MILLIGAN, Respondent PETITION TO ENFORCE ARBITRATION AWARD AND NOW, comes the Petitioner, W. S. Miller & Sons, Inc., by and through its attorneys, Wix, Wenger & Weidner, and respectfully avers as follows: 1. Petitioner, W. S. Miller & Sons, Inc. is a corporation licensed to do business under the laws of the Commonwealth of PennsYlvania, with its principal office at 3001 Pike Street, Harrisburg, Pennsylvania 17111. 2. The Respondent, Mary E. Milligan, is an adult individual currently residing at 6 West Wind street, Lemoyne, Pennsylvania 17043. 3. On or about September 28, 1992, the Petitioner and Respondent entered into a Construction Agreement, the relevant portion of which is attached hereto as Exhibit "A," for the construction of a residence on behalf of the Respondent. 4. In the section of the Agreement titled "Administration of the Contract," Mrs. Milligan agreed as follows: All claims or disputes between the Contractor and the Owner. arising out or relating to the contract or the breach thereof, shall be decided by arbitration in accordance with the Construction Industry Arbitration , i . Rules of the American Arbitration Association currently in effect unless the parties mutually agree otherwise and subject to an initial presentation of the claim or dispute to the Architect as required under paragraph 10.5. Notice of the demand for arbitration shall be filed in writing with the other party to this Agreement and with the American Arbitration Association and shall be made within a reasonable time after the dispute has arisen. The award rendered by the arbitrator or arbitrators shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. . . . The agreement herein among the parties to the Agreement and any other written agreement to arbitrate referred to herein shall be specifically enforceable under applicable law and any court having jurisdiction thereof. (Exhibit A, Contract Agreement, p. 7-8). 5. After W. S. Miller & Sons had substantially completed construction of Ms. Milligan's r.esidence, a dispute arose between the parties as to payment to W. S. Miller & Sons under the contract and repairs which were necessary to the residence. 6. When the parties could not resolve their dispute, the matter was submitted to a panel of arbitrators from the American Arbitration Association pursuant to the Construction Agreement. 7. Testimony from the parties was taken at hearings before the panel of arbitrators from the American Arbitration Association on various dates from February 11, 1997 to August 26, 1997. 8. Initially, Petitioner had sought the amount of $115,411.27 as the payment due it from Respondent under the contract, while Ms. Milligan had entered a counterclaim for various alleged deficiencies in performance by Petitioner, as shown in the 2 ~ Award of the Arbitrator attached hereto as Exhibit "B." 9. The arbitrators awarded the Petitioner the amount of $73,866.58, which reflected the amount of $41,544.69 set off against the Petitioner's initial claim due to deficiencies in performance. (Exhibit "B,", p. 2-3). 10. The award by the arbitrators was in full settlement of all claims and counterclaims raised in the arbitration (Exhibit "B," p.3). 11. Where neither the agreement to arbitrate nor any subsequent agreement between the parties provides for statutory arbitration, common law principles are applicable. Gentile v. Weiss, 328 Pa. Super. 475, 477 A.2d 544, 546 (1984), citing, Campbell Ellsworth. Inc. v. Holv Trinitv Serbian Orthodox Church- School Conareaation, 233 Pa. Super. 126, 336 A.2d 346 (1975). 12. "The decision of the arbitrator in a common-law arbitration is binding and cannot be attacked unless it can be shown by clear, precise and indubitable evidence that a party was denied a hearing, or that there was fraud, misconduct, corruption or other irregularity which caused the rendition of an unjust, inequitable or unconscionable award." Gentile, Id., quoting caraill v. Northwestern National Ins. Co., 316 Pa. Super. 139, 462 A.2d 833, 834-835 (1983). 13. In the instant case the parties agreed that (1) all 3 ..' I' ~ . claims or disputes between them would be decided by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association; (2) any award rendered by the arbitrators shall be final; and (3) a judgment may be entered in accordance with applicable law in any court having jurisdiction over the matter. (Exhibit "A, II p. 7-8). 14. The dispute between the parties centers over the construction of a residence located in Lemoyne, Pennsylvania, which is part of Cumberland County. 15. This Court has unlimited original jurisdiction over contract disputes, including the present matter. 42 Pa.C.S.A. S 931 (a) . WHEREFORE, Petitioner, W. S. Miller & sons, Inc. respectfully requests Your Honorable Court to enter judgment against the Respondent, Mary E.
