Dear Gentlemen:
I have been appointed Chairman of an Arbitration Panel by Judge Hoffer to hear and
determine the above entitled matter. Appointed to serve with me are Jeffrey Yoffe, Esq. and
Michael Cassidy, Esq.
The essence of this case, despite some rather delailed pleadings, can be boiled down to the
facl that a toaster allegedly caused a fire and damages to Noreen Thompson and to the property of
Durrman and Kiel. There are, of course, the usual allegations and counter allegations as to
whether it is in fact a malfunctioning toaster or an abuse and misuse by Ms. Thompson, and
whether or not there are some steps that some Plaintiffs could have somehow taken to protect or
alleviate the situation.
In any event, given the number of people involved, it would probably be prudent for us to
Iry to select a date in late April or early May, 1999. Therefore, if you could each respond to me al
your earliest possible convenience with a list of dates and times at which you would be' available
during that time frame, I will allemplto set up an arbitration date, ALSO I would appreciate it if

Please be advised that I have assumed responsibility for this file from Darren Powell,
Esquire. He has provided me with a copy of your February 26, 1999 letter. Unfortunately, at
this point in time, I have not had an opportunity to review this file,
However, for personal medical reasons, I do nOI believe that I will able to participate in
an Arbilration during April or early May. Mid-Mayor June, 1999 will be more a more
appropriate timeframe for me,
Attached is a list of dates that I am available during the latter part of May and during
June. I would appreciate your consideration of this request to postpone the Arbitration to the
mid-May to June timeframe. If you need more information with regard to my medical

1 have been appointed Chairman of an Arbitration Panel by Judge Hoffcr to hear and
determine the above entitled matter. Appointed to serve with me are Jeffrey Yoffe, Esq, and
Michael Cassidy, Esq,
The essence of Ihis case, despite some rather detailed pleadings, can be boiled down to the
fact that a toaster allegedly caused a fire and damages to Noreen Thompson and to the property of
Durrman and Kiel. There are, of course, the usual allegations and counter allegations as to
whether it is in fact a malfunctioning toaster or an abuse and misuse by Ms, Thompson, and
whether or not Ihere are some steps that some Plaintiffs could have somehow taken to protect or
alleviate the situation,
In any event, given the number of people involved, it would probably be prudent for us to
try to select a date in late April or early May, 1999. Therefore, if you could each respond to me at
your earliest possible convenience with a list of dates and times at which you would be available
during that time frame, I will attempt to set up an arbitration date, ALSO I would appreciate it if

AND NOW, come the Plaintiffs, by and through their allomeys, MARTSON, DEARDORFF,
WILLIAMS & OTTO, and hereby aver as follows:
I. Plaintiff, John Durrman, is an adult individual residing at 369 Copley Drive,
Lancaster, Pennsylvania 1760 I.
2. Plaintiff, Deanna Durrman Kiel, is an adult individual residing at 733 Craigwoods
Drive, St. Louis, Missouri 63122,
3. Defendant, Noreen Thompson, is an adult individual with a last known address of
2722 Walnul Street, Apartment C, Camp Hill, Pennsylvania 170 II.
4. Defendant Hamilton Beach/Proctor-Silex is believed to be a business corporation
doing business in Pennsylvania with a corporate office located at 4421 Waterfront Drive, Glen Allen,
Virginia 23060.
5. On or about October 9,1996, Plaintiffs were the owners of an apartment building
located at 2722 Walnut Street, Camp HilI, Pennsylvania 170 II.
6. On or about the above said date, Plaintiffs leased the premises known as 2722 Walnut
Street, Apartment C, Camp Hill, Pennsylvania to Defendant Noreen Thompson, as evidenced by the
attached Lease Agreement marked as Exhibit "A".
7. At all times relevant hereto, Defendant Proctor-Silex was engaged in the manufacture
and/or distribution of Toastmaster toasters.
8. Approximately six months prior to October 9, 1996, Defendant Thompson purchased
a Toastmaster toaster from a local retail store.
9. On or about October 9, 1996, the toasler malfunctioned causing a fire in Plaintiffs'
apartment building.
10, As a direct and proximate result of the fire, two apartments in the building owned by
Plaintiffs sustained damages in the amount of$19,065,57.

12. The damage to thc aforcsaid building owncd by Plainliffs was the direct and
proximate rcsult of Ihe negligence, recklessncss and carclcssncss of Defcndant Thompson in that
she:
(a) left thc toastcr unallended while in usc;
(b) failed to use reasonable care in cxtinguishing the firc;
(c) failed to alarm the appropriate authorities in a timely fashion; and
(d) failed to exercise reasonable care in preparing her toast.
WHEREFORE, Plaintiffs demand judgment against Defendant Thompson in the amount of
$19,065.57 plus interest and costs,

Ihrough its agents and/or servants and/or employees who in tum were acting within the scope of their
employment and on behalf of Defendant Proctor-Silex,
15. All of the resultant losses and damages sustained by Plaintiffs resulted direclly and
proximately from the reckless, wanton and negligent conduct of Defendant Proctor-Silex in failing
to:
(a) properly design the toaster in order to avoid such injuries/damages;
(b) provide a backup high temperature device which would safely shut
down the toaster in the event of a malfunction; and
(c) properly and/or adequatcly manufacture the toaster in order to
provide a safe product.

was free of defects and was otherwise merchantable and fit for its intended use.
31. Defendant, Hamilton Beach/Proctor-Silex, knew or should have known that
purchasers and ultimate consumers of the toasler were relying on the skill and/or judgment of
Hamilton Beach/Proctor-Silex to select and furnish a suitable toaster fit for its intended
purpose.
32. If it should be determine that the Plaintiff suffered the damages alleged in
Plaintifrs Complaint, which is denied, then said damages were caused in whole or in part by
the Breach of Implied Warranty by Defendant, Hamilton Beach/Proctor-Silex, the negligence
of Defendant, Hamilton Beach/Proctor-Silex (as alleged in Plaintiffs' Complaint) and/or
malfunction of the toaster (as alleged in Plaintiffs' Complaint).

33. Defendant, Noreen Thompson, joins Defendant, Hamilton Beach/Proctor-Silex to
protect her rights 10 contribution and indemnification in the event that it is judicially
detennined that Defendant, Noreen Thompson and Defendant, Hamilton Beach/Proctor-Silex
are jointly and sevemlly liable to the Plaintiff or that Defendant, Hamilton Beach/Proctor-
Silex is liable over to Defendant, Noreen Thompson, the existence of any liability on the part
of Defendant, Noreen Thompson being expressly denied.
