PETITION FOR PROTECTION ORDER
RELIEF UNDER THE PROTECTION "'ROM ABUSE
ACT, 23 Pa.C.S. 96101 et seq.
A. ABUSE
1. The plaintiff, Lauric K. McKillip, is an adult individual residing at 6 I 0 S. Spring
Garden Street, Carlisle, Cumberland County, Pennsylvania 17013.
2. The defendant, Daniel K. Darr, (SSN: 184-62-06(9)(Date ofBirth: 7/10/65), is an
adult individual residing at 762 Grahams Woods Road, Newville, Cumberland County,
Pennsylvania, 17241.
3. The defendant has had an intimate relationship with the plaintill~
4. Since approximately the Summer of 1997, the defendant has attempted to cause
and has intentionally, knowingly, or recklessly caused bodily i1liury to the plaintiff, has placed the
plaintiff in reasonable fear of imminent serious bodily injUlY, and has knowingly engaged in a
course of conduct or repeatedly committed acts toward the plaintiff under circumstances which
have placed the plaintiffin reasonable fear of bodily injury. This has included, but is not limited
to, the following specific insbnees of abusc:
a. On or about January 19, 1998, the defendant telephoned the
plaintiff at her brother's residence, and left two separate messages
on an answering machine threatening to punch hcr in thc face and 10
kill her causing her to fcar for her safety.
b. In or about the Fall of 1997, thc defendant forcefully kicked
the plaintiff in the hip causing a bruise and shoved her into a hutch
cllusing her pain.
c. In or about the Summer of 1997, the defendant choked the
plaintiff leaving marks and threw her onto a couch eausing her pain.
5. The plaintiff believes and therefore avers that she is in immediate and present
danger of abuse from the dcfendant and that she is in need of protection from such abuse.
6 The plaintiff desires that the defendant be prohibited from having any direct or
indirect contact with the plaintiff including, but not limited to, telephone and writtcn
communications.
7 The plaintiff desires that the defendant be enjoined from harassing and stalking the
plaintiff, and from harassing the plaintiffs relatives.
8. The plaintiff desires that the defendant be enjoined from damaging or destroying
any propcrty owned solely by the plaintiff or owned jointly by the parties.
9 The home which the plaintiff is asking the Court to order the defendant to stay
away from is not owned or rented in the defendant's name.
10 The defendant is renting a residcnce locatcd at 762 Grahams Woods Road,
Newville, Pennsylvania.
B. REIMBURSEMENT FOR COST 01<' CASE
11. The plaintiff asks that thc defendant bc ordercd to pay $250.00 to reimburse one of
Legal Serviecs, Inc. 's funding sources for the cost of litigating this case.
WHEREFORE, pursuant to the provisions of the "Protection from Abll8C Act" of October
7, 1976, 23 Pa.C.S. ~ 6101 91 ~t;g., as amended, the plaintiff prays this Honorable Court to grant
the foUowing relief:
A. Grant a Temporary Order pursuant to the "Protection from Abuse Act:"
1. Ordering the defendant to refrain from abusing the
plaintiff or placing her in fear of abll8c.
2. Ordering the dcfcndant to rcfrain from having any
direct or indirect contact with the plaintiff including, but not limited
to, telephonc and written communication.
3. Ordcring the dcfendant to refrain from harassing and
stalking the plaintiff and from harassing the plaintift's relatives.
4. Prohibiting the dcfcndant from damaging, or
destroying property owned solely by the plaintiff or owned jointly
by the parties.
5. Ordering the defendant to stay away from the
plaintift's residence located at 610 S. Spring Garden Street, Carlisle,
Cwnberland County, Pennsylvania, and any other residence the
plaintiff may cstablish.
B. Schcdulc a hcaring in accordancc wi!h !hc provisions of!hc "Protcction from
Abusc Act," and, after such hcaring, cnter an ordcr to be in effcct for a period of onc year:
1. Ordcring !hc dcfcndantto refrain from abusing !he
plaintiff or placing hcr in fear of abuse.
2. Ordering the defendant to refrain from having any
direct or indirect contact wi!h !he plaintiff including, but not limited
to, tclephonc and written communications.
3. Ordering !he defendant to refrain from harassing and
sta1king !he plaintiff and from harassing thc plaintiffs.
4. Prohibiting !he defendant from damaging or
destroying any property owned solcly by !hc plaintiff or owned
jointly by !he parties.
5. Ordering !he defendant to stay away from !he
plaintiffs residence locatcd at610 S. Spring Garden Street, Carlislc,
Cumberland County, Pennsylvania, any o!her residence thc plaintiff
may establish.
6. Ordering thc defendant to pay $250.00 to rcimburse

Court finds that the defendant has eommilled another act of abuse or ha.~ engaged in a pattern or
practice that indicates continued risk of harm to the plaintiff.
8. A violation of this Order may subject the defendant to: i) arrest under 23 Pa.C.S.
~6113; ii) a private criminal complaint under 23 Pa.C.S. ~6113.1; iii) a charge of indirect criminal
contempt under 23 Pa.C.S. ~6114, punishable by imprisonment up to six months and a fme of
$100.00-$1,000.00; and iv) civil contempt under 23 Pa.C.S. ~6114.1. Resumption of eo-
residence on the part of the plaintiff and defendant shall not nullifY the provisions of the court
order.
9. The Pennsylvania State Police Department shall be provided with a certified copy
of this Order by the plaintiff's attorney and may enforce this Order by arrest for indirect criminal
contempt without warrant upon probable cause that this Order has been violated, whether or not
the violation is committed in the presence of a police officer. In the event that an arrest is made
under this section, the defendant shall be taken without unnecessary delay before the court that
issued the order. When that court is unavailable, the defendant shall be taken before the
appropriate district justice. (23 Pa.C.S. ~ 6113).
