred~ (up 10 your Credn Line) you

CALCULATION OF FINANCE CHARGE: To calculate the Finance Charge on your Account, we do the following: Step 1 - We calculate the Average
Daily 8alance, In the manner described In the Immediately following paragraph. Step 2 - We then calculate the Finance Charge by mulliplylng the
Average Daily Balance Balances obtained under Step 1 by the Daily Periodic Rate, thereby yielding a daily Finance Charge amount. Step 3 - T!1e amount
so obtained is then muniplled by the number of days in the billing cycle to obtain the Finance Charge for that billing cycle.
CALCULATION OF AVERAGE OAILY BALANCE: To calculate the Average Daily Balance on your Accoun~ we do the following: Step 1 - We take the
Unpaid Balance on your Account as of the beginning of each day in the billing cycle and add any new cash advances or any other charges made
, on that day, and we subtract any payments or any other credits which were also made on that day. We do not include the Finance Charge In calculating
the Average Daily Balance. Step 2 - We then add up all of the Unpaid Balances for each of the days in the billing cycle. Step 3 - We then divide that
total amount by the number of days In the billing cycle.
This is a Variable Rate Account, and the Finance Charge Rate is subject to change as described below,
The Finance Charge rate on your Account when n first opens will be the Reference Rate charged by the Bank of America (Prime Rate) plus 4.50
percentage points (Margin). rounded up to the nearest one-quarter percent. Alter the Account is opened, the Finance Charge rate will be reviewed
on March 1, June 1, September 1 and December 1 (Review Oates) of each year the Account Is open. If the Prime Rate In etfect on any Review Date
is different (rom the Prime Rate which had been in effect on the Immediately preceding Review Date, the Finance Charge rate will be adjusted on
January 1, April 1 , July 1, and October 1 (Adjustment Dates) to the Prime Rate in effect on the Review Date Immediately preceding each Adjustment
Da~e, plus the Margin, rounded up to the nearest one-quarter percent.
Except for the (Irst adjustment, your Finance Charge rate will not change any more frequenliy than 3 months. Any change in the Finance Charge
rate will be applicable to the Average Daily Balance for the billing cycle covered by the first Statement of Account prepared on or alter an Adjustment
Date. The new rate will remain In effect unlillhe next adjustment takes place. At no time will the Finance Charge rate be allowed to increase above

DEFAULT: You will be in default if (a) you fail to meet the repayment terms set forth on Page 2; (b) you take any aclion, or you fail 10 take any necessary
aclion, which adversely affects our security Interest in the property you have offered as security for this Account; or (c) you make a material
misrepresentalion or you engage In fraud In connection wilh this Account.
TERMINATION OF ACCOUNT: I( your Account Is In defautt, as defined above; we may at our option and wilhout eilher nolice or (urther demand,
eliminate your available credil by reducing your Credil Une to zero. If we do so, we will require you to return to us any unused Credil Une Account
Checks, and until you do so, and until the Unpaid Balance has been paid in full. we will not release our security interest In the real property taken
as security for your Account. We will no longer supply you wilh addilional Credil Une Account Checks. We may require you to Immediately pay any
Unpaid Balance, accrued Finance Charge and Insurance costs. We may also begin (oreclosure proceedings and sell the real property securing your
Account. None of our rights under this Agreement, Including our security Interest In the real property securing your Account, will be Impaired by our
decision to terminate your Account, and your Obligation to repay the Unpaid Balance will be unaffected.
SUSPENSION OF CREDIT PRIVILEGES: We may temporarily prohibit addillonal advances, or we may reduce your Credil Une during any period In
which (a) the value of the property securing this Account declines significantly below the value at which iI was appraised when this Account was
opened; (b) we have reason to believe that you will be unable to meet the repayment terms set forth above because there has been a material change
In any of your financial circumstances so that as of the date of any such change, you would not meet our then current standards of creditworthiness
for new Borrowers; (c) you do not abide by any material obllgalion contained In this Agreement, Including, but not Iimiled to (I) you move from the
state In which your Account was opened; or (II) you do not allow use to appraise the real property securing your Account upon our request; (d)
government action either precludes us from Imposing the Annual Percentage Rate applicable to this Agreement, or Impairs our security Interest In the
real property securing this Account by causing the value of the security to fall below 120% of your Creoil Une; or (e) the combination of the Index
and Margin would resutt In a Finance Charge rate greater than that referred to In the second paragraph of the Adjustment of Finance Charge Rate
section on Page 1 of this Agreement.
CLOSING OF ACCOUNT BY YOU: Upon 30 !Jays advance written notice to us at the address on Page 1 of this Agreement. you may close this Account
if (a) the Unpaid Balance on the Account Is zero; and (b) you have not Issued any Credil Une Account Checks which are stili outstanding. Assuming
both of these condilions are satisfied, wilhln 30 days of the receipt of your request to close the Account, we will release our security Interest In the
real property which secures this Account.
CARE OF THE REAL PROPERTY: You will pay all taxes, assessments, water or sewer charges, or any other fee or charge assessed against the real
property which secures this Account. You will also Insure the real property and any structures thereon against fire, lightning, earthquake, flood, or
any other similar physical hazards. If you fail to pay eilher the assessments or taxes against the property or if you fail to pay the premiums for the
physical damage Insurance, at our option, we may pay these charges or premiums on your behaif. If we do so, you agree that an amount equal to
the amount we expend on your behalf will be treated as a cash advance which will be added to the Unpaid Balance on this Account. Any amount
so added will bear a Finance Charge at the Daily Periodic Rate in effect at the lime of the advance.
ATTORNEY'S FEES: We may charge and collect reasonable attorney's fees and court costs, as permitted by law, if, after declaration of defautt, this
Agreement is referred to an attorney who is not our employee for the purpose of starting legal action and enforcing collection. We may also recover
reasonable expenses Incurred In recovering or selilng any collateral taken as security for this Account.
ANNUAL CHARGE: For participating In the Credit Une Account Program, you will pay an Annual Charge in the amount of $15.00, payable in advance,
, for each year this Agreement Is In effect. We will debil your Account for this charge.
DISHONORED CHECK CHARGE: We may collect from you a charge of $20.00 if you issue a check that Is returned as 'dishonored' or for 'insufficient
funds' by the financial instilutlon on which ills drawn.
DELINQUENCY CHARGE: If you do not pay the Minimum Payment wilhin 10 days of the Due Date shown on a Statement of Account, we will charge
you a Delinquency Charge of 5% of the Payment Amount.
STOP PAYMENT CHARGE: We may collect from you a charge of $20.00 if you issue a check that is returned as 'dishonored' or for 'Insufficient funds'
by the financiallnstilution on which iI is drawn.
OV~RLlMIT CHARGE: We may collect from you a charge of $20.00 if you issue a Credil Line Account Check for which you do not have sufficient
available credil and which is returned to us by the bank on which iI is drawn.
ESTIMATED SETTLEMENT COSTS: At the lime your account is opened, your Esllmated Settlement Costs will be as shown on Page 2. The Estimated
Settlement Costs Include the Recording Fee.Mortgage, Tille Search Fee, Trtle Insurance Premium, Appraisal Fees, Credil Report Fee, Survey Fees,
Satisfaction of Mortgage Fee and Loan Documen1atlon Fee, if any.
COMPLIANCE WITH ACT NO.6: If you do not pay the full amount of a Minimum Payment when ills due, and we Intend to foreclose on the Mortgage,
we must comply wilh the provisions of Sections 403 and 404 of the Act of January 30, 1974, which is known as Act No.6, and the provisions of
the Homeowner's Emergency Mortgage Assistance Act (Act No. 91 of 1983). The pertinent provisions of Sections 403 and 404 of Act No.6 are shown
