(a) Delcndant permitted the soda machine to become and remain in a highly dangerous
condition. with livc, opcn cleclrical circuits exposed. which existed on the premises
of Giant Food Store.
(b) Delcndantlililed 10 properly maintain the lIlaehine in a safe condition for the public,
who usually and customarily used the machine. and in particular. Plaintiff, Tilllothy
Pickel.
(c) Delcndant had a duty to properly inspect Ihc machine on a periodic basis for a
dangerous condition, such as a broken light and exposed wires.
(d) Delcndant litiled to warn the public. and in particular. Plaintiff: Timothy Pickel, of
the dangerous condition.

16. Defendant, Giant rood Stores, Inc., was negligent in
allowing live, exposed wires to exist on the premises, more
specifically as set forth below:
(a) Defendant permitted the soda machine to become and remain
in a highly dangerous condition, with live, open
electrical circuits exposed, which existed on the
premises of Giant rood Store,
(b) Defendant failed to properly maintain the machine in a
safe condition for the public, who usually and
customarily used the machine, and in particular,
Plaintiff, Timothy Pickel.
(c) Defendant had a duty to properly inspect the machine on
a periodic basis for a dangerous condition, such as a
broken light and exposed wires.

(d) Defendant failed to warn the public, and in particular,
Plaintiff, Timothy Pickel, of the dangerous condition.
17. As a direct and proximate result of the negligence of
Defendant, Plaintiff sustained severe injuries, including but not
limited to nerve damage and possibly exploratory surgery.
18. As a direct and proximate result of the negligence of
Defendant, Plaintiff has undergone great physical pain, discomfort,
and mental anguish, and will continue to endure the same for an
indefinite period of time in the future to his great physical,
emotional, and financial detriment and loss.
19. As a direct and proximate result of the negligence of
Defendant, Plaintiff has been, and will in the future be hindered
from attending to his daily activities and duties, to his great
detriment, loss, humiliation, and embarrassment.
20. As a direct and proximate result of the negligence of
Defendant, Plaintiff has suffered a loss of life's pleasures, and
will continue to suffer the same in the future, to his great
detriment and inconvenience.

21. As a direct and proximate result of the negligence of
Defendant, Plaintiff has been compelled, in order to effect a cure
for aforesaid injuries, to expend money for medicine and medical
attention,
22. As a further result of Defendant's aforesaid negligence,
Plaintiff, Timothy Pickel, sustained wage loss,
