purpose of her removal was to refiuance the property.
19. It is specifically denied that the conveyance set forth in Paragraph 12 was to avoid
payment of Jan OsterlUlld's debts. It was made because Lisa had become his wife and to foster
domestic harmony.

30. After reasonable investigation, Plaintiff is without
knowledge or information sufficient to form a belief as to the
truth of the averment that since receiving ownership of the
property referenced in Count II of Plaintiff's Complaint,
Defendants Wilma J. Osterlund and Eugene B. Scheer have invested
$1,367.31 in improvements to the property; therefore, same
averments are deemed to be denied and strict proof thereof is
demanded at trial to the extent said averments are relevant.
31. After reasonable investigation, Plaintiff is without
knowledge or information sufficient to form a belief as to the
truth of the averment that since receiving ownership of the
property referenced in Count II of Plaintiff's Complaint,
Defendants Wilma J. Osterlund and Eugene B. Scheer have performed
more than 54 hours of labor in the improvement of the property,
therefore, same averments are deemed to be denied and strict
proof thereof is demanded at trial to the extent said averments
are relevant.

AND NOW, comes the plaintiff, SANDRA H. OSTERLUND, by her
attorneys, Snelbaker, Brenneman & Spare, P. C. and sets forth the
following cause of action:
BACKGROUND
1. plaintiff, Sandra H. osterlund, is an adult individual
residing at 409 Deerfield Road, camp Hill, cumberland county,
Pennsylvania.
2. Defendant Jan A. Osterlund is an adult individual
residing at 1515 Slate Hill Road, Camp Hill (Lower Allen
Township) cumberland county, Pennsylvania.
3. Defendant Lisa M. Ficarri-Osterlund, also known as Lisa
M. Osterlund, is an adult individual residing at 1515 Slate Hill
Road, Camp Hill (Lower Allen Township) cumberland county,
Pennsylvania.

4. Defendant Wilma J. osterlund is an adult individual
residing at 1525 Slate Hill Road, Camp Hill (Lower Allen
Township) Cumberland county, pennsylvania.
the sum of $25,000.00 per year in equal payments two times a
month.
9. Since the initiation of the Equity Action, Sandra H.
Osterlund has made continuous and repeated efforts to collect
sums due to her from Jan A. Osterlund.
10. Jan A. Osterlund has been found to be in contempt of
court in the Equity Action on several occasions.
11. On or about July 9, 1993, Jan A. Osterlund married Lisa
A. Ficarri, now sometimes known as Lisa A. Osterlund and
sometimes known as Lisa A. Ficarri-osterlund, Defendant herein.
COUNT I
12. Jan A. Osterlund and Lisa M. Ficarri-Osterlund conveyed
the 1515 Slate Hill Road premises to Jan A. Osterlund and Lisa M.
Ficarri-osterlund for $1.00 by deed dated January 31, 1995 and
recorded in the Office of the Recorder of Deeds in and for
Cumberland county, Pennsylvania in Deed Book 118, Page 115, a
copy of which is attached hereto as Exhibit "A" and incorporated
herein by reference thereto.

13. Prior to the January 31, 1995 conveyance described in
the foregoing paragraph, Jan A. Osterlund was the sole owner of
the 1515 Slate Hill Road premises.

14. On May 22, 1996, a judgment in the amount of $7,500.00
was entered in favor of Sandra H. Osterlund and against Jan A.
Osterlund in the Equity Action.
15. On April 14, 1997, a judgment in the amount of
$16,508.60 was entered in favor of Sandra H. Osterlund and
against Jan A. Osterlund.
16. On or about April 22, 1997, Jan A. Osterlund and Lisa
M. Ficarri-osterlund conveyed the 1515 Slate Hill Road premises
to Jan A. Osterlund in consideration of $1.00 by deed dated April
22, 1997 and recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania in Deed Book 158, Page
423, a copy of which is attached hereto as Exhibit "B" and
incorporated herein by reference thereto.
17. Jan A. Osterlund was insolvent at the time of the
conveyance set forth in Paragraph 12 hereinabove or became
insolvent as a result of said conveyance.
18. The conveyance set forth in Paragraph 12 hereinabove
was made with actual intent to hinder, delay or defraud Sandra H.
Osterlund, a present and future creditor of Jan A. Osterlund.
19. The conveyance set forth in Paragraph 12 hereinabove
was made without Jan A. Osterlund receiving a reasonably
equivalent value in exchange for the transfer and Jan A.

Osterlund reasonably should have believed that he would continue
to incur debts beyond his purported ability to pay.
WHEREFORE, Plaintiff Sandra H. Osterlund requests avoidance
of the transfer set forth in Paragraph 12 hereinabove; an
attachment of the asset transferred; an injunction against
further disposition of the assets by Defendants and other relief
as circumstances may require.
COUNT II
20. Paragraphs 1 through 19 hereinabove are incorporated
herein by reference thereto.
21. On or about March 27, 1996, Jan A. Osterlund and Lisa
M. Osterlund conveyed for $1.00 to Wilma J. Osterlund and Eugene
B. Scheer, husband and wife, a certain parcel of land situated in
Lower Allen Township know as Lot 11A as shown on the
Preliminary/Final Subdivision Plan for Jan Osterlund recorded in
Plan Book 71, Page 143 in the Cumberland county Courthouse by
deed dated March 27, 1996 and recorded in the Office of the
Recorder of Deeds in and for Cumberland county, Pennsylvania in
Deed Book 137, Page 158. A copy of said deed is attached hereto
and incorporated by reference herein as Exhibit "C".

22. Jan A. Osterlund was insolvent at the time of the
conveyance set forth in paragraph 21 hereinabove or became

distribution in said Divorce Action.
27. As the conveyance from Jan A. Osterlund and Lisa M.
Ficarri-Osterlund described in Paragraph 12 hereinabove was a
fraudulent transfer as set forth in Count I hereinabove, the
premises known as 1515 Slate Hill Road is not marital property
subject to equitable distribution in the Divorce Action between
Jan A. Osterlund and Lisa M. Osterlund.
WHEREFORE, Plaintiff Sandra H. Osterlund requests avoidance
of the transfer set forth in Paragraph 12 hereinabove; a
declaratory jUdgment providing that the premises known as 1515
Slate Hill Road is not marital property subject to equitable
distribution in the Divorce Action between Jan A. Osterlund and
Lisa M. Osterlund; an attachment of the asset transferred; an
injunction against further disposition of the asset by Defendants
and other relief as circumstances may require.

5. Defendant Eugene B. Scheer is an adult individual
residing at 1525 Slate Hill Road, Camp Hill (Lower Allen
Township) Cumberland County, Pennsylvania.
6. In or about November, 1992, Plaintiff Sandra H.
osterlund initiated an equity action in the Court of Common Pleas
of Cumberland County, Pennsylvania docketed to No. 48 Equity 1992
(hereinafter "Equity Action") against Defendant Jan A. osterlund
to enforce her rights pursuant to a certain Divorce Settlement
Agreement.
7. A Decree dated May 24, 1993 in the Equity Action
provided, inter alia:
1. A decree is entered in favor of plaintiff,
Sandra H. Osterlund against defendant, Jan A. Osterlund
in the amount of $8,058.74.
2. Defendant, Jan A. osterlund, is ordered to
maintain Blue/Cross/Blue Shield, major medical or its
equivalent as required by paragraph 15 of the divorce
settlement agreement, and further ordered to provide
plaintiff notice within one (1) day of either non-
payment of any premium due or cancellation of such
medical coverage.
3. Defendant, Jan A. Osterlund, is ordered to
make all payments when due to plaintiff as required
under the terms of the divorce settlement documents.
4. Counsel fees are awarded to plaintiff in the
amount of $3,547.50.

in required, inter alia, to pay alimony to Sandra H. Osterlund in

14. On May 22, 1996, a judgment in the amount of $7,500.00
was entered in favor of Sandra H. Osterlund and against Jan A.
Osterlund in the Equity Action.
15. On April 14, 1997, a jUdgment in the amount of
$16,508.60 was entered in favor of Sandra H. Osterlund and
against Jan A. Osterlund.
16. On or about April 22, 1997, Jan A. Osterlund and Lisa
M. Ficarri-Osterlund conveyed the 1515 Slate Hill Road premises
to Jan A. Osterlund in consideration of $1.00 by deed dated April
22, 1997 and recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania in Deed Book 158, Page
423, a copy of which is attached hereto as Exhibit liB" and
incorporated herein by reference thereto.
17. Jan A. Osterlund was insolvent at the time of the
conveyance set forth in Paragraph 12 hereinabove or became
insolvent as a result of said conveyance.
18. The conveyance set forth in Paragraph 12 hereinabove
was made with actual intent to hinder, delay or defraud Sandra H.
Osterlund, a present and future creditor of Jan A. Osterlund.
19. The conveyance set forth in Paragraph 12 hereinabove

was made without Jan A. Osterlund receiving a reasonably
equivalent value in exchange for the transfer and Jan A.

distribution in said Divorce Action.
27. As the conveyance from Jan A. Osterlund and Lisa M.
Ficarri-osterlund described in Paragraph 12 hereinabove was a
fraudulent transfer as set forth in Count I hereinabove, the
premises known as 1515 Slate Hill Road is not marital property
subject to equitable distribution in the Divorce Action between
Jan A. Osterlund and Lisa M. Osterlund.
WHEREFORE, Plaintiff Sandra H. Osterlund requests avoidance
of the transfer set forth in Paragraph 12 hereinabove; a
declaratory judgment providing that the premises known as 1515
Slate Hill Road is not marital property subject to equitable
distribution in the Divorce Action between Jan A. Osterlund and
Lisa M. Osterlund; an attachment of the asset transferred; an
injunction against further disposition of the asset by Defendants
and other relief as circumstances may require.
