Plaintiff is a corporation with a place of business at 500 Enterprise Road, Horsham, PA 19044. 2. Defendants Gerald E. Smith and Barbara A. Smith are believed to be residing at 4 Hays Grove Road, Newville, PA 17241. 3. On July 15, 1994, the defendants mader executed and delivered their note and mortgage to First Union Home Equity Corp. in the amount of $68,200 with interest at an annual rate of 12.5 percent, payable in monthly installments of principal and interest of $774.85 for a term of 240 months. A copy of the mortgage is attached hereto as Exhibit "A." 4. The mortgage was recorded in the Office for the Recorder of Deeds for Cumberland County, Pennsylvania in Mortgage Book 1224, page 322, and is on the premises at 4 Hays Grove Road, Penn Township, Cumberland County, PA legally described in the mortgage attached hereto as Exhibit "A." 5. The mortgage documents were subsequently assigned to plaintiff who is the current holder of same, said assignment being recorded in Misc. Book 520, page 865. 6. The defendants are the real owners of the land subject to the mortgage and their last known mailing address is set out in paragraph 2 above. 7. Default has been made by the defendants in the payment of the monthly installments since June 21, 1996 and as of November 24, 1997 the account is delinquent $13,947.30 ($774.85 per month for the period June 20, 1996 through November 24, 1997); whereupon, under the terms of the mortgage, the entire balance of principal became due and payable. 8. In accordance with the provisions of the mortgage documents and/or the Act of January 30, 1974, P.L. 13, No.6, Section 403 (41 P.S. Section 403), a Notice of Intention to Foreclose Mortgage dated was forwarded separately to each defendant by certified and regular mail. An Affidavit of Notice is attached hereto as Exhibit "B" and a copy of the notice is attached hereto as Exhibit "C." The default has not been cured. In the alternative, the notice required by the aforesaid Act does not apply in this instance since the original principal amount of the mortgage exceeded $50,000. 9. In accordance with the provisions of the Act of December 23,1983, P.L. 385, No. 91, section 2 (35 P.S. Section 1680.402c.), a Notice of Homeowner's Assistance Emergency Act of 1983 was forwarded separately to each defendant by cortified and regular mail since the mortgage was more than sixty (60) days contractually delinquent. An Affidavit of Notice is attached hereto as Exhibit "B" and a copy of said notice is attached hereto as Exhibit "D." More than thirty-three (33) days have elapsed since the mailing of said notice and no notice has been received by plaintiff advising that defendants have applied for assistance, nor have defendants arranged for a face to face meeting with a representative of the plaintiff during said period. 10.
